HomeMy WebLinkAboutORD 963BILL NO. 9 ORDINANCE NO. 963 BY COUNCILMAN FinleY AN ORDINANCE BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO TRANSFERRING TO THE STATE OF IDAHO, AND AUTHORIZING THE EXECUTION OF THE PROPER DEEDS OF CONVEYANCE, AN UNDIVIDED ONES -HALF INTEREST IN CERTAIN REAL PROPERTY BELONGING TO THE CITY OF CALDWELL, FOR THE PURPOSES OF AN ARKIORY CONSTRUCTION SITE; REPEALING ALL ORDINANCES, RESOLUTIONS, OR ORDERS OR PARTS THEREOF IN CONFLICT HERE'WIT11 AND DECLARING AN EMERGENCY. BE IT ORDAINED By the Mayor and Council of the City of Caldwe Idaho: Section 1. That WHEREAS, The Mayor and Council, by three- fourths vote of the elected, qualified and acting councilmen at a meeting of the Council held for that purpose on the 44"day of 1960, have determined that it is in the best interest of the City of Caldwell to sell and convey unto the State of Idaho an undivided one-half interest in the real property hereinafter described, for military purposes and for the purpose of an Armory construction site. Section 2. That there is hereby conveyed and transferred unto the State of Idaho for the purposes aforesaid, the following described real property, to-wit: An undivided one-half interest in the following described real property*. Beginning at a oint on the Southeasterly boundary line of Lot 21 of Fair �cres Addition to the City of Caldwell, Idaho, as the same is shown on the official Plat thereof now on Pile and of record in - the office of the Recorder of Canyon County, Idaho, which point is 25 feet East and at right angles from the West boundary line of said Lot 21; thence Northeasterly along the Southeasterly boundary line of said Lot 21 and the Southeasterly boundary line of Block 22 of Hasbrouck's Re- Subdivision of Block 138 Strahorn Addition, and Lots 22, 24, 25, and 28 of Fair Acres Addition, as the same is shown on the official plat thereof now on file and of record in the office of the Recorder of Canyon County, Idaho, to the East corner of Lot 7 of said Block 22; thence Northwesterly along the Northeasterly boundary line of said Lot 7 and the Northeasterly boundary line of said Lot 7 extended, to the South corner of Lot 15 of said Block 22; thence Northeasterly along the Southeasterly boundary line of Lots 15, 16, and 17 of said Block 22 to the East corner of said Lot 17; thence Northwesterly along the Northeasterly boundary line of said Lot 17 and the Northeasterly boundary line of said Lot 17 extended point which is 25 feet East and at right angles to t to the boundary line of Lot 23 of said Fair Acres Addition; thence South and parallel to the West boundary line of Lot 23 and Lot 21 of sai d Fair Acres Addition, to the point of beginning, containing 5.1 acres. The Mayor and City Clerk are hereby authorized and directed to make, execute and deliver a proper deed of convey- ance to accomplish the purposes herein set forth. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED By the council this 29th day of July, 1960.
