9 Be it ordained by the Mayor and Council of the City of
10 Caldwell, Idaho:
11 Section 1. The term Ttperson't when used in this ordinance
1211shall mean and include any person, firm, parntership, corporation
1.311or any other association.
P1: 14 Section 2. It shall be unlawful for any person to engage
15 in the trade or commercial business of cutting, trimming or removing-
16 trees located an street parking or street property, without first
17 1procuring a license therefore as in this ordinance provided.
18 Section 3. Each applicant for such license shall make
19 apDlication to the superintendent of parks on a form to be furnished
20 by the city, which application shall be signed by the applicant and
21 shall show such information as may be required by the superintendent
22 11cf parks.
231 Section 4. The superintendent of parks shall either
24 approve or disapprove such application. If such application be
215� pproved, the applicant.shall.file said application with the City
26 Clerk together with a license fee of Five Dollars ($5.00) per annum.
27 Such license shall be issued for the calendar year or the balance of
28 he calendar year only.
29 Before such license is issued, there must be on file with
30 the City Clerk a policy of public liability and property damage
31 insurance executed by an insurer authorized to furnish such insurance
- the State of Idaho, or an indemnity bond executed by a

1 surety company authorized to execute surety bonds within the State
or
2 of Idaho, such policy of insurance/indemnity bond to provide not lesi
3 than Five Thousand Dollars ($ 000.00) for loss of life or personal
4 injuries to any one person, and not less than Ten Thousand Dollars
5 ($10,000.00) for all loss of life and personal injuries to more than
6 one person arising out of any one accident, and Five Thousand Dollar;
7 ($5,000-00) for damage to property arising out of any one accident.
8 If the superintendent of parks shall disapprove such
9 application for a license, the applicant shall have the right within
10 a period of ten days from the date of such disapproval to appeal to
11 the Council of the City of Caldwell and the decision of the City
12 Council shall be final.
13 Section 5. Any license may be revoked by the Council of
14 the City of Caldwell for the violation of any ordinance of the City
1f5of Caldwell regulating the trimming, cutting or removal of trees.
16 Section 6. It is hereby made unlawful for any person not
ono
17 the owner thereof, to willfully cut, injure, disfigure or destroy
18 any shade trees, or any part thereof, or an ornamental tree growing
19 on either private ground or any street, sidewalk or public park or
20 place in the City of Caldwell.
21 . Section 7. It shall be unlawful for any person to hitch
22 or fasten any animal to or otherwise destroy or injure any growing
23 or living shade tree or ornamental tree, or for any person to cut,
24 break, girdle, or in any way injure any shade or ornamental tree
25 which has been planted or may hereafter be planted on any of the
_96 public streets or grounds of the City of Caldwell, except by consent
27 Of the superintendent of parks.
28 Section 8. Any violation of Section 2, 6 and 7 shall
29 constitute a misdemeanor and any person so violating Section 2, 6
30 and 7 shall be guilty of a misdemeanor and upon conviction thereof
31 shall be fined not to exceed $100.00.

passage, approval and publication.
