CALDWELL ID 83605 TELEPHONE 456�.9021 FAX 456�,'�i MINUTES OF THE PLANNING AND ZONING COMMISSION Meeting of March 7,1996 ROLL CALL: Present: Daniel Ozuna, Madeline Buckendorf, Sonia Huyck, Mike Nachtigall, and Bill Gilbert Absent: Bettie Pilote, William Roos Staff: Nancy Huff, Ed Christopher, and Debra Pendleton The regular meeting of the Planning and Zoning Commission was called to order by Vice-Chairperson Sonia Huyck, at 7:15 p.m., in the Caldwell City Ha11 Council Chambers. MINUTES: The first item of business was approval of the minutes for the previous meeting of February 15, 1996 and the revised minutes of the meeting on January 18, 1996. A motion was made by Commissioner Buckendorf that the January 18, 1996, minutes be approved. The motion was seconded by Commissioner Nachtigall. � Roll Call Vote: Yes: Madeline Buckendorf, Mike Nachtigall, Bill Gilbert, Daniel Ozuna � No: None Motion passed. MINUTES P&Z 3!7/96 Pag� 1 1 � PUBLIC HEARINGS: The public hearing portion of the agenda then followed. Vice-Chairperson Huyck explained the procedure for public hearings. OLD BUSINESS None. NEW BUSINESS ', . , The first hearing was Case # 96-04-SUB--A reauest for a Planned Unit Develo�ment entitled Hi Point ' �I Est�tes, to serve the specific needs of "Adult Living " The applicants were D.D. and Shirley Ackerman. ' Nancy Huff presented the staff report. She informed the Commission that no preliminary plat, only a conceptual plan was submitted. The applicant requested a conceptual plan approval from the Commission , to obtain financiai arrangements and secure the contract with the engineer to provide the preliminary plat. All legal requirements were met. A letter from the Fire Department approving the conceptual plan was included in the packet. Pioneer Irrigation had written some concerns. Staff stated that these would be worked out with the submittal of the preliminary plat in the future. No negative responses were received by staff from other agencies or neighbors. The applicant Dwain Ackerman was present. He gave his address as 3616 S. Kimball, Caldwell. He stated that the idea was well laid out with senior citizens in mind. Many precautions were taken to give the elderly secure walkways and resting areas (ie: sitting benches). He provided a clubhouse for activities, ie: cards, bingo, birthday parties, etc: Several housing plans were available for prospective buyers to choose from. They were going to be homes of good quality and yet affordable for senior citizens. A security gate and fencing would encompass the project. Vice-Chairperson Huyck asked if the guardhouse would be manned. Mr. Ackerman responded that it would not be initially, but that it would be an option for the residents in the future. The Vice-Chairperson wanted to know how many units were going to be constructed in Phases I and II. She also inquired about the size of the clubhouse. The applicant did not know exactly how many units were in each Phase. He s�tated that the size of the clubhouse is 60' x 100'. Commissioner Buckendorf expressed concern over the location of the clubhouse. Mr. Ackerman stated that it is a centraiized location in the back where , any activities that were going on would not interFere with the other residents. Commissioner Buckendorf asked if any other common areas were being provided. Mr. Ackerman responded that a horseshoe pit would be provided. He stated that he was trying to provide things that the senior citizens wanted and not what some younger person would want to have. The Commission as a whole expressed concern about approving a Special Use Pernut without a preliminary plat. Vice-Chairperson Huyck explained that the applicant was only there to request the approval of a conceptual plan and would have to come back before the Commission later for approval of the preliminary plat. MINUTES P&� 3/7/96 Page 2 Vice-Chairperson Huyck then asked for public testimony. Ms. Rosalie Stewart introduced herself and gave her address as 21949 Middle Road, Greenlea.