MINUTES OF THE PLANNING AND ZONING COMMISSION
Meeting of Nlay 18, 1995

The regular meeting of the Planning and Zoning Commission was called to order by Chairman, Rick
Wells, at 7:15 p.m. in the City Hall Council Chambers.
The first item of business was approval of the minutes for the meeting of May 4, 1995. Madeline
Buckendorf offered a Motion to approve the Minutes as distributed. The motion was seconded by
Terry McConnell and passed unanimously.
The next item of business was a Miscellaneous item requesting a time extension for Jefferson Park
Preliminary Plat. Jefferson Park Subdivision is located between the Dixie Drain and S.lOth Avenue
north of Jefferson Junior High School. The developer is Bill MacDowell and the engineer is Skinner,
Earl & Assoc.
Dennis explained that the plat had been approved in 1992 and Phases 1, 2 and 3 have received final I
plat approval by City Council. Phases 1 and 2 have been recorded and street improvements and '!
houses have been constructed. Two phases remain to be developed. When the plat was originally '
approved a pathway connection as part of Phase 2 had been required between Lot 9 across the Dixie
Drain to provide pedestrian access to Caldwell High School. Since then it was discovered that the
School District property crosses the drain at that point and, therefore, the developer does not own the
property to make that pathway connection.
A meeting was held with the developer's engineer and Darrel Deide, Caldwell School District
Superintendent, and it was agreed that there is still a commitment from the School District to have
and maintain the pathway. However, the School District recommend that the pathway connection be
relocated to the southern end of the project, closer to the junior high school.
The other issue is Spruce Street at the southern end of the subdivision. It is the opinion of the
Planning Department, because of the inegular intersections, there should not be an improved
connection of Fircrest Avenue with Spruce Street. When the Transportation Component of the Plan
was amended Spruce Street was identified as a collector roadway diverting the alignment to l Oth
Avenue away from its cunent alignment. Such an improvement can conceivably be paid for from
State Department of Transportation funding. The City is asked the developer to dedicate the south
28 feet to the City as public right-of-way for a future street but not recommending that the street be
developed except for curb, sidewalk and gutter and a strip of asphalt to prevent deterioration. This
would allow fleacibility for the new road to be built at some future time. It is not recommended to
connect Fircrest Avenue or that Spruce Street be extended.

In response to a question from Terry, Dennis indicated the new location for the pathway connection,
stating that a retention pond will also be placed there to collect stormwater runoff, and set up as a
separate lot. Danel Deide was in agreement with this concept.
In response to a question from Rick, Dennis said that the applicant was agreeable to this suggestion.
Rick said that the Commission are aware of the letters received concerning Spruce Street and Fircrest
Avenue and the condition is taking their concerns into consideration.
Terry then offered a Motion to approve the Time Extension for Jefferson park with the three
suggested terms and conditions. Sonia Huyck seconded the Motion.

Before the public hearing section of the agenda, the Chairman outlined the procedure for those
present.
The first item of public hearing concerned a request for a Special Use Permit to allow construction of
a four-family dwelling in the R-2 (Combined Medium Density Residential) zoning district, on
property located on the north side of Spruce Street appro�mately 200 feet east of S. Georgia
Avenue. The property is Lot 1, Block 1 of Precht Subdivision. The applicant was Sallie Bradshaw.
Dennis explained that the property is a 13,340 sq.ft. parcel and the applicant plans to construct a two
story townhouse design. Each unit will have a private fenced rear yard.
The applicant also described the project. Madeline asked Ms. Bradshaw if she agreed with the
suggested conditions, and she said that she did. She will also provide a sidewalk on Spruce Street.
Dennis said that the sidewalk was a requirement of the original subdivider but this had been
overlooked when the plat was recorded. The suggested conditions did not include a requirement for
sidewalks since this was a requirement of the subdivider. However, the Commission could add it to
the list of conditions if they so desired.
Eugene Winters of 2615 E. Spruce expressed concern about irrigation flows and whether this
development would block that flow. It was explained that both State and City ordinances require free
passage of irrigation water. In response to a question about parking, Rick said that the applicant is
providing eight spaces, which is two more than required by Code.
Luis Astorquia who is constructing the neighboring triplex expressed concern about the siting of the
four-plex, in that his own building is sited facing east, and the four-plex will be sited facing south
which he asserted would give his property a view of the four-plexes rear yards. He commented that
he had no objection to the proposal for the four-plex.
Sallie Bradshaw responded that she will put a covered irrigation pipe along the front of the property.
She will keep the proposed siting facing south since it offers a better perspective from the road.

have a clearly defined proposal. She did feel that curb, gutter and sidewalk should be required as part
of the project. Terry agreed with Bettie, adding that the Code does not address physical site
placement of buildings.
Madeline said that she considered this an appropriate development considering the size of the parcel
and the variety of housing types in the location.
Bettie then offered a Motion to approve the Special Use Permit subject to suggested conditions but
with an additional requirement for curb, gutter and sidewalk on the Spruce Street frontage. Dorothy
Davidson seconded the Motion which passed unanimously.

