AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL ENACTING A
NEW CHAPTER 2, ARTICLE 33 TO BE ENTITLED "INDUSTRIAL DEVELOPMENT
CORPORATION," SECTIONS 02 -33 -01 THROUGH 02 -33 -03 INCLUSIVE;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of
Canyon, State of Idaho:
Section 1: That a new Chapter 2, Article 33 of the Caldwell City Code, to be entitled
"Industrial Development Corporation" is hereby enacted, passed and adopted, composed of
Sections 02 -33 -01 through 02 -33 -03 inclusive, as follows:
02- 33 -01: PURPOSE:
The Industrial Development Corporation was created by the City of Caldwell
pursuant to Title 50, Chapter 27, Idaho Code (the "Act "), for the purposes set forth in the
Act, to promote employment, encourage the development of new jobs, maintain and
supplement the capital investments in industry that currently exist in the City of Caldwell,
encourage future employment by ensuring future capital investment, attract
environmentally sound industry, protect and enhance the quality of natural resources and
the environment, and to promote the products and conservation of energy.
02- 33 -03: AUTHORITY:
The powers and authority of the Industrial Development Corporation are provided
in Idaho Code, including but not limited to those powers set forth in § 50 -2708 and the
remainder of the Act, as amended, to the extent said powers are not limited by Ordinance
No. 1633 of the City of Caldwell or by the Industrial Development Corporation's
Charter, By -laws and/or Rules and Regulations.
Section 2: This ordinance shall be in full force and in effect from and after its passage,
approval and publication, according to law.
Section 3: This ordinance is hereby declared to be severable. If any portion of this ordinance
is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue
in full force and effect and shall be read to carry out the purposes of the ordinance before the
declaration of partial invalidity.

Section 4: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.

February, 2012.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2899
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL ENACTING A NEW
CHAPTER 2, ARTICLE 33 TO THE CALDWELL CITY CODE, TO BE ENTITLED
"INDUSTRIAL DEVELOPMENT CORPORATION," SECTIONS 02-33 -01 THROUGH 02 -33 -03
INCLUSIVE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY;
AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN
CONFLICT HEREWITH.
Section 1: Enacts a new Chapter 2, Article 33 to the Caldwell City Code, entitled "Industrial
Development Corporation," setting forth the purposes of said entity, the authority pursuant to which it
was created, and identifying its powers and authority.
Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its
passage, approval, and publication, according to law; provides for severability; repeals conflicting
ordinances, resolutions and orders.
Ordinance No. 2899 provides an effective date, which shall be when published in the Idaho Press Tribune
on the 27th day of February, 2012. Ordinance No. 2899 was passed by the Council and approved by the
Mayor on the 21 day of February, 2012. The full text of the Ordinance is available at Caldwell City
Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing
summary on the 20th day of February, 2012, for publication on the 21" day of February, 2012, pursuant
to Idaho Code § 50 -901 A.
