AN ORDINANCE AMENDING SECTION 6 -118 OF THE CALDWELL CODE OF 1942
MAKING THE PENALTY FOR VIOLATION THEREOF TO BE A FINE OF NOT TO
EXCEED $100.00 AND OR THIRTY DAYS (30) IN JAIL AT THE DISCRETION
OF THE COURT; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED By the Mayor and City Council of the City

Section 1. That Section 6 -118 of the Caldwell Code of

1942 be amended to read as follows:

"6 -118. Drunkenness.- -Any person who shall be in
11 a state of intoxication in any of the streets,
alleys or other public place within the limits
12 of the City of Caldwell, except his private
apartments occupied by him, shall, upon con -
13 viction thereof, be fined in any sum not to
exceed one hundred ($100.00) dollars and or
14 thirty (30) days in jail at the discretion
of the court."

Section 2. All ordinances or parts of ordinances in
16
conflict herewith are hereby repealed.

Section 3. This ordinance shall take effect from and
18
after its passage, approval and publication.
