MILLER MEMORIAL SITE AT THE CALDWELL AIRPORT) Council Members present: Blacker, Ozuna, Hopper, Callsen, Dakan, and Sobba. Staff Members in attendance: Brent Orton and Rob Oates. Guests in attendance: Carolyn Martell-Miller, Skip Bicknese, Lewis Enloe, Craig, Watkins, David Sim, Debbie Winters, Jamie Winters, Linda Watkins, Bill Hinkle, and Mack Kreizenbeck. The Mayor declared the workshop open. Rob Oates, Caldwell Airport Manager spoke in behalf of the Airport Commission. He reported that the proposal was brought before the Airport Commission a few months ago and received unanimous approval with a recommendation for it to be brought forward to City Council for final determination. Carolyn Martell-Miller, 16479 Malt Road, Caldwell, spoke in favor of the request for the addition of Mr. Miller’s name to the Caldwell Industrial Airport signage as a 20-year minimum memorial with the wording: “Richard D. Miller PhD, Field.” She stated that the request is not a name change but rather an addition to signage as other memorials are displayed currently on the City of Caldwell Airport property. Ms. Martell-Miller continued by stating that Mr. Miller’s community involvement included being a Professor of Music at College of Idaho for ten years, Chief Flight Instructor for FAA at Treasure Enterprises, President of AERO-FLITE, Inc., Senior Jet Captain, Training Officer for J.R. Simplot Company, Airpark development and design for Cartell, Inc., and instructor for King Air Flight School. Lewis Enloe, Retired Director of Aviation at J.R. Simplot Company, spoke in support of the proposal. He outlined Mr. Miller’s involvement with the Simplot Company as a pilot and flight/aviation consultant. He stated that Mr. Miller was well known within the United States as well as internationally within the aviation field. Craig Watkins, Chief Pilot of Aviation at J.R. Simplot Company, spoke in favor of the proposal. Skip Bicknese, 601 Three River Way, Fruitland, spoke in favor of the request. He noted that he is employed as the Band Director for the Ontario High School and was well acquainted with Mr. Miller through the field of music. Mr. Miller organized the College of Idaho Jazz Festival while he was a professor at the College of Idaho, which was a well attended event in Caldwell for many years. David N. Sim, M.D., 6014 Emerald Street, Boise, spoke in favor of the request. Bill Hinkle, of Hinkle Aviation located at the Caldwell Industrial Airport, spoke in favor of the request. Mack Kreizenbech, 1328 E. Mastiff Street, Meridian, spoke in favor of the request. In conclusion, Ms. Miller stated that this project would give honor to her husband for the many years of service that he dedicated to involvement with aviation at the Caldwell Airport and his community support. She recommended approval of the request. The Mayor expressed appreciation to those who provided testimony in behalf of the proposed project and stated that City Council would consider the information as it was given this evening. No decisions were made or action taken within this workshop. Workshop dismissed at 6:59 p.m. REGULAR MEETING March 21, 2011 7:00 P.M. The Mayor reported that a City Council Public Workshop was conducted at 6:30 p.m. for the purpose of discussing the proposal for a Richard D. Miller Memorial Site at the Caldwell Airport. No decisions were made or action taken within the workshop. The Mayor asked that everyone stand for the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: Blacker, Ozuna, Hopper, Callsen, Dakan, and Sobba. its use. SPECIAL PRESENTATIONS A.Employees of the Month Presentation: Mayor Nancolas introduced Eric Nye and Devern Berryman as the Employees of the Month for February 2011. He read a memorandum from Fireman Marc Maiello in which he recommended both of the employees for Employee of the Month due to their efforts beyond the call of duty in an incident which took place on February 4, 2011. B.Mayor’s Youth Advisory Council (MYAC) report from their recent trip to Washington, D.C.: Members of the Caldwell Mayor’s Youth Advisory Council presented brief reports concerning their recent trip to Washington, D.C. Presentations were given by: Taylor Jenson, Stephanie Krantz, Marisol Morales, and Brianna Baker. They expressed their appreciation for the opportunity to attend the NLC Conference and reported on the information they gained from the many workshops and speakers. All of the students referenced the impact of being able to meet face to face with the Idaho congressmen and share their concerns regarding the national debt through the presentation of their White Paper. Susan Miller expressed her appreciation for the opportunity to assist by chaperoning the students. The Mayor thanked the students for representing Caldwell in such a professional manner at this national event. He emphasized that all of the dollars expended on this trip were through fundraising efforts by the Mayor’s Youth Advisory Council. Councilman Blacker expressed his appreciation of the Mayor’s Youth Advisory Council on behalf of the City Council for their professionalism in which they conduct their events and travel experiences. He stated that they represent the City of Caldwell in an outstanding manner. MOTION CARRIED OLD BUSINESS: (CONTINUED FROM JANUARY 18, 2011 AND FEBRUARY 22, 2011, AND MARCH 7, 2011: PROTEST HEARING TO CONSIDER THE ACCEPTANCE OF THE ASSESSMENT ROLL PREPARED IN CONNECTION WITH LOCAL IMPROVEMENT DISTRICT [LID] NO. 08-1 FOR WATER AND SEWER CONNECTION FEES) Mark Hilty, 1303 North12 Avenue Road, Nampa, reviewed the facts concerning Council’s consideration of the Assessment Roll for Local Improvement District No. 08-1 and Mr. Celestino’s inclusion on the Assessment Roll. He noted that Council previously recommended that Mr. Celestino be removed from the Assessment Roll since he was not the responsible party in the property’s illegal