HomeMy WebLinkAbout3-24-2004 HE MINUTES CALDWELL PUBLIC HEARING BEFORE HEARING EXAMINER • MINUTES March 24, 2004 I. Cail to Order — Hearing Examiner, M. Jerome Mapp, opened the meeting for the public hearing at 7:02 p.m. II. Review of Proceedings — Mr. Mapp outlined the procedures for the public hearing. Members Present: Steve Hasson, Community Development Director, Debbie Geyer, and Scott Woods, Engineering staff. III. Old Business The Hearing Examiner approved and signed minutes of January 28, January 30, 2004 and February 25, 2004. IV. Hearings - A. CASE NUMBER SUB-83P(E)-03, a request by Hubble Engineering, Inc., for a one-year extension of the preliminary plat of Montecito Park Subdivision granted by City Council on June 3, 2003. The subdivision consists of 243 residential lots • and 6 common-area lots with 20 acres of the site zoned C-4 (Interstate or Freeway Commercial) and 60 acres zoned R-1 (Single-Family Residential). The site is located at the northwest corner of Aviation Way and Hwy. 20/26 and extends approximately one-half mile north. Testimony: Steve Hasson, Community Development Director, presented the staff report. Gary Himes, Applicant's Representative, signed in favor but chose not to speak. Findings of Fact on Case No. SUB-83P(E)-03: The Hearing Examiner accepted the general facts as outlined in the staff report, and public testimony. Conclusions of Law on Case No. SUB-83P(E)-03: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Order of Decision on Case No. SUB-83P(E)-03: The Hearing Examiner approved Case No. SUB-83P(E)-03 with the conditions outlined in the staff • report. Public Hearing Closed - Mr. Mapp closed the public hearing. B. CASE NUMBER OA-59-04, a request by the Community Development Director • to modify Zoning Ordinance No. 1451, Section 10-03-07, Planned Unit Development, to clarify the description and intent of the planned unit development process. Testimony: Steve Hasson, Community Development Director, presented the staff report. Public testimony closed — Mr. Mapp closed public testimony. Findings of Fact on Case No. OA-59-04: The Hearing Examiner accepted the general facts as outlined in the staff report, and public testimony. Conclusions of Law on Case No. OA-59-04: The Hearing Examiner accepted the Conclusions of Law as outlined in the staff report. Recommendation on Case No. OA-59-04: The Hearing Examiner approved Case No. OA-59-04 with the conditions outlined in the staff report. Public Hearing Closed - Mr. Mapp closed the public hearing. • C. CASE NUMBER OA-57-04, a request by the Community Development Director to adopt an amended zoning map that supersedes and replaces the zoning map as adopted by City Council on May 22, 2003 (Ordinance No. 2464). The new map includes all rezones and annexations that occurred between January 1, 2003 and December 31, 2003. All of the zone boundary changes that occurred during the time period were approved by City Council all respective public hearings help pursuant to the requirements of Idaho Code, Title 67, Chapter 65, Local Planning Act.
