AN ORDINANCE RECITING THE PASSAGE, APPROVAL, AND PUBLTCATION
OF ORDINANCE NO. 726; DETERMINING THAT NO OBJECTION TO THE
VACATION OF ARLINGTON AVENUE FROM ITS INTERSECTION WIT;: LOGAN
STREET TO ITS INTERSECTION WITH ELY, STREET AS PLATTED IN
DON AN' S LAKEVIEW ADDITION TO CALDWELL, IDAHO, HAS BEEN YJ� DE
OR FILED AND THAT NO CLAIM OR CLARIS FOR DAMAGES 4 , 11CH WOULD

STREET IS TO THE BEST INTEREST AND ADVANTAGE OF THE CITY OF
CALDWELL AND ITS CITIZENS AND PROPERTY OW MERS; DET301INING
THAT NO DAMAGE WILL BE SUSTAINED BY ANY CITIZEN OF OR PROP -
ERTY 01MER BY REASON OF THE VACATION OF ARLINGTON AVENUE

AVENUE FROM ITS INTERSECTION WITH LOGAN STREET TO ITS INTER-
SE+CTION WITH BV+I STREET, AS VACATED, SHALL REVr: TO THE
PERSONS DEDICATING SAME OR THEIR SUCCESSORS, HEIRS, OR ASSIGNS;
REPEALING ALL ORDINANCES OR, PARTS OF ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE
AMID IT'S TAKING EFFECT.
Be it ordained by the Mating Mayor and Council of
the City of Caldwell, Idaho:
Section 1. That by Ordinance No. 726, passed by
the Council and approved by the Acting Mayor of the City of
Caldwell, Idaho, on August 2, 1948 and published in The Cald-
well News Tribune, a newspaper published in said City of Cald-
well in one issue thereof, on August 7, 1948, notice was given
to all citizens of and owners of property in the City of Cald-
well, Idaho, that an application had been presented to the Act-
ing Mayor and Council of the City of Caldwell, Idaho, request-
ing the passage and approval of an ordinance vacating Arlington
Avenue from its intersection with Logan Street to its inter-
section with Elm Street, as platted in Dorman's Lakeview Addit-
ion to Caldwell, Idaho, which ordinance provided the manner of
filing objections thereto and for filing claims for damages
which would be sustained by reason of the vacating; of the street
above described.
Section 2. That no objections to granting said
application have been made or filed and no claim or claims for
damages which would result therefrom; and it is hereby determined
that no citizen of or owner of property in the City of Caldwell
will be damaged or injured by the vacation of Arlington Avenue
from its intersection with Logan Street to its instersection
with Elm Street, Dorman's Lakeview Addition to Caldwell, Idaho,
and that it is in fact to the best interest and advantage of
the City of Caldwell, Idaho, and its citizens and its property
owners that the above described street be vacated.
Section 3. Be it ordained and established that
Arlington Avenue from its intersection with Logan Street to its
intersection with Elm Street, Dorman's Lakeview Addition to
the City of Caldwell, Idaho, from and after the passage, app-
roval, and publication of this ordinance, shall be vacated and
shall no longer bd deemed a part of Arlington Avenue in the City
of Caldwell, and that certain portion of said street shall no
longer be open or subject to use by the public; and thereupon
the title to said vacated - portion of Arlington Avenue shall pass
and revert to the persons dedicating same or their successors,
heirs, and assigns, free of all easement and dedication heretofor
existing for a public street thereon.
Section 4. It appearing that no claim or claims for
damages sustained by any citizen or citizens of the City of
Caldwell, Idaho, or by any owner or owners of property therein,
by reason of the vacation of said portion of said street has
been filed or made, it is hereby determined that no damages
will be sustained by the citizens of or owners of property
in the City of Caldwell, Idaho by reason of the vacation of
said portion of street.
Section 5. That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.

APPROVED by the Acting Mayor of the City of Caldwell,
