AN ORDINANCE PROVIDING FOR THE ISSUANCE OF A PERMIT AND THE APPLI-
CATION FOR A PERMIT FOR THE CONDUCTING OF A PUBLIC DANCE, PROVIDING
A PERMIT FEE, EXEMPTING CERTAIN CHARITABLE, RELIGIOUS AND SCHOOL
ORGANIZATIONS, DECLARING THE CONDITIONS OF A MISDEMEANOR, AND
PROVIDING A PENALTY.
BE IT ORDAINED By the Mayor and Council of the City of
Caldwell, Idaho:
Section 1. Permit required. Any person, society, organiza-
tion, or corporation, who shall conduct, or cause to be conducted,
any public dance, as herein defined, and except for those persons
exempted herefrom, shall first obtain a permit from the Chief of
Police of the City of Caldwell.
Section 2. Application for permit. Application for the
permit specified in Section 1 shall provide the name of the sponsor.
ing person, or organization, the name of responsible persons who
will personally supervise the activities, and such other information
as may be required by the Chief of Police.
Section 3. Permit fee. Upon approval of the application for
the permit provided for in Section 2 by the Chief of Police, in
writing, and after the payment of a permit fee of Five & No/100
($5.00) DOLLARS, the Clerk shall issue a permit which shall be
valid only for the date specified.
Section 4. Exemptions. The provisions of this ordinance
shall not apply to dances sponsored or conducted by religious,
(fraternal or charitable organizations, where the attendance at said
�dance is limited and restricted to members of such organization,
nor shall a permit be required for dances sponsored or conducted by
school organizations where the attendance is limited to children of
school age, nor shall a permit be required of businesses which
possess or own liquor or beer licenses.
Section 5. Definition. A public dance is a dance which is
open to the public generally.

Section 6. Misdemeanor declared. Any person who shall
conduct, or cause to be conducted, any dance or dance hall without
first having obtained a permit as provided in this ordinance shall
be deemed guilty of a misdemeanor.
Section 7. Penaltj. Any person found guilty of violating
the provisions of this ordinance shall be fined a sum not to
exceed ONE HUNDRED & N01100 ($100.00) DOLLARS, or imprisoned in
the city jail for a period not to exceed thirty (30) days.
