ROLL CALL. SPECIAL PRESENTATIONS. ADDITIONS OR DELETIONS TO THE AGENDA. AUDIENCE PARTICIPATION. CONSENT CALENDAR: 1. Approve acceptance of the minutes from the Regular City Council meeting held on July 2, 2007 and the City Traffic Commission meeting held on July 2, 2007; 2. Approve Order of Decision for Case No. SUB-173P-07 (Montana Subdivision); 3. Approve Order of Decision and Development Agreement for Case No. ANN-152-07/SUP-288-07(Deide annexation); 4. Approve Order of Decision for Case No. SUB-109(2)F-04 (Whitney Springs Subdivision No. 2); 5. Approve Resolution accepting dedication of sewer, water, storm drain, and street light facilities from Willow Falls, LLC for Willow Falls Subdivision; 6. Approve Resolution accepting a a Quit Claim Deed for right-of-way from the Church of Jesus Christ of Latter-day Saints regarding the future development of Linden Street; 7. Approve Resolution accepting a Quit Claim Deed for right-of-way from BH Caldwell, LLC along Ustick Road at Cleveland Boulevard in exchange for right-of-way being vacated on Arthur Street; 8. Approve Resolution accepting a Contract Amendment by the State of Idaho, Department of Health and Welfare and the Caldwell Police Department; 9. Approve Resolution authorizing the execution of a Real Estate Purchase and Sale Agreement from Middleton School District #134 for the Purple Sage Elementary School well; 10. Approve Resolution authorizing the execution of Option to Purchase Right-of-Way and Easement Agreements from Keith Talbert and Arlene DuBose for intersection improvements at l0th Avenue and Linden; 11. Approve Resolution authorizing the execution of a New Merchant Application with U.S. Bank for payment of utility or City transactions to be made by Visa or MasterCard; OLD BUSINESS: 1. Consider Bill No. 25 (Ordinance No. 2676) for Case No. ANN-153-07 (McDaniel annexation) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 2. Consider revised Bill No. 12 (Ordinance No. 2663) for Case No. DAN-01-07 (Payne de-annexation) with a request to waive the rules, pass on the first reading, and approve the summary for publication. (This request is to correct an error in the legal description.) 3. Conduct Public Auction of approximately 168 acres located north of Caldwell off of Old Highway 30 near Purple Sage Golf Course for a minimum bid of $50,000 per acre pursuant to Idaho Code Section 50-1403 (1). NEW BUSINESS: 1. Public Hearing (Quasi-Judicial): Case No. ANN-158-07, a request by Larry and Sandra Corn, Land Associates and Landmark Engineering for annexation of 56.68 acres into the City of Caldwell with an R-1 Single Family Residential zone, a development agreement, and a comprehensive plan map designation of Low Density Residential. The site is located at 20666 Middleton Road. 2. Public Hearing (Quasi-Judicial): Case No. ANN-147-07/SUB-170P-07, a request by Landmark Engineering and Planning for annexation of 8.09 acres into the City of Caldwell with an R-1 Single Family Residential zone, a development agreement, a comprehensive plan map designation of Low Density Residential, and preliminary plat approval of Eagle Rock Subdivision No. 2 consisting of 23 residential lots and 1 common lot. The site is located west of Midland Road approximately ½ mile north of Highway 20/26. 3. Public Hearing (Quasi-Judicial): Case No. CA-96-07, a request by Greensprings Fellowship Trust for a Certificate of Appropriateness to operate professional offices in the Steunenberg Residential Historic District. The site is located at 1208 Blaine Street. This case is being appealed to the City Council after denial from the Historic Preservation Commission. 4. Public Hearing (Legislative): Case No. OA-87-07 (temporary use permits), a request by the Planning and and Zoning Director to revise the text in the ordinance for Temporary Use Permits. 5. Consider Bill No. 43 (Ordinance No. 2694) for Case No. OA-87-07 (temporary use permits) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 6. Consider Bill No. 49 (Ordinance No. 2700) to amend the Caldwell City Code, Chapter 3, Article 1, pertaining to salaries with the request to have this stand as the first reading. 7.
