The owner shall state at the time application is made for such license and upon printed forms provided for such purpose his name and address and shall describe the dog to be licensed in such manner that the dog may be identified with reasonable certainty. Each license issued under the provisions of this ordinance shall be val until and including the 30th day of April of the year for which it is issued, and shall be renewed annually upon payment of the fees above provided. The provisions of this section shall not be intended to apply to those owners who are non-resident temporarily with the city for LAW OFFICES SMITH & MILLER CALDWELL, IDAHO ing with the number on the certificate. Every owner shall be required to provide each dog with a collar to which the license tag must be affixed and shall see that the collar and tag are worn at all times. In case a dog tag is lost or destroyed, a duplicate will be issued by the Police Department upon presentation of the receipt showing payment of the license fee for the current year. IDAHO mailed or delivered to the person to whom the license is issued. Such notice shall be mailed or delivered to the address shown on posting and mailing of such notice the dog shall not have been redeemed by the owner, it may be destroyed or sold for a sum of money sufficient to discharge the costs and charges incurred by the city for impounding and keeping the dog together with the license fee for the current year if unpaid. PROVIDED, That no dog which appears to be suffering from rabies nor any dog of fi dangerous, or vicious propensities shall be released from the pound but shall be destroyed. The buyer of any dog under the provisions of this section shall become the owner of the dog free { from any claim or title of the original owner or harborer. Section 10. RABIES AND NOTIgE If a dog is believed to have rabies or has been bitten by a dog suspected of having rabies, ,such dog shall be confined by a leash or chain on the owner's premises and shall be placed under the observation of a veterinariar lat the expense of the owner for a period of two (2) weeks. The t owner shall notify the poundmaster or dogcatcher of the fact that his dog has been exposed to rabies and at his discretion the poundmaster or dogcatcher is empowered to have such dog removed ;from the owner's premises to a veterinary hospital and there placed k4 LAW OFFICES SMITH & MILLER CALDWELL. IDAHO under observation for a period of two (2) weeks at the expense of the owner. It shall be unlawful for any person knowing or suspecting a dog has rabies to allow such dog to be taken off his premises or beyond the limits of the city without the written permission of the poundmaster. Every owner or any other person, upon as- certaining a dog is rabid, shall immediately notify the pound- master, the dogcatcher, or a policeman, who shall either remove for said dogs provided that such dogs kept in the kennel are not permitted off the kennel owner's premises. The application for kennel license shall state the name and address of the owner of said kennel, the location where the kennel is to be kept and the number of dogs proposed to be kept. No kennel shall be established within one hundred and fifty (150) feet of any dwelling house other than that of the kennel owner. If kennel shall be issued a license, certificate shall be posted in a conspicuous place at the kennel and no kennel license shall be transferrable except on application by both the old and now kennel owner and the payment of the sum of Two Dollars LAW OrFICKS SMITH & MILLER CALDWELL, IDAHO (42.00) for transfer fee to the City of Caldwell, Idaho. Further, this section shall become effective July 20. 1959 Section,12. TITIES. Any person found violating any provisions or section of this ordinance shall be guilty of a misdemeanor and upon c nviction thereon shall be punished by a fine of not less than ve Dollars (05.00) and no more than One Hundred Dollars C., 01 for such offense. Section 13. R"ZEAL OE 991 _QRMNAKC95. Sections 9-101 through 9-111 of Title �,X of Chapter I of the Code of 1942 of the City of Caldwell are hereby repealed. Section 14. SEPARABILITY QE MOMISIMS. It is the intention of the City of Caldwell, Idaho, that-each separate section of this ordinance shall be deemed independent of all other sections i herein and it is further the intention of the City that if any provision or section of this ordinance be declared invalid, all other sections thereof shall remain valid and enforceable.
