in said City of Caldoell in two issues thereof on January 8, 1946
and January 9, 1946, S4otice z given to all citizens of and oviners
of pi-operty in the City of Galdv Idaho, that an application had
been presented by the oviner of all of the ab and adjacent
property, to the :mayor and. �%ouncil of the City of Cald Idaho,
for the passage and approval of an Ordinance vacating those portions
of 23rd . and Hazel . in the Uity of OaldvWell, - "aaho,

which Ordinance provided the manner of makin.7 objections thereto and
of ascertaining daiiiages which would be sustained by reason of the
vacation of those portions of said streets.
Objections to rantinu said application having been filed
Ln she form of petitions, and oral objections having been made and
tnose objections having been considered by the council at its meet -
in held on January 14, 1946, and at its meeting held on February 4,
1946 (consideration of the application having been postponed, by
resolution, from said meeting on January 14, 1946, to the meeting
on February 4, 1946) it is hereby deterriined that no citizen of or
owner of oroperty in - the City of Calds, Idaho, will be damaged or
injured by the vacation of said portions of said streets, and ir"rdkr
it is to the advantage and best interest of the City of C"ald-

well, Idaho, and its citizens and itsproperty o' that the above
described portions of said streets be vacated.
13E IT 011DAINED !V ij TABLI LD That the portions of said
23rd �Lvenue and hazel street in the City of Caldwell, Idaho, parti-
cularly described in Section I hereof, from and after the passage, I
approval and publication of this Ordinance shall be vacated as
platted streets and each shall no longer be deemed a street or
thoroughfare of the City of CaldvLell, 1daho, and shall no longer be
open for or subject to use by the public; and thereupon the title
to those vacated nortions of said streets shall revert to the College
of Idaho, Lhe owner of all of th- adjoinin rind adjacent real prop-
erty, one-half on oacn side thereof, free of the easement or dedica-
tion heretofore existing for public streets thereon.
SECTION III.
It appearing that no claim or claims for damages sustained
by any citizen or citizens of the City of Cald Idaho, or by
any ouner or oymers of property therein, by reason of the vacation
of said portions of said streets have been filed. or i it is
hereby C'A'eter >,ined that no ciarrlages till be sustained by the citizens
of or ovuners of property in the City of Caldwell, Idaho by reason
of the vacation of said, portions of streets.

Tnat all ordinances or Darts of ordinances in conflict
herewith are hereby repealed.
