I. Call to Order —Vice Chairman Murphy called the meeting to order at 7:00 p.m.

III. Review of Proceedings - Vice Chairman Murphy reviewed the procedures for public hearings.
IV. Poll Members for Conflict of Interest - Vice Chairman Murphy polled members for conflicts of interest: there
were none.
I. Old Business —
A. Approve minutes of December 10, 1998— Motion: Commissioner Archuleta. Second: Commissioner Beebe.
Approve as written. Passed: Unanimous voice vote.
B. Approve Recommendation on Case SUB-28F-98 (Falcon Ridge Estates No. 1, Phase 2) and Order of
Decision on SUP-50-98 (Terry Bennett Class B Manufactured Homes) - Morion: Commissioner Archuleta.
Second: Commissioner Beebe. Approve the recommendations for the referenced cases as written. Passed:
Unanimous voice vote.
VI. New Business
A. Election of Officers - Motion: Commissioner Archuleta. Second: Commissioner Beebe, to elect Charles
Murphy as Chairman, Reed Taylor as Vice Chairman, and Janie Archuleta as Secretary. Passed: Unanimous
voice vote.
B. Hearings
1. Case No. OA-21-99, a request by the Caldwell Community Development Duector to adopt an official
zoning map that supersedes and replaces the official zoning map adopted December 13, 1977 by the
Caldwell City Council as a part of Zoning Ordinance No. 1451. The new map includes all rezones and
annexations that have occurred since December 13, 1977 and will bring the official zoning map up-to-
date. All of the respective zone boundary changes that are made a part of the map received prior approval
by the City Council following public hearing requirements set forth in Idaho Code, Chapter 65, Local
Planning.
Testimony —
Linda James presented the staff report and testified that the proposed map will be of benefit to both the public and
the City.

the authority to hear this case and to make a recommendation to the Mayor and City Council for approval or
denial; public notice requirements were met; and the hearing was conducted within the guidelines of Idaho Code
and City ordinances. Passed: Unanimous roll call vote.
Recommendation to City Council - Motion: Commissioner Archuleta. Second: Commissioner Beebe. Based on
the Findings of Fact and Conclusions of Law, recommend to the Mayor and City Council that Case No. OA-21-99
(Official Zoning Map), a request by Community Development D'uector to adopt a new official zoning map is

2. Case No. SUP-52-99, a request by Vallivue School District to amend an existing special use permit in
order to construct a one-story administration office of approximately 5250 square feet. The site is
located within an R-1 zone and is more commonly known as 1407 Homedale Road

Bud Knickerbocker presented the staff report and Exhibit PZ1000, a copy of the Assessor's map showing the
subject site and surrounding zoning.
Bill Hamlin, Representative, testified that it would benefit the school to move to their own location, there will be no
lease rate for them to pay, and have chosen the NW corner of the current High School site to minimize the impact
on the surrounding area of playing fields such as baseball and soccer. George Grant signed up in favor but did not
speak.

3. Case No. SUP-51-99, a request by Calvary Chapel to use a portion of an existing building to conduct
church services and activities. The site is located within a C-2 zone and is more commonly known as 704
Blaine.
Testimony —
Bud Knickerbocker presented the staff report and Exhibit PZ1000, a copy of the Assessor's map showing the
subject site and surrounding zoning.
Bob Larsen, Representarive, tesrified that they have approximately 40 members so parking is ample when needed-
Sunday mornings and Wednesday evenings. Scott Johnson, Wendy Ferguson, Lyle Ferguson, Larry Fogelman,
Kiki Fogelman, Denise Sloan, Jeff Sloan, and Tom Dempsey signed up in favor but did not speak.

