, CALDWELL PUBLIC HEARING BEFORE HEARING EXANIINER
� 1VIINUTES OF APRIL 27, 2000
I. Call to Order — Hearing Examiner Lee Dillion opened the meeting for the public hearings at 7:00 p.m and
outlined the public hearing procedures. City staff in attendance were: Linda James, Community Development
Director, and Joan Holmes, Administrative Secretary.
II. Hearings
A. Case No. SUB-31P(E)-99 (Powell Estates, a Planned Unit Development), a request by Providence
Development Group, LLC for a one-yeaz extension of preliminary plat approval granted by City Council
on April 5, 1999. The Planned Unit Development is approxirnately 30 acres and consists of 109
residential and 5 common-area lots, and 4 commercial lots. The site is located at the Northeast comer of
the intersection of Florida Avenue and Ustick Road and is Iocated in an R-2 (Medium-Density
Residential) zone.
Testimony —
Linda James presented the staff report.
Wayne Forrey, Applicant's representative, testified in favor.
No one testified in opposirion.
Public Testimony Ciosed — Mr. Dillion closed public testimony.
Findings of Fact — Mr. Dillion accepted the facts outlined in the staff report as Findings of Fact.
Conclusions of Law — Mr. Dillion accepted the Conclusions of Law outlined in the staff report. '
Order of Decision — Mr. Dillion stated that the request by Providence Development Group, LLC for a one-year
extensioa of preliminary plat approval is approved with the standard conditions outli.ned in the staff report.
Public Hearing Closed — Mr. Dillion closed the public hearing and noted anyone wishing to appeal his decision
should see the Director of Community Development.

B. Case No. SUB-30E-99, Quail Meadow Subdivision final plat, was withdrawn.

� C. Case No. SUP-81-00, a request by Dr. William Black for a special use pernut to extend the e�cisting 1612
square-foot doctor's office building by adding approximately 1248 square feet of office space. The office
(Family Eyecare Specialist) is located at the southwest comer of the intersection of Pine Street and Ellis
Avenue, is zoned R-3 (Multi-Family High Density Residenrial, and is commonly known as 120 Pine
Street.
Testimony —
Linda James presented the staff report and outlined the facts in the report. She presented exhibit PA-2, a memo
from Gordon Law, City Engineer.

Public Testimony Closed — Mr. Dillion closed public testimony.

Comprehensive Plan Analysis — Mr. Dillion stated the request is in compliance with Residential - Policy 13 and
' Transportation — Policy 3.
Findings of Fact— Mr. Dillion accepted the general facts outlined in the staff report as Findings of Fact.
Conclusions of Law— Mr. Dillion accepted the Conclusions of Law outlined in the staff report.
Order of Decision — Mr. Dillion stated that Case No. SUP-81-00 is approved with the standard conditions

D. Case No. ANN-27-00, a request by Aldon W. and Jacquelyn A. Harshman, to annex approximately 27
acres into the City as an R-3 (High-Density Residenrial) zone and approximately 80 acres into the City as
an R-2 (Combined Medium-Density Residential) zone. As a part of the annexation, the Comprehensive
Plan Land Use map will be amended from an Agricultural designarion to an R-3 and R-2 designarion as
per the aforementioned acreages. The Eastem boundary of the approximately 107 acres is located along
the Westem boundary of KCID Road, beginning approxirnately 400 feet south Highway 20/26. The site
is legally described as all of the NE '/< SE '/4 and all of the SE '/4 NE '/4 and a part of the NE '/< NE '/< of
Section 25, Township 4 North, Range 3 West, Boise Meridian, Caldwell, Canyon County, Idaho. If
approved, the Comprehensive Plan Land Use map will be amended as a part of the next available update.

Wildwood to Vaughn Heinrich; Exhibit HE-1000, assessor's map with the site outlined; Exhibits PR-3, PR-4, PR-
5, letters of opposition.

Comprehensive Plan Analysis — Mr. Dillion found that the request is in compliance with the following
Comprehensive Plan components: Residential — Policy 7; Airport — Policy 2; Transportation — Policies 7 and 10.
Findings of Fact— Mr. Dillion accepted the general facts outlined in the staff report as Findings of Fact.
Conclusions of Law— Mr. Dillion accepted the Conclusions of Law outlined in the staff report.
Recommendation to City Council— Mr. Dillion stated that he recommends approval on Case No. ANN-27-00.
VII. Planning Issues- There were no planning issues brought forward.
VIII. Adjournment — Mr. Dillion adjoumed the meeting at approximately 7:50 p.m.
