HomeMy WebLinkAboutORD 2861BILL NO.2 ORDINANCE NO. 2861 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 19 OF THE CALDWELL CITY CODE REGARDING THE CREATION, MEMBERSHIP, TERMS OF OFFICE, ORGANIZATION AND DUTIES OF THE CALDWELL TRAFFIC COMMISSION; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. Chapter 2, Article 19 of the Caldwell City Code, regarding the Caldwell Traffic Commission, shall be amended as follows: 02- 19 -01: COMMISSION CREATED: There is hereby created and established a commission to be known as the Caldwell Traffic Commission. (Ord. 1840,1-15-1990) 02- 19 -03: MEMBERSHIP; TERMS OF OFFICE: (1) Membership: The Caldwell Traffic Commission shall consist of the Public Works Director, the City Engineer, the Chief of Police, the Fire Chief, the Planning & Zoning Director, the Street Superintendent or their designees and one (1) at -large member (Ord. 2300, 9 -7 -1999) (2) Terms Of Office: i appe t +h Commission shall be made as fellows: two (2) 2 year t effns .I t (2) Avon tenns. All a s4seq a shall be made fat fou (4) year terms (0 d . 1884 0, 1 -15 1990) The at-large member shall be appointed for a term of three 3 ears commencing the 1' day of January and ending on December 31 by the Ma or and Cit y Council. &y vacancy shall be filled by appointment in the same manner and shall serve only for the remainder of the term which is vacant. 02- 19 -05: ORGANIZATION: The Commission shall meet monthly in the Couneil ehama at a set time and location convenient to members. T he Commi ssion shal e l e et effleefs f4em eng the c o w" issie members: The Public Works Director shall serve as Chair of the Commission and the Chief of Police shall serve as the Vice -Chair of the Commission. The Chairffmn shall preside at meetings of the Commission. The viee ehaifm Vice -Chair shall, in the absence of the Chairman, perform the duties of the Chair. All meetings of the Commission shall be open to the public BILL No. 2 (TRAFFIC COMMISSION) PAGE 1 OF 2 and follow the requirements of Idaho's open meeting laws'. The Commission shall keep minutes and other appropriate written records. A simple majority of Commission members present at any given meeting constitutes a quorum. (Ord. 1840, 1- 15 -90) 02- 19 -07: DUTIES: The Commission is formed for the purpose of making recommendations to the Mayor and City Council in all matters pertaining to traffic safety. (Ord. 1840, 1- 15 -90) Section 2. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 3. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 4. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. O BILL No. 2 (TRAFFIC COMMISSION) PAGE 2 OF 2 ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 2861 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 2, ARTICLE 19 OF THE CALDWELL CITY CODE REGARDING THE CREATION, MEMBERSHIP, ORGANIZATION, AND DUTIES OF THE CALDWELL TRAFFIC COMMISSION; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. Section 1: Amends Chapter 2, Article 19 of the Caldwell City Code, regarding the Caldwell Traffic Commission, as follows: (1) Appoints the Public Works Director, Assistant City Engineer, Chief of Police, Fire Chief, Planning & Zoning Director, and Street Superintendent or their designees and one (1) at -large member as full-time members of Caldwell Traffic Commission. (2) Establishes a term of three (3) years for the at -large member of the Caldwell Traffic Commission. (3) Grants the Caldwell Traffic Commission the flexibility to select a meeting location that is convenient for members. (4) Designates the Public Works Director as the Chair of the Caldwell Traffic Commission. (5) Designates the Chief of Police as the Vice -Chair of the Caldwell Traffic Commission. Section 2: Repeals conflicting ordinances, resolutions and orders. Section 3: Provides that this ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 4: Provides for severability. Ordinance No. 2861 provides an effective date, which shall be when published in the Idaho Press Tribune on the 1" day of March, 2011. Ordinance No. 2861 was passed by the Council and approved by the Mayor on the 22 " day of February, 2011.