4. Case Nos. ANN-13-99 and SUB-30P-99, a request by V.E. Graves and Sons, Inc. to annex approximately
14.71 acres into the City of Caldwell as an R-1 (Low-Density Residential) zone, and for preliminary plat
approval (Quail Meadow) to develop 39 residenrial on the aforementioned 14.71 acres. The subject site
is currently zoned County R-1 and is located between a portion of the east side of Dorman Avenue and a
portion of the west side of Marshall Avenue, and adjacent to the west side of Manchester Park No. 3.
Testimony —
Linda James presented the staff report and PZ 1000, a copy of a revised plat as submitted by the Applicant's
engineer. She testified that the Quail Meadow preliminary plat, as submitted to Planning and Zoning Commission
members in their packets, showed Bradford Way as the connecting street to Phase 5 of Manchester Park. The
revised plat of Quail Meadow now shows the eliminarion of Bradford Way with no connection to Manchester Park.
Mrs. James stated that she and Gordon Law had received direction from City Council, during a public hearing on
Copper-rock Subdivision, that subdivisions were to be connected whenever possible and that through-streets were
to be encouraged wherever possible. She also testified that Subdivision Ordinance No. 1758 was amended in order
to place the authority for preliminary plat approval with the Council and to remove approval from the Planning and
Zoning Commission's authority. The amendment to the Ordinance was basically undertaken because the Planning
and Zoning Commission approved the prelirrunary plat for Copper-rock Subdivision without a through street. Mrs.
James noted for the record that the Quail Meadow preliminary plat, as first submitted, included a connection street
with Manchester Park and was in keeping with the City Council's directive to her and Gordon Law.
Dennis King, Applicant's engineer, testified in favor and stated the following: the Applicant would comply with
installing the street connection into Manchester Park if required by the Planning and Zoning Commission and City
Council; the subject site is contiguous to the City and the common boundary is Manchester Pazk; the site is a part of
Wood's Acreage platted in 1895 and included the right-of-way along the east boundary and the right-of-way known
as First Street, but that neither rights-of-way were ever developed; the Applicant has requested the City to vacate
both rights-of-way but the vacation requests have not been presented to City Council at tlus time and if Council
� would not approve the vacations, the plat would have to be redesigned; if a pressurized irrigation system is installed
it would have to be constructed to the standards of Pioneer Irrigation District and would be owned and maintained
by the District; the Applicant is requesting flood irrigation because there is a question as to whether or not there is
adequate water to support a pressurized system; the lot dedicated for stormwater detention is in the low corner of
the property and Gordon Law approves detention and stormwater plans; Dorman is paved but there is no curb and
gutter.
Ron Rainey, owner of property that abuts the north side of the proposed subdivision, testified in opposirion and
expressed his concerns with sewer, water and storm drain runoff collecting and running off onto his property; the
development of Manchester Park covered up an existing drain ditch; storm drains were installed but are not
adequate; the vacation of the right-of-way along the eastern boundary (Marshall Avenue) should not be granted; the
underground irrigation pipe from the southern area along Dorman might be disturbed by this development.
Dennis King testified in rebuttal to the following: that the 25 feet along the eastern boundary is a public right-of-
' way and not an easement; when the right-of-way is vacated the final plat for the subdivision would show a 10-foot
' easement along this area in order to accommodate utilities; Manchester Park would also dedicate a 10-foot
easement along their western boundary, which together with the 10-foot easement along Quail Meadow would
provide for a 20-foot utility easement; Idaho Code regulates off-site drainage and irrigation waters and the
developer will comply with Code requirements.

5. Case No. SUB-29P-99, a request by Jerry D. Trammel for preliminary plat approval to develop a 16-lot
commercial subdivision on approximately 33 acres within the Canyon County/Caldwell Area of City
Impact. The site is zoned County C-3 (Service Commercial) and is located north of the Boise River and at
the northeast intersection of Farmway Road and Hwy. 20/26.
Tesrimony —
Linda James presented the staffreport and testified that county standards are to be met since this is not in our city,
but in our impact area and read Exhibit PA-2, a letter from Notus Parma Highway District into the record.
Jerry Trammel, Representative, testified that he is the manager of the property and his address is 15780 Highway
20/26, Twenty-Six Grazing LTD is the owner. Mr Trammel testified when they purchased the property it was
covered in thistles, the drainage was bad, the PH balance was not right, and the water table was to high to farm.
They opened drains, built office, built the Chevron gas station and would like approval for this project, the lots are
large, they plan to meet all code requirements, and above ground septic is planned.
• Mitch Bicandi, owner of property west of proposed site and president of the ditch company servicing this area,
• testified he was neutral but expressed concerns of drainage, and questioned whether he could continue farming,
because of the dust he creates.
Amy Woodruff, ApplicanYs Engineer tesrified that the runoff generated by the interior streets will be reviewed
and approved by the Notus Parma Highway District; JiJB is the engineering firm designing the drainage system;
all Code requirements will be met; Code will not permit drainage from the subdivision to flow onto adjacent
properties.
Jerry Traznmel states in rebuttal that Idaho has a Right to Fann Law ensuring Mr. Bicandi's ability to farm, and
they will abide by Idaho Code.
