MINUTES OF MARCH 12, 2001
I. Call to Order — Commissioner Archuleta called the meeting to order at 7:00 p.m
II. Roll Call
Members Present: Janie Archuleta, Tracy Coller, Sylvia Robison, Jack Teraberry
Staff Absent: Jim Blacker
Staff Present: Jerome Mapp, Joan Holmes
Legal Counsel: George DeFord
III. Review of Proceedings — Commissioner Archuleta reviewed the procedures for public hearings.
IV. Poll Members for Conflict of Interest - Commissioner Archuleta polled members for conflicts of interest: There
were none.
V. Old Business — Approve Minutes of February 23, 2001. Motion: Comrnissioner Teraberry. Second:
Commissioner Robison. Passed: Unanimous voice vote. Approve Recommendations on Case No. ANN-48-01
(Roman Catholic Diocese of Boise) and Case No. OA-33-01 (Craig Cooper). Approve Orders of Decision on
Case No. SUB-41P(E)-99 (Crystal Springs) and Case No.VAR-20-01 (Canyon Co. Habitat for Humanity).
, Motion: Commissioner Robison. Second: Commissioner Teraberry. Approve as written. Passed: Unanimous
voice vote.
VI. New Business — Hearings
A. Case No. ANN-50-01 a request by the Tarrant Family to annex approximately 76.46 acres into the City.
Approximately 16.44 acres is being requested as C-2 (Comn�uw�ty Commercial) zone. The commercial
parcel is located at the southwest comer of the intersection of Ustick Road and South 10�' Avenue. As
part of the annexation request, the Comprehensive Plan Land Use^ Map would be amended to designate
the 16.44-acres parcel as Commercial; the amendment would be included in the neact available update of
the Comprehensive Land Use Map. In addition, 60.02 acres is being requested as R-2 (Medium Density
Residential) zone, which begins approximately 660 feet southwest from the intersecrion of Ustick Road
and South 10'� Avenue and would abut the southern portion of the proposed C-2 (Community
Cominercial) zone.

Recommendation to City Council on Annezation - Commission members recommended approval of the
anne�tion into the City of Caldwell. Morion: Commissioner Teraberry. Second: Commissioner Robison.
Passed: Unanimous voice vote.
Recommendation to City Council on Comp Plan Amendment - Commission members recommended approval
of amending the Comprehensive Plan Map with the annexation of this parcel. Motion: Commissioner Robison.
Second: Commissioner Teraberry. Passed: Unanixnous voice vote.
Comprehensive Plan Analysis — Motion: Commissioner Robison. Second: Commissioner Teraberry. The
request was applicable to the following Comprehensive Plan components set forth in the staff report: Property
Rights — Goal, Objective B, and Policy 1; School Facilities and Transportation — Goal, and Policy 1; Land Use —
Goal, Objectives Applicable to all Land Uses — C; Area of City Impact — Objective A and Policy 5; Public
Services, Utilities and Facilities — Goal, Objective B, and Policy 5. Passed: Unanimous roll call vote.
Findings of Fact — Motion: Commissioner Robison. Second: Commissioner Teraberry. Accept the general facts
outlined in the staff report as Findings of Fact and include the following facts from testimony: 1) The request
complies with the Comprehensive Plan as outlined; 2) The site is within the area of City impact and is contiguous
to the City; 3) It is appropriate to change the land use designation on the Cornprehensive Plan Map to commercial;
4) It is appropriate to zone the 16.44 acres C-2 as requested; 5) Cominission members discussed the residential
zoning in the immediate vicinity and voted to recommend R-1 (Single Fanuly Residential) zoning instead of the R-
2 zoning as requested. Passed: Unanimous roll call vote.
Conclusions of Law — Motion: Commissioner Robison. Second: Commissioner Teraberry. The Commission has
the authority to hear this case and approve or deny; public notice requirements were met; and the hearing was
conducted within the guidelines of Idaho Code and City ordinances. Passed: Unanimous roll call vote.
Recommendation to City Council — Motion: Commissioner Robison. Second: Comxnissioner Coller.
Commission members recommended approval of Annexation, the Comp Plan Amendment and Zoning on Case
No. ANN-50-01, with the recommendation that the residential zoning be R-1 (Single Fanuly Residential) instead
of R-2 as requested. Passed: Unanimous roll call vote.
Public Hearing Closed — Commissioner Archuleta closed the public hearing.

