Be it ordained by the acting I'a-'ror and Council of
the City of Caldwell, Idaho:
;section 1. That the -�aintenance of the oublic health
and sanitation requirea, and' it is the intention hereof, to
i�ap�e the collection, removal and disposal of garbage and rubbish
in the City of Caldi,�Tell compulsory and universal ut.Aer the
L exiusive suPervision of said City.
Sec,Aon 2. That for the - purpose of carrying into
efl.'ect tine �.rovisions of tnis ordinance, there is hereby created
and established a depart-,g,ent of said. City to be k as City
Sanitary Service Department.
Section 3. That the i;'Ian--aper and control of said
department sliall be vested in a conartissioner to be known as
, ,he City Sanitation 3ervice Cotaiissioner, i-, is to be appointed
as hereinafter set forth.
Section 4. That the mayor shall at the time of
appointr. of other ay officers of said city a
the City 3anitary Serv.ce Commissioner, subject to the confirm-
ation of the City Council; that the duties of such comrAssioner
shall be as �,rescribed by this ordinance and such other and
further duties as the city Council may from time to time prescribe.
Section 5. That the City `ianitary Service Corwr:;issioricr,
under the direction of tree City Council, shall have general
supervision over the Earbaee and refuse conditions of the city,
shall direct and supervise the collection, removal and destruc-
tion of aLy and all garbage, offal, and refuse substance under
any and all contracts which may be nereinafter entered into as
set forth in this ordinance.
Section 6. That the collection, removal, disposal,
and destruction of garbage and refuse as contemplated under the
Frovisions of this ordinance, shall be done and performed by
contract coverinE periods not exceeding five (5) years; that
before awarding any such contract the City Council shall cause
to be published in the official newspaper of said City a notice
at least ten (10) days before letting such contract inviting
sealed proposals for the fir LisHnE of all necessary equipment
and for doing the work herein contemplated; that all proposals
shall be sealed and filed with the City Clerk on or before the
hour named therein; the Council shall have the power to refuse
any and all bids, =6 shall award the contract to the person,
who, in their minds, submits the lowest bid and is best qualified
and best equipped to perform the contract contemplated and the
rending of the services .:wade.
That each successful bidder shall furnish corporate
surety bond to the City of Caldnell in the sum of 05,000-00
conditioned upon the faithful performance of his contract and
compliance with all ordinances of the City and all rules, regu-
lations, laws and statutes relating to his business, particu-
larly all rules and rcEulatjons and matters relating to the
maintenance of any dump.
That Ke contractor shall be required to furnish an
appropriate dump an6 maintain it in a sanitary manner immediately
upon awarding of a contract as above stated.
Section 7. That the term "garbage and refuse" as used
in this ordinance shall be taken to mean all waste and discarded
materials from dwellings, fiats, rooming houses, hotels, clubs,
restaurants, boarding houses, eating places, shots and places
of business, including rubbish and KOH, waste and discarded
food, animal and vegetable matter, brush, grass, weeds, waste
paper, c: ns, glass, ashes, offal, boxes and cuttings from trees,
lawns and gardens; "waste" shall not include materials sub-
to manufacture into by-products.
That the term "person" shall mean every natural jerson,
firm, co- partnership, association or corroration.
Section 8. That it shall be the duty of every person
in yossession, charge or control of any d, ellingr, flat, rooming
hou3e, apartment house, zospital, jehool, hotel, club, restaurant,
boardinL Louse or eatinE place, or in possession, charge, or
control of any shop, place of business or manufacturing establish-
ment where garbage and refuse is created or accumulates, at all
times to keep or cause to be kept portable metal cans for the
deposit therein of garbag, and refose, and to deposit or cause
to be deposited the same therein.
That it shall be the duty of the owner of any dwelling.
or flat to furnish or see that his tenants are supplied with
such cans, or in the case of apartment houses with adequate me&ns

That such cans shall be water tight, of Dot less than
ten (10) and not more than thirty-two (32) gallon capacity, shall
have two handles at the sides thereof and tigLt-fitting; metal

That it shall be the duty of every per ion to cause

Section 9. That it shall be unlawful for any Person

Section 10. That the collector of refuse shall collect,
remove , - arb ,
and di si)ose of al-I p ap, and refs se in the residential
sections of the city at least twice each week, i and from hotels,
restaurants boarding "', 0113eS, eating i 1, ces, apartment houses
schools, and hospitals, and in the business sections of the City
of Claldi�,, as required.
Section 11. ThLt ii - upon awarding of a
contract as above stated, ti council, by ordinance, shall than

schedule being the maximum charge that said contractor can charge
for the services rendered.
Section 12. That the (Aty of Caldwell resei the

Section 13. Th all charges for the services rendered
shall be payable to the contractor, and if not paid on or before

suspend service for non-payment of such accounts, but such

section 14. That every I-erson shall dispose of
garbage and ruobish promptly in the manner and in accordance
with the teriiis of this ordinance and upon failure to do so within

Service Commissioner, the City Sanitary Service Commission r

Section 15. Any -, Person who violates disobeys neg-

lects or refuses to comply with, or who resists any of the
provisions of this ordinance shall be deemed. guilty of a mis-
demeanor and. upon conviction thereof shall be fined in a sum
not exceedines • _AG0.00 or be if-riprisoned in the City Jail for
not more than thirty (IC) days or by both such fine and impris-
onment. Section lo. The City of Caldwell shall have the power
from time to time, in an appropriate manner to set forth and
determine rules and regulations, duties, responsibilities,
and such other manners as may be necessary in the discretion of
the Council for the proper ex-ocution. of this ordina
Section 17. The City of Caldwell is hereby empowered
to carry out all the terms and. provisions of tLis ordinance and
to collect and dispose of refuse in the rnilanner provided herein.
Section 18. All ordinances and )arts of ordinances
in conflict herewith, and especially Ordinance No. 419, as same
is embodied i C (,'Ode of 1942, Section 5-401, 5-402,
5-403, 5-464, 5-405, 5-406, 5-407, 5-408, 5-409, 5-418, 5-419,
5-421, and 5-420 insofar as it pertains to Sections 5-401 through
5-409, be, and the same are "nereby repealed, an' any other
ordinance in conflict herewith is amended according to the ter
hereof. however, all existing contracts and rights shall remain
in full force and effect until terminated.
Section 19. Tkiis ordinance shall be in force and
tame effect from and after the date of passage, approval, and
publication.
