PLANNING AND ZONING CON1�•4ISSION MINUTES
May 24, 1989
The special meeting of the Caldwell Planning and Zoning Commission was called
to order at 12.10 p.m., in the City Hall Council Chambers by the Chairman
Bill Free, Members present were Terry Durbin, Garret Nancolas, Wanda Anthony
and Tom Ensley, Absent were Les Carter, Ron Myers and Chuck Randolph, Jr.
The purpose of the special noon meeting was to consider the request submitted
by Dr. Mike Benedick for a special use permit to allow 'construction of a
professional/office type of building on the northeast corner of Ash Street
and Arlington Avenue.
Dr. Benedick is proposing to construct a new office building for his dental
practice on Lot l, Block 3 of McKimmey Replat, which is in the R 3 zone. The
building will be approximately 35 by 50 feet and the lot size is 107 by 140
feet. The building will face on Ash Street. There is a 10 foot easement on
the east side. There will be room for off street parking in the front or on
the side of the proposed building and and still have the 20 foot setback
that is required. Also noted on the plot plan is provision for a sign, In
the R 3 zone to meet the sign codes, a sign can be 32 square feet, unlighted,
and set back 10 feet from the property line. The surrounding land uses of
the subject properties are vacant fields to the east; the Women's Clinic is
directly north; on the west side of Arlington is the Hazel Apartments; north
of the apartments is the Hazel Park Senior Citizens Housing; and to the south
are single family residences. Dr. Benedick indicated that his plans are to
build a building that will blend in with the residential area. Parking
requirements would be four spaces for one doctor practice in the building.
Chairman Free opened the public hearing and requested participation from the
audience. Testimony was offered by C=ordon Jensen representating Jensen
Construction and Dr. Mike Benedick.
Gordon Jensen said that he will be the contractor for the project and that he ',
has a p}:ot plan and a floor plan for the Com¢nission to look at. They plan
to have two curb cuts for entering and exiting the parking area and this
would eliminate backing vehicles into the street area.
Dr. Mike Benedick said that possibly a slight change may be made to the
building plans by adding dormers on the Arlington Street side.
With no further testimony given, the public hearing portion was closed. A
letter was received from Lewis and Reva Durning, 2101 Cirlce Drive, stating
that they oppose the doctor's office and their letter will be made part of
the record. Also a phone call was received from Mr. Adar,is, who owns
property to the east of the project. He said he was in favor of the office,
but expressed concerns about damaqe to his fence during construction and that
the contractors would not trespass.

89-5-2 After some discussion on the parking area by the Commission, Garret Nancolas
moved to grant the special use permit subject to meeting the specifications
of the required parking and sign. Terry Durbin seconded the motion. Motion
carried.
Findings of Fact:
l. A request was received for a special use permit to construct a
professional/o£fice building to be used as a dental office.
2. The proper legal requirements for advertisement of the hearing were done
and a public hearing was held.
3. The proposed project meets all the requirements of the zoning and
building codes for setbacks, building heights, density and square footage and
it is located in an area with mixed uses.
4. Water and sewer are available.
5 The granting of this special use permit would not cause any damage,
hazard, nuisance, or other detriment to persons or property in the vicinity.
Conclusions of Law:
As the application is in compliance with the building and zoning codes and no
adverse effect on the neighborhood was found, the special use permit should
be issued.
With no further business, the meeting was adjourned at 12:25 p.m.

Dear Sirs:
This letter is to register that we oppose any Doctors.Office or
other commercial building on the corner of East Ash and Arlington
Streets. We feel that there are ample locations North of Hazel Street
available for such offices. We also feel that this section of Ash
Street should have the same protection against commercial development
as South Tenth Street South of Hazel Street.has.
