CALDWELL PUBLIC HEARING BEFORE HEARING EXAMINER
MINUTES
October 3, 2001
I. Call to Order — Hearing Examiner, M. Jerome Mapp, opened the meeting for the
public hearings at 7:00 p.m. and outlined the public hearing procedures. City stafF
members in attendance were: Steve Hasson, Community Development Director,
Joan Holmes, Debbie Geyer and Ben Weymouth (Engineering).
II. Hearings
A. Case No. SUP-135-01, a request by Ron Gish to use a lot located in an M-
1(Light Industrial) zone for the purpose of storing and transferring propane fueL
The site is located approximately 560 feet northeast of the intersection of
Cleveland Boulevard and Tates Way, parallel to the west side of Tates Way.
Testimony
Steve Hasson; Community Development Director, presented the staff and provided
an overview of this request.
� It was noted that there was a previnus approved special use permit on the adjoining �
parcel (SUP-61-99). Discussion followed between the Hearing Examiner and Steve
Hasson concerning the previous SUP and whether this one will replace it.
Ben Weymouth, Assistant City Engineer, addressed questions from the Hearing
Examiner concerning the road conditions.
Ron Gish, Applicant, testified in favor of the extension.
Public Testimony Closed — Mr. Mapp closed public testimony.
Findings of Fact — Mr. Mapp accepted the general facts outlined in the staff report
as well as the facts brought forward during the public testimony.

Conclusions of Law — Mr. Mapp accepted the Conclusions of Law outlined in the ��
staff report.
Order of Decision — Mr. Mapp approved SUP-135-01 with the conditions as outlined
in the staff report.
Public Hearing Closed — Mr. Mapp closed the public hearing and noted anyone
wishing to appeal his decision should see the Community Development Director.

B. Case No. SUP-97E-00, a request by the Carrington Company for approval of a
one-year time extension of the special use permit for a planned unit development
for a retail center approved by the Caldwell Hearing Examiner on September 2,
2000. The site is located at the southeast corner of the intersection of Ustick
Road and S. 10` Avenue.
Testimony —

Joan Holmes, Community Development Planner I, presented the staff report
concerning the time extension request.
Orville Collins, Representative for the Applicant, testified in favor of the extension.
Public Testimony Closed — Mr. Mapp closed the testimony.
Findings of Fact: The Hearing Examiner accepted the general facts outlined in the
staff report as well as the facts brought forward during public testimony.
Conclusions of Law: Mr. Mapp accepted the Conclusions of Law outlined in the
staff report.
Order of Decision: Mr. Mapp approved SUP-97(E)-00 for a one year time extension
on the special use permit granted September 2, 2000.
Public Hearing Closed — Mr. Mapp closed the public hearing and noted anyone
wishing to appeal his decision should see the Community Development Director.
C. Case Nos. SUP-136-01 and ZON-15-01, a request by George Pierce to rezone a
parcel from R-3 (Multi-family High Density Residential) to a C-1 (Neighborhood
Commercial) zone and a request for approval of a special use permit to operate a
duplex .on the aforementioned site. The site is located at the corner of Second
Avenue and Everett Street and is more commonly known as 203, 203 %z ; and
204 Everett Street.
Testimony —
Steve Hasson, Community Development Director, presented the staff report.
George Pierce, Applicant, spoke in favor of the requests. Mr. Pierce stated that he
was considering opening an upholstery shop in the vacant commercial building.
Discussion followed between the Hearing Examiner and Staff concerning which land
use category aligned with an upholstery shop relative to uses defined in the Caldwell
Zoning Ordinance.
Public Testimony Closed — Mr. Mapp closed the testimony.
Comprehensive Plan Analysis on ZON-15-01: Mr. Mapp found that the request
was applicable to the following Comprehensive Plan components: Property Rights —
Goal, Objective B, Policy 1; School Facilities and Transportation — Goal, Policy 1;
Land Use — Goal, Objectives Applicable to all Land Uses — Objective C and Goal,
Objective A, Objective D, Objective E; Natural Resources — Objective A, Objective C,
Policy 1; Public Services, Utilities and Facilities — Goal, Objective B; Transportation —
Goal, Objective A; Community Design — Goal, Objective A, Objective E. Emphasis
was placed on the Land Use (5.3) — Objective E.
Findings of Facts on ZON-15-01: Mr. Mapp accepted the general facts outlined in
the staff report as well as the facts brought forward during public testimony as the
Findings of Fact. _
Conclusions of Law on ZON-15-01: Mr. Mapp accepted the Conclusions of Law
outlined in the staff report.
