AN ORDINANCE RECITING THE PASSAGE, APPROVAL AND PUBLICATION OF "
ORDINANCE N0. 950, DETERMINING THAT NO OBJECTIONS HAVE BEEN MADE
AND FILED TO THE VACATION OF THE ALLEY AS CONTAINED IN BLOCK 1 IN
WESTSIDE ADDITION -TO THE CITY OF CALDWELL, IDAHO, AS SAME IS
SHOWN ON THE 'OFFICIAL HE THEREOF NOW ON FILE ON RECORD IN THE OFFICE OF THE RECORDER I N CANYON COUNTY,.IDA DETERMINING THAT
THE VACATION.OF SAID ALLEY IS TO THE BEST INTEREST AND ADVANTAGE OF
THE CITY OF CALDWELL, ITS CITIZENS AND PROPERTY OWNERS; DETERMINING
THAT NO DAMAGE WILL BE SUSTAINED BY ANY CITIZEN OR PROPERTY OWNER
BY.REASON OF THE VACATION OF SAID ALLEY*' ,THE TITLE
TO SAID ALLEY AS'VACATED SHA REVERT TO THE PERSONS DEDICATING THE
SAME, THEIR SUCCESSORS, HEIRS OR REPEALING ALL ORDINANCE
OR PARTS OF ORDINANCES IN CONFLI HEREWITH AND PROVIDING FOR THE
PUBLICATION OF THIS ORDINANCE ITS TA{ING EFF°°ECT.
BE IT ORDAINED By the Mayor and Council of the City of
Caldwell, Idaho:
Section 1. That by Ordinance loo. 950, passed by the Council
and approved by the Mayor on the 7th day of March, 1960, and pub -
listaed in The News Tribune, a. newspaper pitblzshed in the City of
Caldwell, Idaho, and in one issue thereof on the 12th day of
Ma ch, 1960, notice was given to all citizens and'owners of propert
in the City o f Caldwell, Idaho, that an`a.pplication has been pre -
sented to the Mayor and Council of the City of Caldwell, Idaho,
requesting the passage and approval of an ordinance vacating the
alley as contained.in Block 1 in Westside Addition to the City of
Caldwell, Idaho, as the same is shown on the 'official, plat thereof
now on file anal on record in the office of the Recorder in Canyon
County, Idaho, which alley is more particularly described as followrs:
Beginning at the Northwest corner of Lot 1 of -Block 1
ofWestside Addition to the City of Caldwell, according
to the official plat thereof now on-file in the Office
of the County Recorder of Canyon. County, Idaho; thence
South.along the West boundary line of Lots I through 5,
120: feet tb Southwest,corner of;Lot 5. of said Block
1; thence °Nest: 15 feet to the Southeast corner of Lot
I 35 of said Block 1; thence North, along the East boundary
line of said Lot 35, 120 feet to the Northeast corner of
said Lot 35; thence East '1S feet to the point of beginning.

Section 2. That no objections to granting said a pplication
have been made or filed and no claim or claims have been made for
'' damages which would result therefrom; and it is hereby determined
that no citizen:of, or owner of property in the City of Caldwell
will be damaged or injured by th vacation of the alley,as con-
tained in Block l in Westside Addition to the City of Caldwell,
Idaho, as the same is shown on the official plat thereof now on
file and on 'record in the office of the Recorder in Canyon County,
Idaho, and that it is in fact to the best interest and adv of
the City of`Caldwell, Idaho, and its citizens and its property
owners that the above - described alley be vacated.
Section 3. BE IT ORDAINED A ESTABLISHED That the alley as
contained in Block 1 in "Westside Addition to the City of Caldwell,
w,
Idaho, as the same is shown on the official plat thereof now on
file and on record in the office of the Recorder in Canyon County,
Idaho, from and after the passage, approval and publication of
this ordinance, shall be vacated and that said alley shall no
longer be open -or subject to use by the public; and thereupon the
title to said alley shall pass and revert to - the persons dedicating
the same or their successors, heirs and assigns, free of all ease-
ment and dedication heretofore existing for a, public way therein.
Section -1,. ' That there shall be retained to the public exist-
ing easements for sewers and other utilities.
Section 5. It appearing that no claim.or claims -f damages
sustained by any citizen or citizens of._the City of Caldwell, Idaho,
or by any owner or ,owners of property therein, by reason of the
vacation of said alley has been filed or made, it is hereby deter-
mined that no damages will be sustained by the,citizens of or owners
of property in the 'City of Caldwell, Idaho, by reason of the,vacatio
of said alley.
