BE IT ORDAINED By the Mayor and Council of the City of Caldwell, Idaho; Section 1. That by Ordinance No. 954, passed by the Council and approved by the Mayor on the 13th .day of April, 1960, and published in the T ews- 'T`ribane, a( tewspaper published in the City of Caldwell, Idaho, and in one issue thereof, on the 23rd day of April, 1960, notice was given to all citi4ens and owners of property in the City of Caldwell, Idaho, that are application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting the passage and approval of are ordinance vacating the alley adjacent to. Lot 2, pf the Indust rial-SIt e Addition to the City of Caldwell,, Idaho, as the same is shown on the official plat thereof now on file and of record in the office of the Recorder of Canyon County, Idaho, which a ley is more particularly described as follows Beginnirg at the Northeast corner of Lot 24 of the Industrial-Site Aaditi n to the City of Caldwell, Idaho, as the same is shown on the official, plat thereof now on .file and of record in the office of the County Recorder of Canyon County, Idaho; thence South along the East lime of said Lot 24 a distance of 165.03 feet; thence East and parallel to the South line of Garber Street a distance of 25.00 feet; thence North and '.parallel, to the West line of said Lot 24, 165.00 feet to the South line of Garber Street; thence West along the South line of Garber street extended a distance of 25.030 feet to the point of beginning; which ordinance provi.di.ng the manner for filing claims for damages which would be sustained by the +vacation of the alley above deacribe . ..:LAW OFFICES SMITH & MILLER - - - CALDWELL IDAHO Section 2. That no ob to granting said application have been made or filed and no claim or claims have been made for damages which would result therefrom; and it is hereby determined that no citizen of, or,owner of property ir, t ae City of Caldwell will be damaged car injured lay the vacation of the alley as con- tained in Block 1 in Wastside Addition to the City of Caldwell, Idaho, as the same is shown on the official plat hereof now on file and of record in tine office of the .Recorder of Canyon County, Idaho, and that it is in fact to the best interest and advantage of the City of Caldwell, Idaho, and its citizens and its property owners that the above - described alley be vacated. Section 3. BE IT MAI O AND ESTABLISH E That the alloy adjacent to Trot 24 of the Industrial. -Site Addition to the City of Caldwell, Idaho, As thsAaMe is shown on the official plat thereof now on file and of record in the Office of the,Recorder of Canyon County, Idaho, from and after the passage, approval and publication of this ordinance, shall be vacated and that said alley shall no longer be open or subject to dse by the public, and thereupon the title to said alley shall pass and revert to the persons dedicating the same or their successors, heirs and assigns, free of all ease- ment and dedicationn heretofore existing for a public way therein. Section 4. That thare shall he retained to the public exist- ing easements for sewers gather utilities. Section 5. It appear*ng that no claim or claims for damages sustained -by any citizen 'or ci.titens 'of the City of Caldwell, Idaho,. or by any owner or owners or property therein, by reason of the vacation of said alley has been filed or made, it is hereby deter- mined that no damages will be sustained by the citizens of or owners of property in the City of Caldwell, Idaho, by reason of the vacatior of said alley. Section 6 That all ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED By the Council, this 16th day of May, 1960. APPROVED By the Mayor, this 16th day of Mays 1960.
