AUDIENCE PARTICIPATION. CONSENT CALENDAR: 1. Approve acceptance of the minutes from the Regular City Council meeting held on April 21, 2008; the Caldwell Golf Board meeting held on April 16, 2008; the Caldwell Planning and Zoning Commission meeting held on April 8, 2008; and the Friends of the Caldwell Depot meeting held on March 13, 2008; 2. Approve Order of Decision and Development Agreement for Case No. ANN-169-08 (Kapic annexation); 3. Approve Resolution authorizing the execution of a Memorandum of Understanding with the College of Idaho for the Baseball Diamond located near Griffith Parkway; 4. Approve Resolution authorizing the execution of a Purchase/Compensation Agreement for a temporary construction easement with Olga Gonzalez for the 11th Avenue Indian Creek Bridge; 5. Approve Resolution authorizing the execution of a Right-of-Way Negotiation and Appraisal Services Agreement(s) with Larry Rincover for the Interchange 29 Stage III Projects; 6. Approve Resolution accepting a corrected Quitclaim Deed from David Tiffany and Oanh Kim Hoang Tiffany for right-of-way improvements along North Georgia Avenue; 7. Approve Resolution accepting a Quitclaim Deed from the College of Idaho for the release from all restrictive terms and conditions set forth in the 1962 Agreement regarding the Canyon Multi-Purpose Stadium, Inc.; 8. Approve request from the Parks Department to waive building permit fees in the amount of $599.94 for construction of a metal picnic shelter at Luby Park; 9. Approve request from Dennis Cannon, Downtown Redevelopment Coordinator, to incorporate Phases I and II of the Indian Creek Project into the City Park System. OLD BUSINESS: 1. Consider Bill No. 55 (Ordinance 2706) for Case No. ANN-164-07 (Category B annexations) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 2. Consider Bill No. 15 (Ordinance 2735) for Case No. ANN-169-08 (Kapic annexation) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 3. Consider Bill No. 21 (Ordinance 2741) for Case No. ZON-56-08/SUB-170PF-08 (Kearney Business Condominiums) with a request to waive the rules, pass on the first reading, and approve the summary for publication. NEW BUSINESS: 1. Public Hearing (Quasi-judicial): Case No. SUB-169PF-07 a request by Hibbard Properties LLC for short plat approval of Eagle’s Nest Condominiums consisting of 3 existing buildings with 36 existing residential units. The site is located at 1110, 1112, and 1114 Kimball Avenue. 2. Public Hearing (Quasi-judicial): Case No. ANN-119-06-DAA a request by Marblefront 118 LLC and Landmark Engineering for an amended development agreement for the former Bishop Ranch Subdivision. The site is within the City of Caldwell and is zoned R-1 (Low-Density Residential) with a Low Density Residential designation on the Caldwell Comprehensive Plan Map. The site is located at the southeast corner of Wells Road and Lincoln Road. 3. Public Hearing (Legislative): Case No. OA-96-08 a request by Caldwell’s Planning and Zoning Director for an Ordinance Amendment to amend City Code Section 10-02-09 regarding Home Occupations; create a new Section 10-02-14 concerning regulatory standards for new pubic schools; and create a new section 10-02-10 regarding child care facilities. 4. Consider Bill No. 17 (Ordinance 2737) for Case No. OA-96-08 (home occupations, public school standards, child care facilities) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 5. Public Hearing (Legislative): Case No. OA-97-08 a request by Caldwell’s Redevelopment Coordinator for an Ordinance Amendment to amend City Code Section 10-12 regarding the City Center Zoning District. 6. Consider Bill No. 23 (Ordinance 2743) for Case No. OA-97-08 (city center zoning district) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 7. Public Hearing (Legislative): Case No. OA-98-08 a request by Caldwell’s Planning and Zoning Director for an Ordinance Amendment to amend City Code Section 10-03-11 regarding zoning definitions. 8. Consider Bill No. 9 (Ordinance 2729) for Case No. OA-98-08 (zoning definitions) with a request to waive the rules, pass on the first reading, and approve the summary for publication. 9.
