CALDWELL PUBLIC HEARING BEFORE HEARING EXAMINER
• MINUTES
July 30, 2003
I. Call to Order — Hearing Examiner, M. Jerome Mapp, opened the meeting for the
public hearing at 7:06 p.m.
II. Review of Proceedings — Mr. Mapp outlined the procedures for the public
hearing.
Members P resent: S teve H asson, C ommunity D evelopment D irector a nd J oan
Johnson, and Scott Woods, Engineering staff.
III. Hearings -
A. Case No. SUP-190-03, a request by Lanny Berg for special use permit
approval of a duplex in an R-1 (Single Family Residential) zone. The parcel
is located at 1405 & 1407 Larch Street or the northeast corner of Colorado
and Larch.
Testimony:
Steve Hasson, Community Development Director, presented the staff report.

Robert Penner, testified neutral.
Public testimony closed — Mr. Mapp closed public testimony.

Comprehensive Plan Analysis: Mr. Mapp found that the request was applicable
to the following Comprehensive Plan components: Property Rights - Goal,
Objectives A, B and Policy 1; School Facilities and Transportation — Goal and
Policy 1; Economic Development — Goal, Objectives A, C, D and Policy 2; Land
Use — Goal, Objectives Applicable to All Land Uses - Objectives A, C, Objectives
Applicable to Residential Land lJse — A and B; Natural Resources — Goal and
Policy 1; Public Services, Utilitie�� and Facilities — Goal, Objective A, Policies 1, 2,
5 and 7; Transportation — Goal, Objective A and Policy 5; Community Design —
Goal, Objectives A, E and Policy 6.
Findings of Fact on Case No. SUP-190-03: The Hearing Examiner accepted
the general facts as outlined in the staff report.
Conclusions of Law on Case No. SUP-190-03: The Hearing Examiner
• accepted the Conclusions of Law as outlined in the staff report.

• Case No. SUP-190-03 with the condition outlined in the staff report.

B. Case No. SUP-191-03, request by VW I nvestments for special use permit
approval to place a Class B manufactured home in a C-3 (Service
Commercial) zone. The site is located on the south side of Linden Street
approximately 560 feet east �if Cleveland Blvd or 2822 E Linden Street.

Due to the fact the Applicant submitted a withdrawal letter the public hearing was
cancelled on Case SUP-191-03. �

C. Case No. ZON-35-03, a request by Gunstream Commercial Real Estate to
rezone approximately 13.2 acres from an M-1 (Light Industrial) zone to a C-3
(Service Commercial) zone. The parcels are located at the southwest corner
of the intersection of S. 21S Avenue and Chicago Street and abut the
northeast side of the Oregon Shortline Railroad right-of-way.

Carl Woodburn, Owner, testified in favor.

recommends to the City Couneil that the comprehensive land use map be
modified to reflect the request.
Recommendation on Case No. ZON-35-03: The Hearing Examiner
recommended approval of Case No ZON-35-03 with the condition outlined in the
staff report.
Public Hearing Closed - Mr. Mapp closed the public hearing.
