ORDINANCE NO. 2851
AN ORDINANCE AMENDING CHAPTER 10, ARTICLE 12, SECTION 4 OF THE CALDWELL CITY CODE
WHICH IS THE CITY CENTER DISTRICT ORDINANCE; PROVIDING FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND
PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon. State of Idaho.
Section 1. Chapter 10, Article 12, Section 4, regarding Caldwell's city center district ordinance, shall be
amended as follows:
Section 10- 12- 04(19)B.6. Off premises signs and/ billboards both temporary and permanent, are prohibited in
the city center zoning district, except that certain temporary off premises signs, for special events only. may be
permitted as outlined in section 10 -02 -06 of this chapter; andfurther excepting the following
The City of Caldwell may provide permanent_signage within the City Center district for the following
purposes: highlighting landmarks and entry points to downtown or specific districts: highlighting the
history of downtown Caldwell: providing maps and geographical information: on central locations,
listing businesses within the jGi enter zoning district; providing a designated place for posting
fliers, posters for upcoming events and public notices; providing one electronic reader board in the
City Center district to be owned and maintained by the City to advertise special events as well as
businesses located within City Center who would pay for such advertising. Such permanent signage
shall be reflective of the types and styles contained within the page titled "Sidewalk Signage"
contained with the "City Center Zoning District Design Guideline Pictures ", shall be placed on City
property or property owned by the Caldwell East Urban Renewal Agency, shall have to receive
approval from City Council through a— ubl c_hearin!a prior to placement, and shall be owned,

Section 2. This ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid
by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be
read to carry out the purposes of the ordinance before the declaration of partial invalidity.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2851
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER
10, ARTICLE 12, SECTION 4 OF THE CALDWELL CITY CODE; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT
HEREWITH.
Section 1: Amends Chapter 10, Article 12, Section 4, regarding Caldwell's City Center signage
ordinance, allowing certain permanent off premises signs to be placed by the City of Caldwell only after
receiving approval from City Council through a public hearing. Further amends same chapter, article and
section by increasing sign height for projecting or suspended signage ; increasing sign area, spacing and
number of allowed signs for wall signage; increasing sign area and number of allowed signs for
permanent and temporary window signage.
Section 2: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law.
Section 3: Repeals conflicting ordinances, resolutions and orders.
Section 4: Provides for severability.
Ordinance No. 2851 provides an effective date, which shall be when published in the Idaho Press Tribune
on the 25` day of April 2011. Ordinance No. 2851 was passed by the Council and approved by the
Mayor on the 18 day of April 2011. The full text of the Ordinance is available at Caldwell Planning &
Zoning Department, 521 Cleveland Boulevard, Caldwell, Idaho. The Mayor and City Council approved
the foregoing summary on the 18 day of April 2011 for publication on the 25` day of April 2011,
pursuant to Idaho Code 50 -901 A.
