Call to Order — Chairman Alldredge called the meeting to order for the public hearing at 7:00 p.m. II. Roll Call — Members Present: Paul Alldredge, Janie Archuleta, Jack Teraberry, Joyce Griffith, Dennis Callsen, and Michael Jakobson. Members Absent: Staff Present: Steve Hasson, Community Development Director, Debbie Geyer and Scott Woods (Engineering Staffl. III. Review of Proceeding — Chairman Alldredge reviewed the procedures for public hearing. IV. Consent Calendar �, A. North Lake Acres Subdivision (Exhibit A) ' Scott Woods, Engineering Department, stated that in accordance with the � Idaho Code concerning proposed subdivisions located with the Area of City impact, irrigation systems must be approved by both Canyon County and the City of Caldwell. He noted that the proposed irrigation system for North Lake Acres Subdivision has been reviewed by the City Engineering Department and would recommend its approval by the Planning & Zoning Commission. MOTION/Commissioner Teraberry, SECOND/Commissioner Griffith Approve irrigation plans for the North Lake Acres Subdivision as recommended by the City of Caldwell Engineering Department. Passed: Unanimous roll call vote. V. Old business VI. New Business - Hearings A. Case No. SUP/PUD-209-04, a request by Sharon Bourasa for a Planned Unit Development through a special use permit to place an espresso drive thru on a parcel already occupied by a carwash located at 4422 East Ustick Road in a C-3 (Service Commercial) zone. Steve Hasson, Community Development Director, presented the staff report. Gina Emery, ApplicanYs Representative, testified in favor. • Rodney Orrison, signed in favor, but did not to speak. : , • Testimony closed. Comprehensive Plan Analysis - MOTION: Commissioner Archuleta ' SECOND: Commissioner Jakobson. The request was applicable to the following Comprehensive Plan Components as outlined in the staff report: Property Rights — Goal, Objective B and Policy 1; School Facilities and Transportation — Goal, and Policy 1; Economic Development — Goal; Land Use — Goal, Objectives Applicable to All Land Uses — Objective A and C, Policies Service, Utilities and Facilities — Goal, Objective B, Policies 1, 5, 6 and 7; Transportation — Goal and Objective A; Community Design — Goal, Objective A, E and Policy 2. Findings of Fact on Case No. SUP/PUD-209-04 - MOTION: Commissioner Griffith SECOND: Commissioner Alldredge. Accept the general facts outlined in the staff report, staff/public testimony and other pertinent facts. Passed: Unanimous roll call vote. Conclusions of Law on Case No. SUP/PUD-209-04 - MOTION: Commissioner Jakobson SECOND: Commissioner Alldredge. The Planning & Zoning Commission has the authority to hear this request and to recommend to the Mayor and City Council that it is approved or denied. The hearing was • legally noticed and posted, and was held under the requirements of Idaho Code and City ordinances. Passed: Unanimous roll call vote. Order of Decision on Case No. SUP/PUD-209-04 - MOTION: Commissioner Alldredge SECOND: Commissioner Griffith. The Commission approved Case No. SUP/PUD-209-04 with the conditions outlined in the staff report. Passed: Unanimous roll call vote. Public Hearing Closed — Chairman Alldredge closed the public hearing. ................................................................ B. To hear concurrently Case Nos. ZON-37-04 and SUP/PUD-208-04, requests by Jeffrey Hall for a Planned Unit Development through a special use permit to allow an espresso drive thru on a parcel to be occupied by a carwash located at the southeast corner of North 10 Avenue and Freeport Street, allow off-site parking in an R-3 zone, and rezone Lots 16 and 17 in Block 54 of Boone's Addition from R-3 (Multi- Family Residential) to C-2 (Community Commercial). As a part of the rezone request, the Comprehensive Plan Land Use Map would be amended to designate this parcel as commercial; the amendment would be included in the next available update of the Comprehensive � Land Use Map. Planning & Zoning Commission Minutes — March 10, 2004 , . , � Steve Hasson, Community Development Director, reported that the applicant • has requested that the application be pulled from the agenda inasmuch as alterations had been made to the site plan. The case will be renoticed for public hearing on April 14, 2004 before the Planning and Zoning Commission. ................................................................ I VIII. In addition, the irrigation entity charged with the delivery of water to said lands must be advised regarding the irrigation system. The Engineering Department has reviewed the proposed irrigation plan for the above mentioned subdivision and recommends its approval. The City of Cald��ell Engineering Department has future design, alignment and grades a��ailable. Applicant �►�il! be required to connect to City services when available. It is the recommendation of the City of Cald�i�ell Engineering Department that the applicant- be required to preserve the right-of-way and setbacks required for a Local Road to atlo�v for future construction of this roadH�ay. The Cify of Caldwell requires a minimum of 28- foot one-half width right-of-way. The applicant should be aware that all street improvements �vithin the right-of-way �►�i[I be required to conform to the standards and requirements set forth by Idaho Transportation Department, Cany�on County � District No. 4 and the City of Cald«�ell, as applicable. The City of Caldwell standards require construction of road�vay improvements to include curb, gutter and sidetivalk.
