IN GOLDEN GATE ADDITION AND SEVENTH AVENUE AS PLATTED IN GOLDEN
6 GATE ADDITION AND DEVERS ADDITION, AND NINTH AVENUE AS PLATTED IN
DEVERS ADDITION TO THE CITY OF CALDWELL, IDAHO, AS TO THOSE PORTION
7 OF SAID AVENUES AS THEY CROSS THE RIGHT OF 16'AY FOR U.S. HIGHUdAY NO.
20; PROVIDING FOR THE FILING OF OBJECTIONS THERETO AND FOR FILING
8 CLAIMS FOR DAMAGES SUSTAINED THEREBY AND PROVIDING FOR THE ASCER-
TAINING OF SUCH DAMAGES BY THE MAYOR AND COUNCIL OF THE CITY OF
9 CALDWELL; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE.
loll Be it ordained and established by the Mayor and Council
11 of the City of Caldwell, Idaho:
12 Section 1. That an application has been presented to the
Mayor and City Council of the City of Caldwell, Idaho, for the pas-
sage and approval of an ordinance vacating First and Third Avenues
as platted in Golden Gate Addition and Seventh Avenue as platted in
Golden Gate Addition and Devers Addition, and Ninth Avenue as plat -
ted in Devers Addition to the City of Caldwell, Idaho, as to those
portions of said avenues as they cross the right of way for U. S.
Highway No. 20, said portions of streets to be vacated being des-

cribed as follows:
FIRST AVENUE
®beginning at a point on the Northwesterly boundary
of First Avenue (formerly known as ;Seventh Avenue) of
Golden Gate Addition to the City of Caldwell, which
point is approximately 71 feet Southwesterly measured
along said Northwesterly boundary of First Avenue from
the most Easterly corner of Block 22 of said Golden
Gate Addition; thence Northeasterly along said North-
westerly boundary of First Avenue 152.9 feet more or
less to a point; thence South 35 38 East - 81.6 feet
more or less to a point on the Southeasterly boundary
of First Avenue; thence Southwesterly along said South-
easterly boundary 152.9 feet more or .less to a point;
thence North 35 38 t�,Test - 81.6 feet more or less to
the point of beginning.

Beginning at a point on the Northwesterly boundary
of Third Avenue of the Golden Gate Addition to the City
of Caldwell, which point is approximately 7.0 feet North-
easterly measured alon said Northwesterly boundary of
Third Avenue from the most Easterly corner of Block 24
of said Golden Gate Addition; thence South 46° 52J'
East - 80.0 feet more or less to a point; thence South-
westerly along the Southeasterly bouhdary of Third
Avenue 150.0 feet more or less to a point; thence North

the Northwesterly boundary of Block 76 Devers Addition to
Caldwell from the most Westerly corner of Lot 1 of said
Block 76; thence Northeasterly along the Southeasterly
boundary of said Seventh Avenue - 150.0 feet more or less
to a point; thence North 46 521t West 80.0 feet more or
less to a point; thence Southwesterly along the North-
westerly boundary of Seventh Avenue 150.00 feet more or
less to a point; thence South 46 52J'East $0.0 feet
more or less to the point of beginning.

Block 65 of Devers Addition to the City of Caldwell
which point is on the Northwesterly boundary of Ninth

to the most Southerly corner of Lot 13 of Block 66, Devers
Addition, thence Easterly 117.0 feet more or less to a
point on the Southeasterly boundary of said Ninth Avenue
which point is approximately 35.0 feet Southwesterly
measured along the Southeasterly boundary of said Ninth
Avenue from the most Northerly corner of Lot 24 of Block
61, Devers Addition, thence Southwesterly along the South-
easterly boundary of said Plinth Avenue 302.0 feet more

and in which application the applicant is the State of Idaho.
Section 2. That said application will be considered

under a suspension of the requirement that an ordinance be read on
three different days at a meeting of the Council of the City of
Caldwell, to be held on the 1st day of October, 1951, at the hour
of $:00 o'clock F.M., at the Council Chambers in the City Hall in
the City of Caldwell, when and where or prior to which date, any
citizen of the City of Caldwell or any owner of property in the Cit
of Caldwell may file with the Clerk of the City of Caldwell written
objections to granting said application or may file any claim for
damages which any citizen or owner of property may sustain by rea-
son of the vacation of said street, and all claims for damages will
be considered and ascertained by the Council of the City of Caldwel:
at said meeting.

Section 3. Notice of the foregoing shall.be given to all
citizens of, and owners of property in the City of Caldwell, Idaho,
by the publication of this ordinance in the Caldwell News- Tribune,
a newspaper published in the City of Caldwell, Idaho, in at least
one issue thereof, and commencing with the issue published on
September �,r - 1951.
PASSED by the Council of the City of Caldwell third th

APPROVED by the Mayor of the City of Caldwell this,.4th

32
