CALD' IDAHO, SAND REPEALIAIG ORDINANCE NO. 704 Ilvi SO FAR AS

SPINDLE G__h,ES IN THE CITY OF CALDIAIMILL, IDAHO.
Be it ordained by the Mayor and Council of the City
of Caldvrrell, Idaho:
Section 1. DEFINITIONS:
(a) The term 'operson ", when used in this ordinance,
shall mean and include any person, firm, or partnership, corp-
oration, or other association of persons.
(b) A "Punchboard", within the meaning of this
ordinance shall be a board containing a number of holes or
receptacles of uniform size in which are placed slips of paper
or other substance, in a capsul or otherwise, upon which is
Written or printed token numbers, figures, insignia, characters,
symbols, letters, or words, or combinations.`thereof, which may
be punched or drawn from said holes or receptacles by any
person upon payment of a consideration, and who shall obtain
an award of merchandise or money only upon the chance of draw-
ing the token number, figure, insignia, character, symbol, letter
or word, or combination thereof, which has previously been
designated to pay a prize.
(c) The term 4 ichance spindler?, within the meaning
of th.s ordinance, shall be any spindle, stick, pin, or other
device on which may be fastened by any method, slips of paper,
envelopes, cards, or other devices, upon which is written or
printed token rttimharc, figures, insignia, characters, symbols,
letters or words, or combinations thereof, and which may be drawn
by any person from said spindle, or holder, upon };ayment of a
consideration, v , rho may obtain an award of merchandise or money,
only upon the chance of drawing the token number, figure, insignia,
character, .symbol, letter or word or combination thereof, which
has previously been designated to pay a prize.
(d) The definitions of "punchboard" and ?
spindle" as herein defined shall not be construed so as to
include coin - operated amusement devices as defined by Ordinance
No. 702 of the City of Caldwell.
Section 2. It shall be unlawful and punishable for
any person to keep, ivaintain, or operate any premises or room
wherein any punchboard and chance spindle game is alloyed or

permitted to be played, used, or operated, or any premises or
room wherein any such punchboard and chance spindle game is
kept, possessed, or maintained for the purpose of the playing
or operation thereof, until a license is granted therefor, by
the Council of the City of Caldwell, as in this ordinance pro-
vided '.
Sectioi. 3o iiyplication for a license shall be made
to the City Clerk, a form to be supplied by the City Clerk,
which provide such information as the Council may require
from time to time, and in particular shall provide the follow-
ing information:
(a) The name and address of the applicant; if a
copartnership, the names and addresses of each thereof; if a
corporation, association, or combination acting as a unit,
the names and addresses of the principal officers and members
of the Board of Trustees, directors, or other governing board.
(b) The address and descriptions of the particular
premises or room in which the business will be conducted.
Section 4. Each application shall be accompanied by
the required license fee, which shall be returned to the appli-
cant if the Council shall refuse to issue a license. If the
Council shall so order, the City Clerk shall issue a license
to the applicant, which license shall at all times be promin-
ently displayed in the place of business of the applicant,
and which license shall be issued only for the particular
premises or room described therein.
Section 5. It shall be unlawful. and punishable as
a misdemeanor to:
(a) For the owner, manager, or person in charge of
any premises or room to permit or allow any person to punch,
play, use or operate any punchboard or chance spindle Fame
within or upon such premises or room until a license is procured.

(b) Topermit or allow, in any manner whatsoever,
any person under the age of 21 years to punch, play, use or
operate, in any manner whatsoever, any such punchboard or
chance spindle game;
(c) For any person under the aEe of 21 years to
play, use, punch, or operate any punchboard or chance spindle
game.
Section 6. The license fee hereby levied and imposed
shall be as follows:
(a) For any premises or room where any punchboard
or chance spindle game is permitted and operated and the prize
is merch ndise only, the sum of — Seventy -five and No 100
( •ia75•o0 ) DOLLARS per annum;
(b) For any premises or room where any punchboard,
or chance spindle game is permitted or operated, and the prize
is money, or money and ierchandise, : the sum of One hundred fifty
and No /100 (:150.00 ) DOLLARS per annum;
Provided, that if any license is issued for less
than a full calendar year, the.amount collected for such license
shall be prorated as of the actual month of issuance of such
license.
Section 7. Any person who shall'violate the provisions
of this ordinance shall.be fined not more than `;6100.00 and /or
ttfrtg (-3)0) days in jail at the discretion of the court. Each
and every violation of the provisions of this ordinance ahall
constitute a separate offense.
Section a. Ordinance No. 704 and all ordinances
and parts of ordinances in conflict herewith are hereby repealed
in so far as such ordinances or parts of ordinances relate
to tree possession, use, or operation of �unchboards, and for
chance spindle tames 7.� herein defined.
Section 9. No license issued under the provisions
of this ordinance may be transferred in any manner whatsoever.
In the event any licensee shall be convicted of the vb la.tion
of any provision of this ordinance, the Council shall revoke
such license forthwith.
Section 10. This ordinance shall be in full force
and take effect on January 1, 1948.