� Idaho. She represented herself as a real estate agent and marketer for the project. She explained that the project is a good idea. She stated that (3) other interested people were at the meeting with her. The public hearing was then closed. Discussion from the Commission followed. Concern about approving the special use permit without a preliminary plat was apparent. Commissioner Nachtigall stated that he did not have a problem with the special use pernut, if the wording of some conditions could be changed and some additions could be made. He had qualms about approving a special use permit without knowing the requirements of the Department of Engineering. Ms. Huff stated that Mr. Law had told Mr. Ackerman that he would meet with him when the preliminary plat was ready. She further stated that Condition #S met this requirement. It was the consensus of the Commission that they state that we approve of the concept. It would give Mr. Ackerman a sense of what the Commission would like to see and he could go on with his project. The public hearings were reopened. Mr. Ackemiari was given the opportunity for rebuttal. He stated that he needed the assurance of the Commission to go ahead with the financing. He wanted the special use pernut. Vice-Chairperson Huyck closed the public hearings. The Commission discussed the fact that this was conceptual only and not a preliminary plat. Ms. Hu� assured the Commission that they could impose conditions now and when the preliminary plat came up for review. Commissioner Gilbert was not comfortable with approving the special use permit. He suggested that the Commission table this until the preliminary plat is ready. Commissioner Buckendorf agreed with him. Commissioner Nachtigall agreed with them, however he felt this was not fair to the applicant. A motion was made by Commissioner Nachtigall that the Commission approve the special use permit with the conditions amended as foilows: Condition #2 to read a conceptual plan instead of preliminary plat subdivision and the applicant may proceed to the preliminary plat phase, Condition #3 addition of that the special use permit is applicable for one year, with the option to renew, and Condition #7 addition of the conditions in the letter dated 2/2/96 and received 2/28/96 with the attachment by Bruce Alcott. Commissioner Buckendorf seconded the Motion. Roll Call Vote: Yes: Mike Nachtigall, Daniel Ozuna No: Madeline Buckendorf , Bill Gilbert There being a tie within the Commission, the Vice-Chairperson was asked for her vote. MINUTES P&Z 3/7I96 Page 3 The second hearing was Case # 96-07-SUP-- A request to construct a two-family dwelling in the R-1 I � ingle Fa.mily Residenrial) zonin� district of Caldwell on the corner of Terrace Drive and Ohio Avenue '� The applicants are Mary Knottingham and Don Mason. � I Ed Christopher presented the staff report. All legal requirements were met. The applicant proposes to �, build two duplex units that consist of four three-bedroom units. The only deviation in the request was ' in the density. The R-1 provides for a 1 to 6 density scale. The request was for a 6.3 density. The � applicant proposed to remove an older home and replace it with the two new duplexes. Staff received �, one letter from a neighbor opposing the request due to the possible influx of tra�c through the area. ', Commissioner Buckendorf suggested that the recently received, E�ibit A, be made a part of the '', conditions of approval since it included landscaping. ' Shawna VanBeek wa.s the representative for the applicant. She said that she was a real estate agent. She ' supplied the Commission with a picture of the home in question. This picture was made an E�ibit to I the application. She showed that the home was old and infested with beetles. It was not fit to live in a.ny ', longer. She read a letter from Mary Knottingham to the Commission. In the letter, Mrs. Knottingham expressed her desire to sell the property. She introduced Mr. Don Mason who is the prospective buyer of the property. He resides within one block of the property. He stated that he would maintain the landscaping and would provide for RV parking. He further stated that this would be a pleasant project and an asset to the community. Vice-Chairperson Huyck then asked for public testimony. Mr. Brad Baker residing at 1921 Terrace Drive, Caldwell, opposes the request. He stated thax this would add extra traffic and the peaceful neighborhood would be gone. He did not like the idea of having a duplex in the area. V'ice-Chairperson Huyck then closed the public hearings. Discussion from the Commission followed. It was mutually agreed that it was a pleasing addition to the neighborhood. A motion was made by Commissioner Gilbert t6at the Special Use Permit be approved with the conditions as set forth by stai� and the addition of Condition #5 to read the newly received Ezhibit A. The third hearing was -C'ase # 96-06-SUP -- A reauest to construct a sin .gle family dwelling in the M-1 jLight Industrial, zonin� district of Caldwell in the 200 block of Holly Street. The applicant was John Day. Ed Christopher presented the staf� report. All legal