Section 3. That Chapter 10, Article 3, Section 10- 03 -13, of the Caldwell City Code, at
subsections (20) through (21), is amended as follows:

{202 4-) Failure To Comply With Administrative Order: Failure to comply with an
administrative order after it becomes final is a misdemeanor. Filing a criminal
misdemeanor action does not preclude the city from using any other legal remedy
available to gain compliance with the administrative order.
Section 4. That Chapter 10, Article 8, Section 10- 08 -02, of the Caldwell City Code, at
subsection (4)(C)(1) and at subsection (4)(C)(7), is amended as follows:
C. Maintenance Methods: Maintenance of trees and shrubs by:
1. Clearing: The controller is responsible for removing all tree, shrub and
vegetative work derived debris relating to private trees, shrubs and vegetation
from the street, sidewalk and parkway by sunset on the day on which the work is
done unless street closure is authorized. This requirement includes immediate
removal of any private fallen trees or tree limbs from private trees that fall into
any public right of way area. Failure to immediately remove private fallen trees or
tree limbs from private trees that have fallen into any public right of way area
shall constitute a nuisance and may be abated as such by the city in any manner
p rovided by law,

7. Tree Removal And Trimming Permit Required: Prior to engaging in the
removal or replacement of trees or shrubs, to include trimming, cutting and
pruning in the public rights of way, the controller must first obtain a tree removal
permit from the city forester. The city forester or other staff representative will
inspect the work for compliance; all removal costs shall be at the applicant's
expense. A fine of four hundred dollars ($400.00) shall be assessed to the
controller /applicant and a fine of four hundred dollars ($400.00) shall be assessed
to the company that performed the removal and/or trimming if a permit was not
first obtained from the city forester prior to removal and /or t •imming and if the
company was not on the city's approved list of companies allowed to trim and/or
remove trees and /or shrubs. A lien may b e assessed against the pr-epeAy tip

Section 5. This ordinance shall be in full force and effect f and after its passage, approval,
and publication, according to law.
Section 6. This ordinance is hereby declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in
full force and effect and shall be read to carry out the purposes of the ordinance before the
declaration of partial invalidity.
Section 7. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2889
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER
4, ARTICLE 4, SECTION 04 -05 -10 OF THE CALDWELL CITY CODE PERTAINING TO THE
COLLECTION OF COSTS ASSOCIATED WITH DELETERIOUS DISCHARGES INTO THE
CITY'S PUBLICLY OWNED TREATMENT WORKS, AMENDING CHAPTER 5, ARTICLE 9,
SECTION 05 -09 -03 PERTAINING TO THE COLLECTION OF FEES FOR STREET LIGHTS,
AMENDING CHAPTER 10, ARTICLE 3, SECTION 10- 03 -13, PERTAINING TO THE USE OF
LIENS IN THE COLLECTION OF ADMINISTRATIVE FINES AND COSTS UNDER
CHAPTERS 11, 12 AND 13 OF THE CALDWELL CITY CODE, AMENDING CHAPTER 10,
ARTICLE 8, SECTION 10- 08- 02(4)(C)(1) SO AS TO PROVIDE THAT A VIOLATION
THEREOF CONSTITUTES A NUISANCE WHICH MAY BE ABATED BY THE CITY, AND
AMENDING CHAPTER 10, ARTICLE 8, SECTION 10- 08- 02(4)(C)(7) BY DELETING
REFERENCE TO THE USE OF A LIEN IN COLLECTING FINES ISSUED THEREUNDER;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN
CONFLICT HEREWITH.
Sections 1 through 4: Amends Chapter 4, Article 4, Section 04 -05 -10, of the Caldwell City Code, to
allow for collection of costs associated with deleterious discharges as part of the responsible property
owner's sewer user billing account, and removing reference to the filing of a lien; Amends Chapter 10,
Article 3, Section 10 -03 -13 by deleting reference to the use of liens in collection of administrative fines
and costs and renumbering the following section; Amends Chapter 10, Article 8, Section 10 -08 -02 to
provide that a violation of subsection (4)(C)(I ) constitutes a nuisance, and by removing references to the
use of liens in collecting the fines or costs resulting from violations of the Caldwell Tree Ordinance.
Sections 5 through 7: Provides that this ordinance shall be in full force and effect from and after its
passage, approval, and publication, according to law; provides for severability; repeals conflicting
ordinances, resolutions and orders.
Ordinance No. 2889 provides an effective date, which shall be when published in the Idaho Press Tribune
on the 12th day of December, 2011. Ordinance No. 2889 was passed by the Council and approved by the
Mayor on the 5th day of December, 2011. The full text of the Ordinance is available at Caldwell City
Hall, 411 Blaine Street, Caldwell, Idaho 83605. The Mayor and City Council approved the foregoing
summary on the 5th day of December, 2011, for publication on the 12th day of December, 2011, pursuant
to Idaho Code § 50 -901 A.
