BY COUNCILMAN AN ORDINANCE CREATING A PLANNING COMMISSION FOR THE CITY OF CALDWELL UNDER THE PROVISIONS OF TITLE 50, CHAPTER 27, IDAHO CODE, PROVIDING FOR THE NUMBER, QUALIFICATIONS, AND TERM OF OFFICE OF THE MEMBERS THEREOF, PROVIDING FOR THE ORGANIZATION AND MEETINGS THEREOF, AND SETTING FORTH THE POWERS AND DUTIES OF SAID COMMISSION,, WHEREAS, The continued growth and expansion of the City of Caldwell, Idaho, requires thorough planning and programming; AND, WHEREAS, such planning can best be performed by a commission of the citizens of Caldwell; and it is deemed neces- sary and in the interests of the public and the inhabitants of said city that a planning commission be formed; NOW, THEREFORE, Be it ordained by the Mayor and Council of the City of Caldwell, as follows: Section 1. There is hereby created and established, under the provisions of Title 50, Chapter 27 of the Idaho Code, a commission to be known as "CALDWELL PLANNING COMMISSIONtt. Section 2. Membership and Terms of Office. - -The Caldwell Planning Commission shall consist of seven (7) members to be ap- pointed by the Mayor, with the consent and approval of the Council. One of such members shall be a member of the City Council, and such memberts term of office shall correspond to his term of office as a member of the City Council. The remaining six members shall be resident taxpayers of the City of Caldwell. The term of office for the first appointive members shall be as follows: two of such members for two years, two for four years, and two for six years, the respective terms of office to be determined by lot at the first meeting of the commis- sion. Thereafter, the term of office for each appointive member shall be six years. Vacancies shall be filled by action of the Mayor, with the consent of the City Council. Members shall be selected without regard to political affili- ations, and shall serve without compensation. -1- Section 3. Organization, Rules and Meetings.- -The Commission shall elect its own chairman, and may create and fill such other offices as it may determine necessary. The Commission shall hold one regular meeting each month for not less thannine months in each year. A majority of the appoint- ive members of the Commission shall be necessary to constitute a quorum at any meeting. All meetings shall be open to the public. 'Written rules may be adopted by the Commission for the transaction of business, and a written record of meetings, resolutions, findings, and deter- minations shall be kept, which record shall be a public record. The Commission may require the attendance at any meeting of such other city officials as it may deem necessary. Section 4. Powers and Duties. - -It shall be the duty of the Commission to recommend and make suggestions to the City Council for the adoption of coordinated plans for the physical develop- ment of the city; for the formation of zoning districts, to make suggestions concerning the laying out, widening, extending, and locating of streets, roads, and highways for the relief of traffic; to make suggestions concerning density of population and development of land within the jurisdiction of the city; to make suggestions concerning the future growth, development, and beautification of the city with respect to its public buildings, streets, parks, grounds, and lands. To give suggestions concerning landscaping and /or location of buildings, structures, or works to be erected, constructed, or altered by individuals, corporations, or the city. The Commission shall have all the powers conferred by Title 50, Chapter 27, of the Idaho Code, with respect to cooperating with Planning Commissions of other counties or cities. Any and all maps, plats, and replats of land which require the approval of the City Council shall first be submitted to the Commission -2- 0 0 for its suggestion, and the Commission shall have a reasonable time within which to examine such maps, plats, or replats before returning the same to the City Council. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. This ordinance shall be in force and shall take effect from and after its passage, approval and publication.
