BY COUINCILi AN GLAISYER AN ORDINANCE AUTHORIZING THE CONW]YAAC E OF RZAL PROPERTY OWNED BY THL CITY OF CALMi LL, 11)AHO, TO THE STATE OF IDAHO FOR PUKIC USE livaThOUT ANY AONETAtY COl'JSIDERATION ACCRUING TO THE' CITY OF CA- LD °a -LLL. 1 ,1HZI {EAS, The City of Caldwell, a municipal corporation of the State of Idaho, has heretofore acquired and is now the owner of the hereinafter described real property, and, tiVhLAEAS, The State of Idaho, acting by and through the Department of Highways, desires to acquire an easement over and upon said land for the purpose of constructing the Old Oregon Trail FI FUI 3021(1) Highway, and, �'HZREAS, It is deemed to the best interests of the City of JjCaldwell, Idaho, that said request be granted, NUW ThLH FORE, Be it ordained by the Jvjayor and Council of 11 the City of Caldwell, Idaho; Section 1. That the Nlayor of the City of Caldwell, Idaho, 11 be and he is hereby authorized and directed to execute in the name of the City of Caldwell, Idaho, for a consideration of One Dollar, a right of way deed conveying an easement to the State of Idaho over and upon the following described real property for highway purposes, said real property being described as follows: An irregular strip of land being a portion of that certain right of way formerly owned and operated by the Boise Valley Traction Company lying situate within the Golden Gate Addition to the City of Caldwell, Idaho, according to the official plat thereof now on file and of record in the office of the Recorder of Canyon County, Idaho, and lying situate-on both sides of the right of way Survey line as shown on the official plat of` the Old Oregon Trail FI FUI 3021(1) Highway Survey on file in the office of the Department of Highways of the State of Idaho, described as follows, to wit; Beginning at a point where the center line of the Abandoned Boise and Interurban Railway intersects the Northeasterly boundary line of Galveston ;street of the Golden Gate Addition to the City of Caldwell, Canyon County, Idaho, according to the official plat thereof on file and of record in the Recorder's Office of said County; thence Southeasterly along; the Northeasterly boundary of Galveston Street - 27 feet to a point on the Southeasterly right of way line of said Railway; thence Northeasterly along said Southeasterly right of way line - 25 feet distant Southeasterly from and parallel to the center line of said Railway - 585 feet, more or less, to a point; thence Northwesterly along a curve right of -- 3709.72 foot radius, 110 feet distant Northeasterly from and parallel to the Old Oregon Trail F'I F "UI 3021 (1) Highway right of way survey line a distance of 98 feet, more or less, to a point on the Northwesterly right of way line of said Railway; thence Southwesterly along said Northwesterly right of way line - 50 feet distant Northwesterly from and parallel to said Railway center line - a distance of 621 feet, more or less, to a point on the Northeasterly boundary line of Galveston Street; thence Southeasterly along; said Northeasterly boundary line - 54 feet, more or less, to the point of beginning. Highway Station reference; 148 78 to 149 76. And Also, An irregular strip of land being all that portion of Blocks 24, 25 and 26 of said Golden Gate Addition lying situate Northeasterly of a line 106 feet distant Southwesterly from and parallel to said right of way survey line, described as follows; Beginning at Station 156�24 of the said right of way Survey line, which station is a point on curve on the Northwesterly boundary line of said Block 24 approximately 54 feet South- westerly from the Northerly corner of said Block 24; thence 202.11 feet with a 1 curve left, said curve having; a central angle of 36 441 1511 to Station 160 26.11, which station is a point of spiral curvature; thence 250.0 feet with a spiral curve left, said curve having a central angle of 1 52 30" to Station 16 276.11 Back equals 162 75.88 Ahead, which station is a point on tangent; thence South 46 521 3011 Bast on tangent 649.12 feet to Station 169¢25, which station is a point on tangent on the Southeasterly boundary line of said Block 26 approximately 68.5 feet Southwesterly from the ;easterly corner of said Block 26. And Also, A parcel of land lying situate on the Northeasterly side of said right of way survey line and lying over and across the Northeasterly 40 feet of Block 27 and the Southwesterly 40 feet of Block 30 of said Golden Gate Addition to the City of Caldwell, described as follows, to wit; Beginning at the IUesterly corner of Block 30 of said Golden Gate Addition, thence Northeasterly along the Northwesterly boundary line of said Block 30 a distance of 40 feet wore or Less to a point; thence South 46 52 3011 East along a line lU6.0 feet distant Northeasterly from and parallel to said right of way survey line a distance of 340 feet more or less to a point on the Southeasterly boundary line of said Block 30; thence Southwesterly along said Southeasterly boundary of Block 30 and said Block 27 a distance of 80.0 feet more or less to a point; thence Northwesterly along a line 40 feet distant Southwesterly from and parallel to the Northeasterly 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 oil 17 19 20 21 22 23 24 25 26 27 28 29 30 31 32 boundary of said Block 27 a distance of 340.0 feet more or less to a point on the Northwesterly boundary of said Block 27; thence hortheasterly along the Northwesterly boundary line of said Block 27 a distance of 40.0 fe<,-t more or less to the point of beginning. Highway Station reference: 170�05 to 17345. Excepting that portion already dedicated by public use or otherwise as a public road. New riijit of way required being a 5.76 acres of the 6.08 acres above described. Section 2. This ordinance shall take effect from and after the approval and publication thereof.
