MAY BE DONE AND SHOPS MAY BE OPEN, AND LICENSING BARBERS AND BARBERING WITHIN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AND PROVIDING THE PENALTY FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE ACTING MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. No person, persons, firm or corporation shall open, conduct, maintain or operate a barber shop or practice barbering for revenue, pay, free or otherwise in Caldwell, Canyon County, Idaho, unless such person, persons, firm or corporation shall have been duly licensed by the City of Caldwell for such purpose and shall have obtained a permit thereof. Section 2. Every person, persons, firm or corporation desiring to open, conduct, maintain or operate a barber shop or to practice barbering for revenue, pay, free or otherwise, must make application to the City Clerk of said City for a license therefor, which application shall be in form hereinafter des- cribed. Section 3. Every applicant for a license shall exhibit an Idaho Registered Barber's Certificate issued to the applicant and file with the City Clerk a written application stating the full name and address of applicant, including the street and number, or where said application is made by the owner of a shop, or if more than one person, or if an association or corporation, the full names and addresses including street numbers of all parties interested. The application shall also state the following: (a) The exact location, including street and number, where said barber shop is to be opened, conducted, maintained or -1- • • operated, or where said applicant intends to practice bar- bering. (b) The name and address of the owner of the premises in which said barber shop is to be located. (c) The name under which the barber shop will be opened, maintained, operated or conducted, and the application shall be signed by the applicant. Section 4. Every person, persons, firm or corporation to whom a license is granted shall pay an annual fee therefor in the sum of Two Dollars ($2.00). All such licenses shall expire at midnight on the 31st day of January following the date of issuance of said license. If and when a license is issued after the 3ost day of Jun& of any year the fee shall be one -half of said sum. All money received by way of license fees shall be paid into the General Fund of the City. Section 5. No transfer of license shall be permitted. Section 6. Every person, persons, firm or corporation now operating, maintaining, or conducting a barber shop or prac- ticing barbering for a revenue, pay, free or otherwise must secure a license or a permit in accordance with this ordinance within thirty (30) days after this ordinance shall become effective. Section 7. It shall be unlawful for any person, persons, firm or corporation to operate, maintain or conduct any barber shop or practice barbering for revenue, pay, free or otherwise without first obtaining a license as heretofore provided, or employ a person or persons to perform the duties of a barber who is not a licensed barber under this ordinance; provided that this ordinance shall not apply to any student or apprentice in any barber college approved and permitted to teach barbering by the Department of Law Enforcement of the State of Idaho. -2- Section 8. Every person, persons, firm or corpora- tion to whom a license is granted shall abide by and conform to all and every health, sanitary and other regulation affecting barbers or barbering prescribed by the laws of the State of Idaho and /or the Department of Public Welfare of the State of Idaho. And upon failure so to do, the City Council of Caldwell, Idaho, after a hearing, for good cause shown, may revoke the license of any such person, persons, firm or corporation and no new license shall be issued to such licensee or to any copartnership or association of which he is a member, or to any corporation of which he is an officer within three (3) months thereafter. Section 9. It shall be unlawful for any person, per- sons, firm or corporation to operate, maintain or conduct any barber shop, or place wherein barbering is done, in the City of Caldwell, Idaho, to be open for the business of barbering for revenue, pay, free or otherwise before 8:00 o'clock A. M. and after 6:00 o'clock P. M. on the following days, to -wit: Monday, Tuesday, Wednesday, Thursday and Friday of each and every week; on Saturday of each week said shops or places shall not be open before 8:00 o'clock A. M. or after 7:00 o'clock P. M. All barber shops shall remain closed on Sunday and the following holidays, to -wit: New Year's day, Decoration Day, Fourth of July, Labor Day, Armistice Day, Thanksgiving Day and Christmas, and when said holidays, or any of them, fall on Sunday, then the following Monday shall be observed. Section 10. Any person, persons, firm or corporation who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined for the first offense not more than Ten Dollars ($10.00) and cost of prosecution, and for second offense not more than -3- Twenty -five Dollars ($25.04) and cost of prosecution, and each day of the violation of this ordinance shall be and constitute a separate offense. Section 11. If any portion of this ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remainder of this ordinance. Section 12. This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
