CALDWELL PLANIVING AND ZO1vING COMMISSION
' MINUTES OF JUNE 8, 2000

I. Call to Order — Chairman Blacker called the meeting to order at 7:00 p.m.
II. Roll Call , '�
Members Present: Janie Archuleta, Jnn Blacker, Jack Teraberry
Staff Present: Linda James, Joan Holmes
Legal Counsel: Mark Hilty
III. Review of Proceedings — Chairman Blacker reviewed the procedures for public hearings.
IV. Poll Members for Conflict of Interest - Chairn�an Blacker polled members for conflicts of interest: there were
none.
V. Old Business —
A. Approve Minutes of May 9, and May 11, 2000 Meetings. Motion: Cominissioner Teraberry. Second:
Commissioner Archuleta. Approve as written. Passed: Unanimous voice vote.
B. Approve Recommendarion on Case No. OA-29-00 (Comprehensive plan 2000). Motion: Comxnissioner
Teraberry. Second: Commissioner Archuleta. Approve as written. Passed: Unanimous voice vote.
VI. New Business — Hearings �
A. Case No. SUP-86-00, a request by Tamarack Properties, Inc., for a special use pernrit to construct a
planned unit development that consists of 6- four plex dwelling units located on appro�mately 1.1 acres
located in an R-3 (Multi-Family High Density Residential) zone. The site is described as Lots 23 and 24,
Torrens and Tucker Addirion and fronts N. Michigan Avenue.
. Testimony —
� Linda James testified that not enough informarion was available at this time to present a staff report and
recommended that Commission members continue this case to a date and time certain, that date being June 22,
2000, at 7:00 P.M., City Hall Council Chambers before the Hearing Bxaminer.
Public Testimony Closed — Chairman Blacker closed public testimony.
Public Hearing Continued — Members voted to continue the public hearing to June 22, 2000 as recommended.

B. Case No. ANN-33-00, a request by Crestline Development, LC and Heartland Development, LLC to
annex approxixnately 10 acres into the City as a C-2 (Community Commercial) zone. The site is located
at the southeast corner of the intersection of Highway 20/26 and KCID Road.
Testimony —
Linda James presented the staff report and Exhibi�s PR-1 and PR-2, letters of opposition:
Tesrifying in favor was: Rita Earl, Applicant's Representative.
No one spoke in opposition.
Public Testimony Closed —Chauman Blacker closed public testimony.
Comprehensive Plan Analysis - Motion: Commissioner Archuleta. Second: Commissioner Teraberry. The
request is in compliance with: Land Use goal; and Commercial Categories- Policy 8. Passed: Unanimous roll call
vote.

Findings of Fact — Motion: Comrrussioner Archuleta. Second: Commissioner Teraberry. Accept the general
facts outlined in the staff report as Findings of Fact and include E�ibits PR-i and PR-2. Passed: Unanimous roll
� call vote.
Conclusions of Law — Motion: Commissioner Teraberry. Second: Commissioner Archuleta. The Commission
has the authority to hear this case and recommend approval or denial; public norice requirements were met; and
the hearing was conducted within the guidelines of Idal�o Code and City ordinances. Passed: Unanimous roll call
vote.
Recommendation to City Council — Motion: Commissioner Teraberry. Second: Coxnmissioner Archuleta.
Approve Case No. ANN-33-00. Passed: Unanimous roll call vote.

C. To hear concurrenfly Case Nos. ANN-32-00 and SUB-SOP-00, a request by Crestline Development, LC
and Heartland Development, LLC to annex approximately 150 acres into the City as an R-1 (Single-
Family Residential) zone, and prel'uninary plat approval of Colonial Heights Subdivision, a three-phased -
development, which consists of 108 residential and 5 common-area lots and covers approximately 29
acres of the aforementioned 150 acres. A portion of the subdivision site abuts the south side of Highway
20/26, and a portion abuts the east side of KCID Road.
Testimony —
Linda James presented the staff report and Exhibit A-6, the annexation map.
Testifying in favor were: Rita Earl, Applicant's Representative, and Scott Stanfield, Applicant's Engineer.
Carol Grassl signed up as neutral with quesrions.

Commissioner Teraberry. The request is in compliance with the Comprehensive Plan components as follows:
Agricultural — Policy 3; Residenrial Categories - Policies 3, 6, 9, 10, 13 and 15; Urilities - Policies 1, 2, and 3;
Transportarion - Policy 7; Urban Storm Runoff - Policies 1 and 2; Housing - Policies 1, 2, and 3; Community
Design — Policies 7 and 8. Passed: Unanimous roll call vote.
Findings of Fact on Case No. SUB-SOP -00 — Morion: Commissioner Teraberry. Second: Commissioner
Archuleta. Accept the general facts outlined in the staff report as Findings of Fact and include the following facts
from testimony: Scott Stanfield stated that the Applicant's will undertake a�affic study in the near future; the

T Applicants' engineer will work with the City Engineer regarding the relocation of the pressure sewer line from I I
Lakey's mobile home park; sidewallcs along Highway 20/26 may or may not be permitted by the Idaho
Transportation Department. Passed: Unanimous roll call vote.

Archuleta. The Commission has the authority to hear this case and recommend approval or denial; public notice
requirements were met; and the hearing was conducted within the guidelines of Idaho Code and City ordinances.
Passed: Unanimous roll call vote.
Recommendation to City Council on Case No. SUB-50P-00 — Motion: Commissioner Teraberry. Second:
Commissioner Archuleta. Approve Case No. SUB-SOP-00 with the standard conditions outlined in the staff
report. Passed: Unanimous roll call vote.

VII. Planning Issues- The hearing chamber is going to be renovated for use as office space so hearings beguuring in
August will be held in the Board of County Commissioners' chambers at the Courthouse, however Thursday
evenings are not available. The Commission members agreed to hold the first hearing of the month on Tuesday.
VIII. Adjournment — Chairman Blacker adjourned the meeting at approximately 8:45 p.m
