HomeMy WebLinkAbout9-27-1994 P&Z MINUTES i w � PLANNING AND ZONING C011�IMISSION NIINiJTES Meeting of September 27, 1994 Present: Chairman Tom Ensley, Madeli.ne Buckendorf, Dorothy Davidson, Mary Higdem, Terry McConnell Absent: Bettie Pilote, Rick Wells Staff: Dennis Crooks, Liz Yeary The special meeting of the Planning and Zoning Commission was called to order by Ghairnian Tom Ensley, at 7:00 p�. in the City Hall Council Chambers. The only item of business was the request for approval of a prelimi.nary plat entitled Fliteline , Condominiums to allow the creation of 19 condominium units at Caldwell Industrial Airport. � The plat is essentially a replat of portions of Aviation Way Subdivision No.2 which was considered and approved by the Planning and Zoning Commission on February 15, 1990. Dennis explained that the land is leased from the City of Caldwell, but that the buildings (hangars} could be sold and owned by various individuals, who would be subject to the tenns of the City's lease. The purpose of the plat is to complete the legal procedure to permit ownership of the buildi.ngs without accompanying ownership of the underlying ground. Steve Millemann, on behalf of the applicant, agreed with Dennis, stating that ultimately the lease will be assigned to individual owners who will take over management of the condominium complex. The concept had been discussed with the Airport Manager and accepted. Covenants, Codes and Restrictions will be recorded to protect the City's interests and the owners' association will be obliged to maintain a reserve of one year for the City land rental fee, so there will always be money to pay the rental. Before final plat Mr. Millemann said that they would divide the parcel into two blocks for ease of property management since they are not contiguous parcels. In response to a question from Terry McConnell, Mr. Millemann said that he was in full agreement with the suggested terms and conditions. Mary Higdem commented that the item is in conformance with the Comprehensive Plan and the area is designated as indusdrial. Mary questioned whether the hangar units could be sold from one individual to another. Mr. Millemann responded that the units aze considered real property and can be sold but are always subject to the established lease agreement. Teny commented that currendy hangar space at the airport is only available by rent and the idea of unit ownership will fulfill a need. After a short discussion, Mary offered a Motion to approve the Preliminary Plat subject to the suggested conditions. Terry McConnell seconded the Motion. �m�rrES pa�z 9-z�-9a �� i � . ROLL CALL VOTE.
