Section 1. That by Ordinance No. 710, passed by the
council and approved by the mayor of the City of Caldwell,
Idaho on July 14, 1947 and published in The Caldwell News- Tribune,
a newspaper published in the City of Caldwell, in one issue
thereof on Ju_iy 19, 1547, notice was given to all citizens of
and owners of property in the City of Caldwell, Idaho; that
an application had been presented to the Mayor and Council of
the City of Caldwell, Idaho requesting ne passage and approval
of an ordinance vacating Quincy Street in its entirety as platted
in the Golden Gate Addition to the City of Caldwell, which plat
is now on file and of record in the office of the Recorder of
Canyon County, Idaho; which ordinance provided the manner of
filing objections thereto and for filing claims for damages which
would be sustained by reason of the vacating of the street in
question.
Section 2. That no objections to granting said
application have been made or filed and no claim or claims for
damages have been made which would result therefrom; and it
is hereby determined that no citizen of or owner of property
in the City of Caldwell will be damaged or injured by the vaca-
tion of Quincy Street in its entirety as platted in the Golden
Gate Addition to the City of Caldwell, and that it is in fact
to the best interest and advantage to the City of Caldwell,
Idaho and its citizens and its property o� that the above
described street be vacated.
Section 3. Be it ordained and established that Quincy
Street as platted in the Golden Gate Addition to the City of
Caldwell, Idaho, more particL:larly described in Section 1 hereof,
from and after the passage, approval, and publication of this
ordinance, shall be vacated as a platted street in the Golden
Gate Addition to the City of Caldwell, Idaho and shall no longer
be deemed a street in the City of Caldwell and that that certain
street shall no longer be open or subject to use by the public
and thereupon the title to the said vacated street shall pass
and revert to the owners of all the adjacent and adjoining real
estate,free of all easement and dedication heretofore existing
for a public street thereon.
Section 4. It appearing that no claim or claims for
damages sustained by any citizen or citizens of the City of
Caldwell, Idaho, or by any owner or owners of property therein,
by reason of the vacation of said Quincy Street has been made
or tiled, it is hereby determined that no damages will be sus-
tained by the citizens of or owners of property in the City of
Caldwell, Idaho by reason of the vacation of said street in its
entirety.
Section 5. All ordinances or parts of ordinances
in conflict herewith are tieveby repealed.
Section o., This ordinance shall be in force and
shall take effect from and after its passage, aF,rroval, and
publication.