requirements were met. The lot wiil accommodate a single family dwelling. No negative responses from other agencies or neighbors were received. MINUTES P&Z 3/7/96 Page 4 The applicant John Day was present. He resides at 1594 S. Riverstone Lane in Boise, Idaho. He inherited the property and stated that he plans to place a quality home there. Vice-Chairperson Huyck closed the public hearings. Discussion from the Commission followed. The Commission agreed that the project is a good one. A motion was made by Commissioner Buckendorf that the Special Use Permit be approved with the conditions as set forth by staff. The fourth hearing was -Case # 96-02-SUB -- A request for annroval of a preliminarv �lat for the Wmters Place Subdivision in the C-3T (Service Commercial, Mobile Home Individual Overlax) aonin� di�trict of f'aldwell, on the corner of Ithaca Street and N Sth Avenue The applicant was Jack Winters. Ed Christopher presented the staff report. All legal requirements were met. Staff received a letter tonight from Darrell and JanaLee Barrett opposing the request. The letter stated that the proposed road would seriously affect the garage and the church. They preferred that the road not go through there. The applicant Jack Winters was present. He resides at 604 Galveston in Caldwell. He stated that he objects to condition number five of the engineering comments. The subdivision rules make it is possible , to have the developments under a LID. Vice-Chairperson Huyck then asked for public testimony. The first speaker was William Mason. He resides at 9533 Hwy. 44, Middleton, Idaho. He was representing Skinner & Associates. They were the engineers that developed the preliminary plat. The second speaker was Pastor Allard L. Smith. He resides at 8440 So. Eagle Rd., Meridian, Idaho. T'he church is next to the property. In 1991, the church asked the City Planning & Zoning Commission for a special use permit for a double car gazage. At that time, the Commission assured the church that a street would not go through the azea. The parking lot ha.s been paved and the lot fenced. The church property was upgraded. The project would seriously affect the church. The trash and tra�ffic would be worse. It would greatly disrupt the organization of the church. The third speaker was Art Honey. He resides at 111 N. Sth, Caldwell. He stated that the area did not need any more mobile homes. He stated that the mobile homes there now are substandard. He was emphatic in his desire not to have a slum area. He did not favor the project and stated that it would down grade the cunent property values. MINUTES P8Z 3/7/96 Page 5 The fourth speaker was Chris Cooper. He resides at 1015 N. Sth, Caldwell. He stated that he is a new cabinet shop owner. He opposes the project. He stated that it will down grade the neighborhood. He did not believe that having more trailers in the area was necessary. The fifth speaker was Ernie Bull. He resides at 324 Jolette, Caldwell. He opposed the project. He stated i that he did not want to see more trailers moved into the area. The applicant was asked to give rebuttal. Mr. Winters stated that he wanted a good neighborhood. There '� appeared to be a great demand for affordable housing. Mr. Winters further stated that he will provide � off-street parking and grass for landscaping. '� Vice-Chairperson Huyck then concluded the public heatings. Discussion from the Commission followed � I ', Commissioner Buckendorf staterl that the preliminary plat met the requirements. The other ' Commissioners agreed. A motion was made by Commissioner Buckendorf that the Preliminary Plat be approved. The motion was seconded by Commissioner Ozuna. The fifth hearing was -Case # 96-03-SUB — A reauest for a�proval of the nreliminarv nlat for a Planned nit De�lo�mern known as Baycrest Villa�e to be constructed at the northwest corner of Po�lar Street �nd Arlin,gton Avenue. The applicant was T&J Properties, LLC. Nancy Huff presented the staff report. The applicant proposed to develop a 30-unit condominium comple�c to sell as a condominium unit or to rent as an apartment creating a supply of both quality rental housing and a.