of the City of Caldwell, Idaho:
SECTION I.
That by Ordinance No. 658 passed b, .1
T the Council and ap-
proved by the Mayor of the City of Caldwell, Idaho, on March 4,
1946, and published in The Caldwell News-Tribune, a newspaper pub-
lished in said City-of Caldwell in two issues thereof on March
1946, and on March 7 1946, W.tice was given to all
citizens of and owners of property in the City of Caldwell, Idaho,
that an Application had been presented by the owner of a portion
of the abutting and adjacent property, to the tjlayor and Council
of the City of Caldwell, Idaho, for the passage and approval of an
Ordinance vacating the following described alley platted in the
Original Townsite of Caldwell, Idaho:
Beginning at the southerly corner of block 95 of the Original
Townsite of Caldwell, Idaho, as shown on the Revised hap of
Caldwell, Idaho, on file and of record in Book 1 of Plats,

page 5, and Book 1 of Plats, page 20 in the office of the
Recorder of Canyon County, Idaho; running thence southwesterly
on a line which is a continuation of the southeasterly line
of said Block 95, a distance of 16 feet; running thence
northwesterly on a line parallel with the southwesterly line
of said Block 95, a distance of 300 feet;'running thence
northeasterly bn a line which is a continuation of the - North -
rresterly line of said Block 95, a distance of 16 feet to the
point of intersection with the westerly corner of said dock
95; running thence southeasterly along the southwesterly line
of said Block 95 to the point of beginning
which Ordinance provided the manner of making objections thereto
and of ascertaining damages which would be sustained by reason of
the vacation of said alley.
;SECTION II.
That no objection to granting said application has been
:Wade or filed and no claim or claims for damages which would result
therefrom have been filed; and it is hereby determined that no
citizen of or owner of property in the City of Caldwell, Idaho,
will be damaged or injured by the vacation of said alley, and that
it is in fact to the best interests and advantage of the City of
Cald Idaho, and its citizens and its property owners that the
above described alley be vacated.
SEC T IMI III.
BE IT ORDAIN 41D ESTABLISHED That said alley platted
in the Original Tovvrnsite of Caldwell, Idaho, from and after the
passage, approval and publication of this Ordinance shall be
vacated,as a platted alley and shall no longer be deemed an alley
or thoroughfare of the City of Caldwell, and shall no longer be
open for or subject to use by the public; and thereupon the title
to said alley, as specifically described in Section I of this
Ordinance shall pass and. revert to the respective owners of all
of the abutting and adjacent property thereto, as follows:
The northeasterly ono-half thereof, being a tract of land

Block 95 of the Original lownsite of Caldwell, Idaho,

to Idaho Egg Producers, a cooperative marketing corporation;
The southwesterly one -half thereof being a tract of land
eight feet in width and 300 feet in length adjoining the
northeasterly line of the riht of gray of the Oregon Short
Line eLailroad
to the Oregon Short .pine railroad Company, free of the easement
or dedication heretofore existing for public street thereon.
SECTION IV.
All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
Passed by the Council of the City of Caldwell this 18th
day of iparch, 1946.
Approved by the :Aayor of the City of Caldwell this 18th
day of March, 1946.