The next public hearing concerned a request for comprehensive plan designation and zoning
classification in connection with proposed annexation of property at the northwest corner of
Homedale Road and Montana Avenue. Associated with this request was a companion Special Use
Pernut to construct a LDS Seminary School on the property. Rick explained that the hearings would
be held concurrently but that separate votes would be taken on each item. It is not the role of the
Commission to review the annexation, since that is the City Council's responsibility, but to
recommend Comprehensive Plan and Zoning classifications, should annexation be approved.
Dennis explained that the location is considered suitable for this type of use, since a corner parcel on
two arterial roadways would be difficult to develop residentially. Staff is recommending one point of
access on Homedale Road and one on Montana Avenue. Circulation is a concern because of the
increased traffic generated by the new High School.
Scott Wendell, architect for the project, testified and asked the Commission to look at the suggested
conditions. The Church do not feel 13 parking spaces are necessary but that 4 would be more
appropriate, since the students using the facility would not be driving cars but walking across
Montana Avenue. There would be two teachers and a part-time secretary employed at the school.
They were also concerned about allowing access fiom both Homedale and Montana because once
traffic increases people will use the facility parking lot as a shortcut to the other roadway to avoid the
intersection.
Madeline asked how he thought the church could guarantee no students would park, since students
will drive rather than walk. Mr. Wendell conunented that students will park in the spaces provided,
i.e. if four spaces are provided, then only four people will park there. He did not think there would be
any evening activities. He was not supportive of temporary bamers to prevent access through the
property to avoid the intersection but prefened landscaping. Sonia said that as an area resident,
Montana Avenue is a road of choice for many travellers. Mr. Wendell said that if they are required to
increase the parking they would prefer it be on the northern side of the property.

In response to a question from Rick, Dennis stated that in his opinion the seminary use could change
and if parking is allowed to be less than required, future uses would perhaps not have sufficient
parking. The property is large enough to accommodate the required parking. He agreed that there
does need to be something done to prevent cars using the property as a way to avoid the intersection
and would support a request for an access on Montana Avenue only.
The public testimony portion of the hearing was closed. Terry agreed with the architect that the i
seminaries are well controlled and that there are no evening activities.
Bettie commented that the requirements of the Code should be adhered to. Madeline agreed saying
that the Commission has to be consistent. She agreed that the one access on Montana Avenue was
appropriate.
After further discussion Bettie Pilote offered a Motion to recommend to the City Council a
Comprehensive Plan designation of Low Density Residential and a zoning classification of R-1
(Single Family Residential) for the subject property. Terry McConnell seconded the Motion.

Terry McConnell offered a Motion to approve the Special Use Permit for the LDS Seminary School
subject to suggested conditions, omitting condition #5 but requiring the applicant to work with Staff

The final public hearing was consideration of a Resolution of Interpretation to assist in clarifying and
interpreting ambiguities that cunently characterize the City's Sign Ordinances and Regulations. Items
to be considered include a definition of terms, free-standing signs, portable and temporary signs,
abandoned signs and signs placed and/or constructed within the public right-of-way. The applicant is
the City of Caldwell.
Dennis explained that this item was reviewed and sent to Council in 1994 and City Council elected to
have another workshop. At that workshop on April 24, 1995, it was generally agreed that this
Resolution would be a preliminary step in amending the Sign Ordinance in that it allows Staff and the
Commission to evaluate signs more appropriately. Dorothy asked Dennis how portable signs will be
addressed. Dennis responded that we will attempt to define a standard regarding size, placement and
time frame and bring that to the Commission and eventually Council for consideration.

In response to a question from Sonia, Dennis said that the Sign Committee recommended this
approach, with the understanding that the business community is informed that the ordinance is being
reviewed and that it will be enforced.
Sonia offered a Motion to forward the Resolution of Interpretation of the Sign Ordinance to the City
Council with a recommendation of approval. Madeline Buckendorf seconded the Motion.

Dennis commented on items acted on by Council and potential items for forthcoming Planning and
Zoning Commission agendas. He informed the Commission that there is one meeting scheduled for
June and two meetings scheduled for July, then one schedule for August, to avoid conflict with the
Caldwell Night Rodeo.
There being no further business the meeting adjourned at 9:45 p.m.
