BY COUNCILMAN ICI & n a AN ORDIIANCE LICENSING, REGULATING,k ND CONTROLLING THE OPERA- TION OF CHANCE TRIZE GkNi�;S IN THE CITY OF CALD . -ELL, IDAHO; PROHIBITING BINGO, KEENO OR RELATED GAME1S; AND REPEALING ORDIN ii�CE NO. 704 IN SO FAR AS IT PERTAINS TO LICENSING AND OPERATING CHANCE PRIZE GAIES WITHIN THE CITY OF CALD? IDAHO. Be it ordained by the Mayor and Council of the Cif of Caldwell, Idaho: Section 1. DEFINITIONS: (a) The term 'tpersonfl, when used in this ordinance, shall mean and include any person, firm, partnership, corpora- tion, or other association of persons. (b) The term 'ychance prize game", within the meaning of this ordinance, shall be any game in which the obtaining of a prize is based soley upon the chance of the player, upon payment of a consideration, to 'draw or otherwise secure a token number, figure, insignia, character, symbol, letter or word, or combination thereof, which is designated to pay a prize in cash or merchandise. ,(c) The definition of f'chance prize gameP as herein defined shall not be construed so as.to include coin - operated amusement devices as defined by Ordinance No. 702 of the City of Caldwell. Section 2. It shall be unlawful and punishable for any person to keep, maintain, or operate any premises or room wherein any chance prize game is allowed or permitted to be played, used, or operated, or any premises or room wherein any such chance prize game is kept, possessed, or maintained for the purpose of playing, or operation thereof, until a license is granted theretr, by the Council of the City of Caldwell, as in this ordinance provided. Section 3. Application for a license shall be made to the City Clerk, upon a form to be supplied by the City Clerk, which shall provide such information as the Council may require from time to time, and in particular shall provide the.follow- ine information: (a) The name and address of the applicant; if a copartnership, the names and addresses of each thereof; if a_ corporation, association, or combination acting as a unit, the names and addresses of the principal officers and members of the Board of Trustees, directors, or other governing, board. (b) The address and description of the particular premises or room in which the business will be conducted. Section 4. Each application shall be accompanied by the required license fee, which shall be returned to the applicant if the Council shall refuse to issue a license. If the Council shall so order, the City Clerk shall issue a license to the applicant, which license shall at all times be prominently displayed in the place of business of the applicant, and which license shall be issued only for the particular premises or room described therein. Section 5. It shall be unlawful and punishable as a misdemeanor to: (a) For the owner, manager, or person in charge of any premises or room to permit or allow any person to play or operate any chance prize game within or upon such premises or room until a license is procured therefor; (b) To permit or allow, in any manner whatsoever, any person under the age of 21 years to play or operate, in any manner whatsoever, any such chance prize game; (c) For any person under the age of 21 years to play or operate any chance prize game; ) (d) For the owner, manager, or person in charge of any premises or room to permit or allow the playing or opera- tion of any chance prize games involving more than three players including the owner, manager, person in charge of .premises or room, or employee thereof; (e) For the owner, manager, or person in charge of any premises or room to hermit or allow the playing or operation of any chance prize game based upon the principle of the games commonly called "Bingo?', T'Keeno'}, or the like. Section 6. The license fee hereby levied and imposed shall be as follows: (a) For any premises or room where any chance prize game:is permitted and operated and the prize it merchandise only, the sum of Two Hundred Dollars (, per annum; (b) For any premises or room where any chance prize game is permitted and operated and the prize is money, or money and merchandise, the sum of Four Hundred Dollars (3400.00) per annum; Provided, that if any.license issued for less than a full calendar year, the amount collected for such license .shall be prorated as of the actual month of issuance of such license. Section 7. Any person who .,shall violate the provisions of this ordinance shall be fined not more than $100.00 and/or t1Ar&y (30) days in jail at the discretion of the court. Each and every violation of the provisions of this ordinance shall constitute a separate offense. Section 8. Ordinance No. 704 and all ordinances and parts of ordinances in conflict herewith are hereby repealed in so far as such ordinances or parts of ordinances pertain to the licensing and operating of chance prize games within the City of Caldwell, Idaho. Section 9. No license issued under the provisions of this ordinance may be transferred in any manner whatsoever. In the event any licensee shall_ be convicted of the violation of any provision.of this ordinance, the Council shall revoke such license forthwith.. Section 10. This ordinance shall be in full force and take effect on January 1, 1948. PASSED BY the Council this day of December, 1947. APPROVED BY the Mayor this r�!� 'day of December, 1947.