B. To hear concurrently, Case Nos. ANN-51-01 and SUB-61P-01, a request by Logan's Crest, Inc. to annex
approximately 5 acres into the City as an R-1 (Single Family Residential) zone and preliminary plat
�, approval of Logan's Crest Subdivision, which consists of 20 residential lots and one 1 common area lot.
The site abuts the north side of Logan Street and is approximately 700 feet east of Farmway Road.

Services, Utilities and Facilities — Goal and Objective B; Transportation — Goal and Objecrive A. Passed:
Unanimous roll call vote.
Findings of Fact on ANN-51-01 — Motion: Commissioner Robison. Second: Cominissioner Teraberry. Accept
the general facts outlined in the staff report as Findings of Fact and include the public testimony and
comprehensive plan analysis as outlined. Passed: Unanimous roll call vote.

were met; and the hearing was conducted within the guidelines of Idaho Code and City ordinances. Passed:

along Logan Street is to be included. Passed: Unanimous roll call vote.
Conclusions of Law on SUB-61P-Ol — Motion: Commissioner Robison. Second: Commissioner Teraberry. The
Comxnission has the authority to hear this case and recommend approval or denial; public notice requirements
were met; and the hearing was conducted within the guidelines of Idaho Code and City ordinances. Passed:
Unanimous roll call vote.
Recommendation to City Council on SUB-61P-Ol — Motion: Commissioner Coller. Second: Commissioner
Teraberry. Commission members recommended approval of Case No. SUB-61P-01 with an additional condition
of placing a 10 foot landscaping area along Logan Street. Passed: Unanimous roll call vote.
Public Hearing Closed — Commissioner Archuleta closed the public hearing.

C. To hear conciurently, Case Nos. ANN-49-01 and SUB-60P-01, a request by Charlotte Kinney Trust to
annex approximately 33.3 acres into the City as an R-1 (Single Family Residential) zone and preliminary
plat approval of Ferncroft Subdivision, which consists of one hundred and thirty-three (133) lots and four
(4) common area lots. The site abuts the east side of S. Montana Avenue and is approximately 2,150 feet
south of Ustick Road.

7erome Mapp stated that the Applicant wished to speak.
Randy-Robertson, Applicant, stated he would like the Commission to continue this case until March 26, 2001 in
order to prepare.
Recommendation to Continue to Date and Time Certain — Motion: Commissioner Teraberry. Second:
Commissioner Coller. Commission members continued Case Nos. ANN-49-01 and SUB-60P-01 until March 26,
2001 at 7:00 p.m Passed: Unanimous roll call vote.
Public Hearing Continued — Commissioner Archuleta continued the public hearing until March 26, 2001.

D. Case No. SUB-59P-01(Country Village), a request by Florida Avenue MBC, LLC to convert a previously
approved Special Use Pernut for a mobile home park with two hundred and twenty-five (225) home
spaces and nine (9) common lots into a Planned Unit Development subdivision. The Planned Unit
Development will consist of two hundred twenty (220) individual ownership lots with eight (8) common
lots for recreation. The parcel is located on the east side of S. Florida Avenue approximately 1550 feet
north of the intersection of Ustick Road and S. Florida Avenue. This site is located in an R-2 (Medium
Density Residential) zone.

M. Jerome Mapp stated some points of clarification.
Discussion of Commission — Commission members agreed that the Community Development, Director City
Engineer and the Developer of the project need to meet and work out some azeas of concern and problems they
testified to today before coming back to the Commission.
Recommendation to Continue to Date and Time Certain - Motion: Commissioner Teraberry. Second:
Commissioner Robison. Commission members voted to continue Case No. SUB-59P-01 to a date and time certain
being Monday March 19, 2001 at 5:00 p.m here in the public meeting room of the Canyon County Courthouse.

E. Continued Hearing Case No. SUB-59P-01(Country Village) to Date and Time Certain Monday March 19,
2001—
Mark Hilty stated for the record that an auto accident had prevented our Acting Community Development Director
from being at this public hearing today and recommended the Commission continue to another date and time
� certain when Jerome Mapp could be in attendaace.
Recommendation to Continue to Date and Time Certain - Motion: Commissioner Teraberry. Second:
Commissioner Robison. Commission members voted to continue Case No. SUB-59P-01 to a date and time certain
being Friday Mazch 23, 2001 at 3:00 p.m here in the public meeting room of the Canyon County Courthouse.
