BY COUNCILMAN AN ORDINANCE AUTHORIZING THE DEEDING OF A PARCEL OF LAND OWNED BY THE CITY OF CALDWELL, IDAHO, TO THE STATE OF IDAHO FOR PUBLIC USE WITHOUT ANY MONETARY CONSIDERATION ACCRUING TO THE CITY OF CALDWELL . WHEREAS, The City of Caldwell, a municipal corporation of the State of Idaho, has heretofore acquired and is now the owner of the hereinafter described real property; and, WHEREAS, The State of Idaho, acting by and through the Department of Highways, desires to acquire an easement over and upon said land for the purpose of constructing the Old Oregon Trail FI FUI 3021 (1) Highway; and, WHEREAS, It is deemed to the best interests of the City of Caldwell, Idaho, that said request be granted, NOW, THEREFORE, Be it ordained by the Mayor and Council of the City of Caldwell, Idaho: Section 1. That the Mayor of the City of Caldwell, Idaho, be and he is hereby authorized and directed to execute in the name of the City of Caldwell, Idaho, for a consideration of One Dollar, a right of way deed conveying an easement to the State of Idaho over and upon the following described real prop- erty for highway purposes, said real property being described as follows: An irregular parcel of land being on the North easterly side of the right of way survey line of highway as shown on the official plat of the Franklin FI 3021 (2) Highway Survey on file in the office of the Department of Highways of the State of Idaho, and lying in a portion of the SEINE' of Section 22, Township 4 North, Range 3 West, Boise Meridian, described as follows, to -wit: Be inning at a point on the South line of the SE NE4 of Section 22, Township k North, Range 3 infest, Boise Meridian, approximately 775 feet Westerly from the East Quarter corner of said 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14' 0 15 16 17 � U 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I 0 0 Section 22; thence Westerly along the South line of the SE4 of said Section 22 a dis- tance of 122 feet, more or less, to a point on the Southwesterly boundary line of Hannibal Street extended; thence Northwesterly along said boundary line of Hannibal Street extended a distance of 49 feet, more or less, to a point; thence Northeasterly along a line being an extension southwesterly of the Southeasterly boundary of Block 58 of Devers Addition to the City of Caldwell according to the official plat thereof now on file and of record in the office of the county recorder of Canyon County, Idaho, a distance of 82 feet, more or less, to a point on the Southeasterly boundary of said Block 58, which point is approximately 2 feet Northeast- erly of the South corner thereof; thence South- easterly along a sp curve left having a central angle of 2 30' parallel to and 110 feet distant Northeasterly from said right of way survey line of highway a distance of 137 feet more or less, to the point of beginning. Highway Station reference: 192/05 to 19224.5• Section 2. This ordinance shall take effect from and after the approval and publication thereof.
