6 CUTTING THE STREET OR ALLEY TO REIMBURSE THE CITY OF CALDWELL FOR
THE COST OF RESTOHING THE STREET OR ALLEY; PROVIDING THE PENALTY
7 FOR VIOLATING THIS ORDINANCE.
8 Be it ordained by the Mayor and Council of the City of
9 Caldwell, Idaho:
10 Section 1. The term "person" when used in this ordinance
11 shall mean and include any person, firm, partnership, corporation
1p or any other association.
13 Section 2. It shall be unlawful for any person to cut
0� 14 or make cuts in the streets or alleys within the city limits of the
15 City of Caldwell for the purpose of making sewer connections, water

16 connections, and otherwise without first making application to the
o 17 City Engineer of the City of Caldwell and obtaining his permission
, to cut said street or alley as the case may be. Said application
1911 shall be made upon a form provided by the City Engineer.
Section 3. If the City Engineer grant permission for
21 the cutting of any street or alley, the person cutting said street
2,' or alley shall backfill the cut.and said cut shall be thoroughly
water settled in a manner which will meet with the approval of the
City Engineer; and where a paved street is cut the restoration of
pavement shall be made by the City of Caldwell at the expense of
the person cutting the street or alley and payment shall be made
to the City of Caldwell at the time said permit is granted. Said
2811 expense shall be determined on a per square yard basis of the area
cut, the charge for which shall be determined by a resolution of
the Council of the City of Caldwell with a minimum charge of 15-00-
3111 Should the cut destroy more pavement than paid for at the time the
permit is issued an additional charge for the area affected shall

3 Section 4. Any violation of Section 2 and Section 3 of
4 this ordinance shall constitute a misdemeanor and any person so
5 violating Section 2 and Section 3 shall be guilty of a misdemeanor
6 and upon conviction thereof shall be fined not to exceed $100.00.
7 Section 5. This ordinance shall take effect from and
8 after its Passa approval and publication.
