PLEDGE OF ALLEGIANCE TO THE FLAG. ROLL CALL. CONFLICT OF INTEREST DECLARATION. SPECIAL PRESENTATIONS ADDITIONS OR DELETIONS TO THE AGENDA. AUDIENCE PARTICIPATION. CONSENT CALENDAR: 1. Approve acceptance of the minutes from the Regular City Council Meeting held on August 2, 2010; the Caldwell Traffic Commission Meeting held on August 2, 2010; the Caldwell Industrial Airport Commission Meeting held on August 5, 2010; the Caldwell Historic Preservation Commission Meeting held on June 28, 2010; and the Caldwell Housing Authority Meetings held on December 1, 2009, January 5, 2010, February 2, 2010, March 2, 2010, April 6, 2010, May 2010, and June 2010; 2. Approve Order of Decision for Case No. ZON-70-10 (Simplot Rezone); 3. Approve of appointment of Bill Buckendorf to the Pathways and Bike Routes Committee as Maureen Toomey’s replacement and completing the remainder of her her term with an expiration date of December 31, 2012; 4. Approve Resolution accepting an Easement from Vision Charter Schools for pressure irrigation main line at the Vision Charter School site; 5. Approve Resolution requesting items located at the Caldwell Police Department to be declared as surplus property for the purpose of donations being made to the Emmett Police Department. 6. Set the public hearing date for September 20, 2010 to consider Amendments to the Appropriation Ordinance No. 2801 (Bill No. 19) for Fiscal Year 2009-2010; 7. Approve Resolution ratifying an emergency repair to the disinfection system at the Caldwell Wastewater Treatment Plant pursuant to Idaho Code Section 67-2808. OLD BUSINESS: 1. Second Reading of Bill No. 23 (Ordinance 2838) for Local Improvement District 10-1 under the second reading. 2. Consider Bill No. 18 (Ordinance 2833) for Case No. ZON-70-10 (Simplot rezone) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 3. Public Hearing pursuant to Idaho State Code 50-1002 for consideration of the proposed budget for the fiscal year beginning October 1, 2010 and ending September 30, 2011. 4. Consider Bill No. 24 (Ordinance 2839) the Appropriation Ordinance for Fiscal Year 2010-2011 with the request to waive the three reading process and pass on the first reading by title only. 5. Consider acceptance of the fees in excess of 5% of the amount previously charged and set the public hearing date for September 20, 2010 during the Regular City Council Meeting to be held at 7:00 p.m. NEW BUSINESS: 1. Consider Bill No. 2842 (Ordinance 27) amending Chapter 6, Article 7 (Liquor, Beer and Wine Regulations). 2. Public Hearing (Qausi-judicial): Request by Yuri Blanco of Remax Realty for vacation of a portion of public utilities, irrigation, and drainage easement. The request is made to correct an easement encroachment of the home at 14289 Moreno Drive built in said easement rendering the property as “un-financeable.” 3. Consider Bill No. 29 (Ordinance 2844) for vacation of a portion of public utilities, irrigation, and drainage easement to correct an easement encroachment at 14289 Moreno Drive with a request to waive the rules and pass on the first reading. 4. Consider Bill No. 15 (Ordinance 2830) annexing a portion of property within the corporate city limits known as 19291 Ward Lane into the Caldwell Municipal Irrigation District with a request to waive the rules and pass on the first reading. 5. Public Hearing (Quasi-judicial): Case Number APP-03-10 a request by Cirrus Pointe LLC to amend an existing development agreement for Cirrus Pointe Subdivision by modifying the responsibility for Cirrus Pointe Subdivision’s traffic mitigation requirement. The site is zoned R-1 Low Density Residential and is located on the west side of Indiana Avenue approximately 2,000 feet south of Karcher Road. 6.
