4 AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF AND 0117NERS OF PROPERTY
IN THE CITY OF CALD1ELL, IDAHO, THAT AN APPLICATION HAS BEEN PRE3EN-
5 TED FOR THE VACATION OF SHAVER AVENUE FROM ITS INTERSECTION WITH
CROOKHAM STREET TO ITS INTERSECTION WITH THE OREGON SHORT LINE RAIL -
6 ROAD COMPANY SPUR RIGHT OF WAY, AS PLATTED BETWEEN LOTS 3 AND 4
OF THE INDUSTRIAL SITE ADDITION TO THE CITY OF CALDWELL, IDAHO; PRO -
7 VIDING FOR FILING OBJECTIONS THERETO AND FILING CLAIMS FOR DAMAGES
SUSTAINED THEREBY; PROVIDING FO ASCERTAINING SUCH DAMAGES BY THE
8 MAYOR AND COUNCIL OF THE CITY OF CALDWELL; AND PROVIDING FOR THE
PUBLICATION OF THIS ORDINANCE.

Be it ordained and established by the Mayor and Council of

the City of Caldwell, Idaho:

Section 1. That an application has been presented to the

Mayor and Council of the City of Caldwell, Idaho, for the passage
and approval of an ordinance vacating Shaver Avenue from its inter-
section with Crookham Street to its intersection with the northerly
boundary line of the Oregon Short Line Railroad Company spur right
of way, running parallel with and between Evans Street and Crookham
Street, as shown upon the plat of the Industrial Site Addition to
the City of Caldwell, which portion of Shaver Avenue is more partic-
ularly described as follows:

Beginning at the Northeast corner of Lot 3, Industrial
Site Addition to the City of Caldwell, running thence South
along the East boundary line of said Lot 3, to the Southeast
corner thereof; thence at right angles East to the Southwest
corner of Lot 4, Industrial Site Addition, to the City of
Caldwell; thence running North along the 1,ATest boundary line
of Lot 4 to the Northwest corner thereof; thence at right
angles West to the point of beginning.
and in which application the applicants are the owners of all of
the property abutting and adjacent to said Shaver Avenue betnreen
Crookham Street and the Oregon Short Line Railroad Company spur
right of way as above described.
Section 2. That said application will be considered

under a suspension of the requirement that an ordinance be read on

three different days at a meeting of the Council of the City of
Caldwell, to be held on theday of /.. 1951, at the
32
hour of 8:00 o'clock P.1 at the Council Chambers in the City Hall

1 in the City of Caldwell, when and where or prior to which date,
2 any citizen of the City of Caldwell or any owner of property in
3 the City of Caldwell may file with the Clerk of the City of Cald-
4 well, written objections to the granting of said application, or
5 may file any claim for damages which any such citizen or owner of
6 property may sustain by reason of the vacation of said portion of
7 Shaver Avenue, and all claims for damages will be considered and
8 ascertained by the Council of the City of Caldwell at said meeting.
9 Section 3. Notice of the foregoing shall be given to all
.0 citizens of and owners of property in the City of Caldwell, Idaho,
11 by the publication of this ordinance in The Caldwell News Tribune,
12 a newspaper published in the City of Caldwell, Idaho, in at least
13 one issue thereof and commencing with the issue published on
14 1 1951.

16 day of September, 1951.