$'ordable home ownership. Ms. Huff stated that tbe City does not ha.ve a Condominium applicarion. The only option was the Planned UnitlSpecial Use Permit. This application also included a request for a rezone of lots 7-10 to adjust the Comprehensive Plan to R 3. The legal requirements were met. She specified that the preliminary plat could be approved pending deviations by the City Council. Virginia Vanderpool represented the applicant. She gave her home as 3000 E. Lake Hazel, Meridian, Idaho. She described T&J Properties as a group of local business people that envisioned a need for quality multi-family housing in the Caldwell area. She described the project as condominium units with two bedrooms, split baths and with covered pazking and storage in the parking area. Common axeas would be including a barbecue pit and picnic area. She stated that the project would be compatible with the neighborhood. Commissioner Nachtigall asked the applicant if the requirements of the Engineering Department were being met. The applicarn responded that they were not cleaz on what the Engineer wanted. She further stated that they would work that out with him and meet all city standards. � MINUTES P8Z 3/7/96 Page 6 Commissioner Nachtigall stated that he opposed the project because of the narrow streets and the invariable influx of traffic that would be created. The applicant responded that Arlington Avenue was not completed through to the adjacent street. They have been working with the City Engineer and the school. The school has asked that it be a requirement that they complete that road. Curb, gutter, and sidewalks would be constructed on both sides. Commissioner Buckendorf asked about the common areas. The applicant responded thax there were no patios attached to the units. Instead they have provided patio areas and greenbelt walking areas. They : would also provide barbecue pits and picnic tables. There would not be a play area for children. V'ice-Chairperson Huyck then asked for public testimony. The first speaker was Pat Ho�er, residing at 219 Felton, Caldwell. She stated that she works in real estate. She is opposed to the project request for the following reasons: A) It will have an impact on the price of homes in the area. B) It does not meet the requirements for making a re-zone. � C) There will be at least 30 units. That means there will be at least 60 cars traveling on Kimball . Kimball can barely handle the tra.ffic that it has now. D) Stop lights would need to be erected. Who would pay for them? The second speaker was Katherine Damon, residing at 216 Felton, Caldwell. She was opposed to the project. She was concerned about the increase in tra.�c on Kimball. She stated that there are no walking areas now and she was concerned about the safety of the children going to and from school. She also stated that the patio would hang over her property line. Vice-Chairperson Huyck asked staff if this encroachment was possible. Ms. Hu�respanded that they were tallcing about a possible overha.ng on the top, but there would not he any physical encroachment with a structure. The third speaker was Richard Gilbert, residing at 2708 Arlington Avenue. He was opposed to the project. He was concemed that there was no means to handle all of the traffic that would be generated by the project. T'he fourth speaker was Tony Elordi, residing at 3304 Iowa, Caldwell. He was one of the owners of the project. He addressed the concems of the public in rebuttal. He explained about the street going through. He stated that they were willing to work with the school, the City Engineer, and the Commission to obtain an approval of the project. � V'ice-Chairperson Huyck stated that this concluded the public hearing portion of the agenda. Discussion from the Commission followed. It was the consensus of the Commission that the project did not fit as a PUD. There were concerns over the excess traffic and parking issues. It was decided that, because of the late hour and the fact that the Commission needed more time to consider a project of this enornuty, the project should be tabled until the next meeting of the Commission. The Commission as a whole wanted information from the City Engineer and requested that stafflook at whether this project meets the requirements of a PUD. MINUTES P&Z 3!1/96 Page 7 Nancy Huff stated that the Commission could table this until the next meeting. She said that it would have to be the meeting on April 18, 1996 in order to get proper notice to the public. She stated that this would give her time to meet with the applicant and decide on a proper format for the application. They would also have time to work out some of the details. A motion was made by Commissioner Nachtigall made a motion that the project be tabled until the April 18, meeting of the Planning and Zoning Commission. The motion was seconded by Commissioner Buckendorf. Roll Call Vote: Yes: Mike Nachtigall,Madeline Buckendorf , Daniel Ozuna, Bill Gilbert, No: None Motion passed.
