AN ORDINANCE AMENDING SECTION 3 OF ORDINANCE NO. 702, AS AMENDED
BY ORDINANCE NO. 719 OF THE CITY OF CALD' -4ELL, IDAHO, CREATING
A SPECIAL COIN OPERATED AMUSEMENT DEVICE FUND AND PERMITTING
THE REMITTING OF THE CITY'S PORTION OF A COIN OPERATED DEVICE
LICENSE WHEN A DEVICE IS WITHDRAWN FROM OPERTION..
BE IT ORDAINED BY THE ACTING MAYOR AND COUNCIL OF
THE CITY OF CALDr;, {LL, IDAHO:
Section 1. That Section 3 of Ordinance No. 702 of
the City of Caldwell be amended to read as follows:
"Section 3. -- The license fee to be paid for a license
to operate a single coin operated amusement device in the City
of Caldwell, Idaho shall be determined by the denomination of
the coin required to play such device. The license fee per
calendar year for each single coin device shall be as follows:
Five cent devices
750.00

Ten cent devices
950.00
each
Twenty -five cent devices

The license fee to be paid for a license to q)erate
a multiple coin operated amusement device in the City of Caldwell,
Idaho shall be determined by the total in cents of the coins
that can be inserted in such device in one 13ay. The license
fee per calendar year for each multiple coin device shall be
as follows:

Prohibited
During the month of January each year the council
may in its discretion permit - a licensee hereunder to pay his
license fee for the calendar year in semi- annual installments,
one -half in the month of January each year and one -half on
July 1 following.
If the license be granted in any other month than
January, then the above provision does not apply and the
license fee shall be for the entire balance of the year, said
fee being determined by prorating the calendar year license
fee from the first day of the month in which said license is
to be issued.
The City Treasurer shall place the license fees so
collected in a special fund to be designated as "Coin Operated
Amusement Device Fund." From this fund the City Treasurer
shall remit to the Treasurer of the State of Idaho and to the
Treasurer of Canyon County $125.00 for each device being lic-
ensed for a full calendar year, or the prorated portion thereof
if licensed for less than a full calendar year. Remittances
by the City Treasurer to the State and County Treasurer shall
be made in quarterly installments on the 1st day of April, the
1st day of July, the 1st day of October, and the 1st day of
January each year.
The City's portion of said license fee as placed in
the Coin Operated Amusement Device Fund shall be transferred
to the general fund of the City by the City Treasurer in equal xi
monthly installments, said transfer to be made at the beginning
of each month ►s operation of said devices.
In the event any device is removed by said licensee
from operation permanently at any time during the calendar
year, the licensee may apply to the City Council of the City
of Caldwell for a refund of that portion of the City's share
of the license fee which has not been transferred to the general
fund of the City as of the date of the request for refund. The
City Council then, in its discretion, may authorize the City
Treasurer to draw a warrant on the Coin Operated Amusement
Device Fund and refund to the licensee that portion of the City's
fee not transferred to the general fund."
Section 2. This ordinance shall be in full force
and effect from and after the 1st day of January, 1949•
