Call to Order — Chairman Alldredge called the meeting for the public hearing at 7:03 p.m. _ II. Roll Call — Members Present: Chairman Paul Alldredge, Janie Archuleta, Jack Teraberry, Joyce Griffith, and Michael Jakobson. Members Absent: Staff Present: Steve Hasson, Community Development Director, Debbie Geyer and Scott Woods (Engineering Staf�. III. Review of Proceeding - Chairman Archuleta reviewed the procedures for public hearing. IV. Old business — MOTION/Approve minutes for December 10, 2003 and January 14, 2004. Passed: Unanimous roll call vote. V. New Business - Hearings • A. Case No. OA-55-04, a request by the Community Development Director to add daycare requirements to Zoning Ordinance No. 1451, Sections 10-02-09 (Home Occupations) and 10-02-10 (Child Care Facilities) relating to inspections and background checks. Steve Hasson, Community Development Director, presented the staff report and letter of support from the following: Testimony closed. Comprehensive Plan Analysis - MOTION: Commissioner Teraberry SECOND: Commissioner Jakobson. The request was applicable to the following Comprehensive Plan Components as outlined in the staff report: Property Rights — Goal, Objectives A, B and Policy 1; School Facilities and Transportation — Goal, Objectives A and Policies 1, 2, 3; Economic Development — Goal, Objective A, B and Policy 1; Land Use — Goal, Objectives Applicable to All Land Uses — Objective A, Policies for Residential Use — Policies 1, 2 and 3. Findings of Fact on Case No. OA-55-04 - MOTION: Commissioner • Archuleta SECOND: Commissioner Teraberry. Conclusions of Law on Case No. OA-55-04 - MOTION: Commissioner Griffith SECOND: Commissioner Archuleta. The Planning & Zoning Commission has the authority to hear this request and to recommend to the Mayor and City Council that it is approved or denied. The hearing was legally noticed and posted, and was held under the requirements of Idaho Code and City ordinances. Passed: Unanimous roll call vote. Recommendation on Case No. OA-55-04 - MOTION: Commissioner Griffith SECOND: Commissioner Jakobson. The Commission approved Case No. OA-55-04 with the conditions outlined in the staff report.
