AN ORDINANCE RECITING THE PASSAGE, APPROVAL AND PUBLICATION (,
ORDINANCE no. 785; DETERMINING THAT NO OBJECTIONS TO THi VACATION
OF FIRST AVENUE AND THIRD AVENUE AS PLATTED IN GOLDEN GATE ADDIT-
ION AND SEVENTH AVENUE AS PLATTED IN GOLDEN GATE ADDITION AND
DEVERS ADDITION, AND NINTH AVENUE AS PLATTED IN DEVERS ADDITION TO
THE CITY OF CALDWELL, IDAHO, AS TO THOSE PORTIONS OF SAID AVENUES
AS THEY CROSS THE RIGHT OF WAY FOR U.S. HIGHti11AY NO. 20, HAVE BEEN
MADE OR FILED AND THAT NO CLAIM OR CLAIMS FOR DAMAGES wTHICH 1 ,00ULD
BE SUSTAINED BY REASON THEREOF HAVE BEEN FILED: DETERMINING THAT
THE VACATION OF FIRST AVENUE AND THIRD AVENUE AS PLATTED IN GOLDEN
GATE ADDITION AND�SEVENTH AVENUE AS PLATTED IN GOLDEN GATE ADDIT-
ION AND DEVERS ADDITION, AND NINTH AVENUE AS PLATTED IN DEVERS
ADDITION TO THE CITY OF CALDWELL, IDAHO, AS TO THOSE PORTIONS OF
SAID AVENUES AS THEY CROSS THE RIGHT OF WAY FOR U.S. HIGHWAY NO.
20, IS TO THE BEST INTEREST AND ADVANTAGE OF THE CITY OF CALDWELL,
ITS CITIZENS AND PROPERTY OWNERS; DETERMINING THAT NO DAMAGE 14ILL
BE SUSTAINED BY ANY CITIZEN OR PROPERTY OWNER BY REASON OF THE
VACATION OF SAID FIRST AVENUE AND THIRD AVENUE AS PLATTED IN
GOLDEN GATE ADDITION AND SEVENTH AVENUE AS PLATTED IN GOLDEN GATE
ADDITION AND DEVERS ADDITION, AND NINTH AVENUE AS PLATTED IN
DEVERS ADDITION TO THE CITY OF CALDWELL, IDAHO AS TO THOSE POR-
TIONS OF SAID AVENUES AS THEY CROSS THE RIGHT 6F WAY FOR U. S.
HIGH19AY NO. 20; PROVIDING THAT THE TITLE TO FIRST AVENUE AND
THIRD AVENUE AS PLATTED IN GOLDEN GATE ADDITION AND SEVENTH. AVENUE
AS PLATTED IN GOLDEN GATE ADDITION AND DEVERS ADDITION, A '

Be it,ordained by the Mayor and Council oflihe
Idaho:
Se.;tion 1. That by ordinance no. 785, passed by`""
the Council and approved by the Mayor of the City of Caldwell,
Idaho, on the 5th day of September, 1951, and published in The
Caldwell News - Tribune, a newspaper published in the City of
Caldwell, Idaho, in one issue thereof on the 15th day of Septem- `
ber, 1951, notice was given to all citizens and owners of prop-
erty in the City of Caldwell, Idaho, that an application had beef
presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting the passage and approval of an ordinance va-
catin. First „venue and Third Avenue as platted in Golden Gate
Addition and Seventh Avenue as platted in Golden Gate Addition
an. Devers Addition, and Ninth Avenue as platted in Devers Ad-

dition to the City of Caldwell, Idaho, as to those portions of s =,ii
avenues as they cross the right of way of U.S. Xighway No. 20;
which ordinance provided the manner for filing claims for damages
which would be sustained by the vacating of the streets above
described.
Section 2. That no objections to granting said
application have been made or filed and no claim or claims for
damages which would result therefrom; and it is hereby deter-
mined that no citizen of or owner of property in the City of
Caldwell will be damaged or injured by the vacation of First
Avenue and Third Avenue as platted in Golden Gate Addition and
Seventh Avenue as platted in Golden Gate Addition and Devers
Addition, and Ninth Avenue as platted in Devers Addition to the
City of Caldwell, Idaho, as to those portions of said avenues as
they cross the right of way for U.S. Highway No. 20, and that it
is in fact to the best interest and advantage of the City of
Caldwell, Idaho, and its citizens and its property owners that
the above described streets be vacated.
Section 3. Be it ordained and established that
First Avenue and Third. Avenue as platted in Golden Gate Addition
and Seventh Avenue as patted in Golden Gate Addition and Devers
Addition, and Ninth Avenue as platted in Devers Addition to the
City of Caldwell, Idaho, as to those portions of said avenues as
they cross the right of way for U. S. Highway No. 20, from and
after the passage, approval and publication of this ordinance,
shali be vacated, and that said streets shall no longer be open
or subject to use by the public; and thereupon the title to said

ating the same or their successors, heirs and assigns, free o:' al
easement and dedication heretofore existing for a public street
therein.
Section 4. It appearing that no claim or claims
for damages sustained by any citizen or citizens of the City of
Caldwell, Idaho, or by any owner or owners of property therein, t
reason of the vacation of said portionsof said streets has been
filed or made, it is hereby. determined that no damages will be
sustained by the citizens of or owners of property in the City of
Caldwell, Idaho, by reason of the vacation of said portionsof sai
streets.
Section 5• That all ordinances or parts of or-
dinances in conflict herewith are hereby repealed.
PASSED by the Council of the City of Caldwell,
this 1st day of October, 1951.
APPROV$D by the Mayor of the City of Caldwell,
