CALDWELL PLANNING AND ZONING COMMISSION
MINUTES OF MARCH 11,1999
I. Call to Order —Chauman Murphy called the meering to order at 7:00 p.m.
II. Roll Call
Members Present: Janie Archuleta, Matt Beebe, Jim Blacker, Charles Murphy
Staff Present: Linda James, Joan Holmes
Legal Counsel: None
III. Review of Proceedings —Chairman Murphy reviewed the procedures for public hearings.
IV. Poll Members for Conflict of Interest - Chairman Murphy polled members for conflicts of interest: there were
none.
V. Old Business —
A. Approve muiutes of February 25, 1999— Motion: Commissioner Archuleta. Second: Commissioner
Beebe. Approve as written. Passed: Unanimous voice vote.
B. Approve Order of Decision on Case VAR-13-99 (James McCoy). Motion: Commissioner Archuleta.
Second: Commissioner Beebe. Approve the recommendation for the referenced case as written. Passed:
Unanimous voice vote.
VI. New Business — Hearings
A. Case No. ANN-15-99, a request by Robert and Nancy Roberts to annex approacimately 75 acres into the
City of Caldwell as an M-1 (Light Industrial) zone, including all of the right-of-way of Simplot
Boulevard/Hwy 19 that abuts the south side of the of the subject properiy, and including the right-of-way
of Union Pacific Raikoad's rail-line adjacent to that portion of Simplot Boulevard/Hwy 19 so noted. The
subject parcel is located at the northwest comer of the intersecrion of Simplot Boulevard and Farmway
Road, and is legally described as a portion of the S%2 NE '/a of Section 20, Township 4 North, Range 3
W.B.M.
Testimony —
Linda James presented the staff report and Exhibit S-4 from the City's attorney. Mrs. James informed members
that it was the attorney's opinion that the railroad r-o-w cannot be annexed.
John Blaye, Representative, and Robert Roberts, Applicant, testified in favor.
Ron Sale, testified as neutral.
Public Testimony Closed —Chairman Murphy closed public testimony.
Comp Plan Analysis - Motion: Commissioner Blacker. Second: Commissioner Beebe. The request is in
compliance with the following Comprehensive Plan Components: Agricultural Land Use — Policy 3, Industrial
Categories- Policies 2 and 3. Passed: Unanimous roll ca11 vote.
Findings of Fact — Motion: Commissioner Blacker. Second: Commissioner Beebe. Accept the general facts
outlined in the staff report as Findings of Fact and include the fact that annexation of Union Pacific Railroad's
right-of-way cannot be included. Passed: Unanimous roll call vote.
Conclusions of Law — Motion: Commissioner Blacker. Second: Commissioner Beebe. The Commission has the
authority to hear this case and to make a recommendation to City Council; public notice requirements were met;
and the hearing was conducted within the guidelines of Idaho Code and City ordinances. Passed: Unanimous roll
call vote.

Recommendation to City Council — Motion: Commissioner Blacker. Second: Commissioner Beebe. Based on
the Findings of Fact and Conclusions of Law, recommend to the Mayor and City Council that Case No. ANN-15-
99, a request by Robert and Nancy Roberts to annex appro�mately 75 acres into the City as M-1 (Light Industrial)
zone, is approved. Passed: Unanimous roll ca11 vote.
Public Hearing Closed —Chairman Murphy closed the public hearing.
VII. Planning Issues — Linda James stated that there will be no meeting on March 25. She also handed out a
memorandum regarding the workshop scheduled for March 15 on the manufactured home ordinance. She
discussed amending the zoning ordinance and presenring a form for review, which will come forward at a future
meeting.
VIII. Adjournment —Chairman Murphy adjourned the meeting at approximately 735 p.m.
