That by Ordinance 1 651 passed by the Council and
approved by the Wlayor of the City of Caldwell, Idaho, on :February
4, 1946, and published in The Caldwell News-Tribune, a newspaper
plablished in said City of Cald�vell, in two issues thereof on Feb -
ruary

Tract 1.

of Canyon County, Idaho; running thence 21'ast a distance
of 22.5 feet; running thence Aorth parallel with the Last line
of Blocks 57, 61, 64 and 68 of said lWountain View Addition to
a point due Last of the Eortheast corner Of said Block 68;
runnin,g thence -est a distance of 22.5 feet to the `northeast
corner of said Block 68; running thence mouth along the East
line, of said Blocks 57 to 68 inclusive to the point of com-
mencing; also

Commencing at the orthvrest corner of block 74 of ountain
View Addition to Caldwell Idaho as shown on the official
Flat thereof on file and of record in the office of the he Re-
dorder of Canyon County, Idaho; running thence 'd'-'est a distance
of 22.5 feet; rixnniag thence 'youth parallel with the -est
line of Blocks 74, 78, 81 and 85 of said i View Addi-

wnich Urdir-ance provided ti`ie of making objections thereto
and of ascertaining damages which viould, be sustained by reason of
the vacation of said portions of said College -Avenue.

That no objection to granting said application has been
made or filed and no claim or claims for damages which would result
therefrom have been filed; and it is hereby deter-mined that no
citizen of or o of property in the City of Caldwell, Idaho,
will be daniaged or injured by the vacation of said portions of
said College "venue and that it is in fact to the best interests
and advantage of the City of Caldwell, Idaho, and its citizens
and its property omners that the above described portions of said
College Avenue be vacated.
BE IT ORDAT-N-J"D RAD That the portions of said
College `.venue in the City of Caldwell, Idaho, particularly des-
,
cribed in _ection I hereof, from -and after the passage, approval
and publication of this Ordinance shall be vacated as platted

portions of said College Avenue and shall no longer be deemed a
part of that avenue as a street or thoroughfare in the City of
Caldwell, Idaho, and. those portions of said College Avenue shall
no longer be open for or subject to use by the public; and there-
upon the title to the portions of said vacated Tract 1, adjoining
and adjacent to each of the lots in Blocks 57 to 68 inclusive of
fountain View Addition to Caldwell, Idaho, as shown on the official
Flat thereof on file and of record in the office of the Recorder
of Canyon County, Idaho, and encompassed by the extended north and
south boundary lines of each lot in those blocks, shall pass and
revert to the present owner of each such adjacent and adjoining
lot, free of the easement or dedication heretofore existing for a
public street thereon; and thereupon the title to said vacated Tract
2 adjoining and adjacent to each of the lots in Blocks 74 to 85
inclusive of mountain View :addition to Caldwell, Idaho, as shown
on the official Plat thereof on file and of record in the office
of the Recorder of Canyon County, and encompassed by the extended
north and south boundary lines of each login those blocks, shall
pass and revert to the present owner of each such adjacent and ad-
joining lot, free of the easement or dedication heretofore existing
for a public street thereon.
SECTION IV.
It appearing that no claim or claims for damages sustained
by any citizen or citizens of the City of Caldwell, Idaho, or by
any owner or owners of property therein, by reason of the vacation
of said portions of said streets have been filed or made, it is
hereby determined that no damages will be sustained by the citizens
of or owners of property in the City of Caldwell, Idaho, by reason
of the vacation of said portions of street.
SECTION V.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