connection to the sewer and that the responsible party be contacted regarding the amount owing the City. Mr. Hilty reported that his office is moving forward with trying to contact the builder that was actually responsible for the illegal connection. He recommended on leaving LID No. 08-1 in place since this is a voluntary LID but remove Mr. Celestino from the Assessment Roll. MOVED by Hopper, SECONDED by Blacker to remove Mr. Celestino from the Assessment Roll for LID NO. 08-1. MOTION CARRIED (CONSIDER BILL NO. 11 [ORDINANCE NO. 2870] FOR CASE NO. DAN-185-11 [PAINE DE- ANNEXATION] WITH A REQUEST TO WAIVE THE RULES, PASS ON THE FIRST READING AND APPROVE THE SUMMARY FOR PUBLICATION) The Mayor noted that the public hearing for this matter was previously held. MOVED by Hopper, SECONDED by Blacker to approve the Caldwell Comprehensive Plan Map resolution. MOTION CARRIED NEW BUSINESS: (CONSIDER BILL NO. 14 [ORDINANCE NO. 2873] FOR AMENDMENTS TO CHAPTER 4 OF THE CALDWELL CITY CODE REGARDING THE CEMETERY WITH THE REQUEST TO WAIVE THE RULES, PASS ON THE FIRST READING, AND APPROVE THE SUMMARY FOR PUBLICATION) th Mark Hilty, 1303 12 Avenue Road, Nampa, stated that the amendments were prepared by Aaron Seable of Hamilton, Michaelson, and Hilty in consultation with City staff. He recommended that Mr. Seable attend the next Regular City Council Meeting to be held on April 4, 2011 to address in detail the proposed amendments. Mayor Nancolas suggested that Mary Hawker, administrative assistant at the Caldwell Cemetery, also th attend the April 4 meeting to outline current procedures followed at the Cemetery in comparison to proposed changes outlined within the ordinance. MOVED by Hopper, SECONDED by Blacker to continue this item to the next Regular City Council Meeting to be held on April 4, 2011 at 7:00 p.m. MOTION CARRIED (CONSIDER THE APPROVAL OF RESOLUTION NO. 38-11 AUTHORIZING FUNDS FOR THE PROCUREMENT OF ACCELA SOFTWARE AND ASSOCIATED HARDWARE ) Brent Orton, 621 Cleveland Blvd., presented the staff report concerning the authorization of funds for the Accela software. He presented handouts outlining the Accela package features and the cost which would be divided among the departments using the software. The current departments affected by its use would be Engineering, Building, Planning and Zoning, and Fire. He noted that staff is working with Canyon County concerning the possibility of Canyon County hosting the hardware. He clarified that there would not be charges from Accela for improvements made to the software above and beyond the annual maintenance fee. Discussion followed among Council Members concerning the program’s capabilities, current features of the BluePrints software used by Development Services and the Fire Department, and budgetary impact issues. th Mark Hilty, 1303 12 Avenue Road, Nampa, reported that he has reviewed the maintenance agreement and had concerns regarding the limitation of liability statement. He contacted the company concerning the document’s language. He noted that he was comfortable with the negotiations and it was clear that the company is excited to work with the City of Caldwell. Councilman Hopper stated that the limitation of liability statement is fairly common among software companies. The Mayor read Resolution No. 38-1: A RESOLUTION OF THE CITY OF CALDWELL, IDAHO TO AUTHORIZE THE USE OF CITY FUNDS FOR PROCUREMENT OF ACCELA SOFTWARE AND ASSOCIATED HARDWARE. THE ESTIMATE OF COST IS $213,000 TO BE APPROPRIATED FROM DEPARTMENT BUDGETS AND FROM THE GENERAL FUND. MOVED by Callsen, SECONDED by Dakan to approve Resolution No. 38-11 authorizing the funds for the procurement of Accela software and associated hardware. Roll call vote. He noted that the setback limitations that require a 300-ft. separation between premises that sell alcohol and either schools or churches, could be waived with approval of City Council for establishments within the City Center Zone. Those seeking such a waiver would be reviewed by Council on a case- by-case basis through the public hearing process. In response to questions from Mayor Nancolas, Anne Marie Skinner reported that this issue was initially brought forward by inquiry from a local floral shop owner wanting to provide wine sales by the bottle and/or wine tasting events within their facility. Since that time, the floral shop has not pursued the matter; however, a restaurant is now seeking a certificate of occupancy for a building that is located within 300-feet of a church in the downtown area. Discussion followed by Council Members concerning the amount of store-front churches located within the downtown area and how such an ordinance will assist Council in reviewing each request on a case-by-case basis. MOTION CARRIED (FINANCE AND HUMAN RESOURCE REPORTS) Councilman Callsen reported that the Finance Committee has reviewed current accounts payable in the amount of $1,839,197.84 for the period ending March 16, 2011 and net payroll in the amount of $256,836.43 for the pay period ended March 12, 2011. MOVED by Callsen, SECONDED by Blacker that accounts payable in the amount of $1,839,197.84 represented by check numbers 74928 through 75456 and the total payroll in the amount of $256,836.43 represented by check numbers 21353 through 21394 and direct deposits be accepted, payment approved, and vouchers filed in the office of the City Clerk. MOTION CARRIED (COUNCIL COMMENTS) None. (MAYOR’S COMMENTS) The Mayor reported that the U.S. Census Report has been received and Caldwell is now listed as the sixth largest city in the State of Idaho. He highlighted the events at the recent National League of Cities Conference in Washington, D.C. and the various workshops he was able to attend. The Mayor noted that the Caldwell YMCA has reached two mile stones this year: Anniversary of five (5) years of operation and reaching a goal of 16,000 members.
