MIlVUTES Planning and Zoning Commission Workshop May 6, 1993 Present: Wanda Anthony, Rita Earl, Phil Frye, Tom Ensiey, Mary Higdem, Terry ; McConnell, Dennis Crooks, Gordon Law, Liz Yeary �'� � Chairman Tom Ensley called the meeting to order. Dennis Crooks began by thanking those I Commissioners who had attended the Council work session conceming the Area of City �'� Impact. Dennis felt that as a result of that workshop and the subsequent Council discussion of the Dave Marrs Record of Survey, the Council had an understanding of the situation the City is in and the importance of the Area of City Impact Agreement. In response to a question from Mary Higdem, Dennis reported that Lifeline Ministries had withdrawn their application for a church facility on S. Georgia because they did not want to restrict their operation to a purely educational facility which was an approach the City Attorney had suggested as an option. The City Attorney had not considered the effect of a church on adjoining commercial property and the ability to sell alcoholic beverages as a"taking" but that it might constitute a"damage or detriment to these properties". The Commission then proceeded to discuss the process of Public Hearings and the most advantageous way to present them for the benefit of the public and Commission and Staff. 1. Public hearing is formally opened by the Chair who explains the hearing procedure to the public, identifies the signature sheets on the staff desk, states the purpose of the public testimony, and requests the public to always speak into the microphone. 2. Staff gives presentation. 3. Applicant provides testimony. 4. Public testimony taken. 5. Commission discussion, questio�s and answers of staff and possibly call back public or applicant. 6. Applicant's closing statement. 7. Chairman then formally closes the public hearing, advising audience there will be no further testimony accepted. If an individual requests to provide further testimony, the public hearing would have to be formally reopened. 8. Commission Discussion, questions of other departments and staff. P&Z WORKSHOP NIINUTES 5/6/93 - P.1 t In response to a question from Wanda Anthony, Dennis said that information from other deparunents can be obtained in three ways. a) Dennis will attempt to get the information and relay it to the Commission as part of the Staff Report. b) Approval of a request may be condirioned subject to review and acceptance by other departments. c) Involving more complex cases where the information is critical to making a rational, informed decision, an item may be continued until the information is received. 9. Motion - it was emphasized that a motion must be made and a brief statement of justificarion. Motion will be seconded. 10. Discussion of Motion - this is when the Commission discusses the merits of the motion on the table. 11. Amendment to the Motion - if an amendment to the original motion is offered and seconded, the Commission discusses that amendment and votes on it. 12. Subsequently, the original Motion is restated and then voted on. 13. It was agreed by the Commission that to ensure order and proper record keeping, the Clerk will ask for a Roll Call vote, beginning with the maker of the Motion. Dennis then introduced the new City Engineer, Gordon Law, to the Commission. The next item on the agenda was Platting and Subdivisions. Denius explained how Cities are regulated by State Code and authority is given to the Cities to enact their own more stringent standards. The Caldwell Subdivision Orclinance was adopted in 1972 and has had minor amendments subsequently. The Ordinance requires more extensive updating now, because as the City is expanding, there are more subdivisions, and we are negotiating an Area of City Impact Agreement which will entail more review of development occurring in rural areas. The Cominission and the City may have to develop standards to suit a more rural development. Currently, our ordinance is designed to evaluate projects that are expected to be served by city utilities. We will review more cases within the Area of City Impact that cannot reasonably be expected to be served by city utilities, which will mean different density designations to accommodate wells and septic tanks, and rurai roads. Gordon was then questioned concerning the future capacity of the Sewage Treatment Plant. Gordon explai.ned that the collection system is adequate now, but the discharge permit is under review by the EPA. Ultimately if the problem is not solved there could be a P&Z WORKSHOP MINUTES 5/6/93 - P.2 # moratorium on new development connections to the sewer. There is no capacity for "wet" industries at this time, unless another "wet" industry reduces its discharge. When asked if Engineering would attend Commission hearings, Gordon responded that they will attend Subdivision Review meetings and if necessary will attend a Commission hearing. If there is no Engineering representation at a hearing and a technical question is raised, the item may be tabled or conditioned subject to the review and approval of the City Engineer. In discussing rural development in the Area of Ciry Impact, Gordon felt that the Southwest District Health Department and the Department of Environmental Quality would be a tremendous help in evaluating projects. It was felt that a separate section of the Subdivision Ordinance would deal with rural residential development and that such development could be an attractive aznenity adjacent to the urban environment, as it would provide open and green space. However, it was also cautioned the rural type development in the wrong places can serve as an obstacle to a future network of streets, urility extensions and also a master drainage plan. ; Dennis indicated the City also needs to develop a controlled access policy for collector and arterial roadways. Such a policy is a stated objective in the transportation component of the Cit�s Comprehensive Plan. Multiple access points, lot orientation and driveways being located at or near congested intersections are impairing the ability of these streets to move traffic efficiently and safely. Following further discussion Rita Earl ofFered a motion and Wanda Anthony seconded to ask Engineering and Planning and Zoning to initiate an update of the Subdivision Ordinance, to initiate an update of the Public Facilities Component of the Comprehensive Plan and initiate a controlled access policy document. All three of these items would first be considered by the Planning and Zoning Commission and then forwarded to the City Council for any final action. The motion passed unanimously. Finally, Dennis advised the Comnnission that several applications have been received which necessitate a meeting on June 3 in addition to the regular June 17 meeting.
