AN ORDINANNCE GIVING NOTICE TO ALL C ITIGEN S OF, AND OffiXERS OF
PROPERTY IN THE CITY OF CALDkELL, THAT AN APPLICATION HAS BEEN
PRE6ENTED FOR THE VACATION OF A PORTION OF MICHIGAN AVENUE AND
23RD AVENUE IN THE CITY OF CALDVuELL, IDAHO; PROVIDING FOR FILING
OBJECTIONS THERETO AND FOR FILING CLAIMS FOR DAMAGES SUSTAINED
THEREBY; PROVIDING FOR ASCERTA3 ING SUCH DAMAGES BY THE MAYOR AND
COUNCIL OF THE CITY OF CA.LDWELL; AND PROVIDING FOR THE PUBLICATION
OF THIS ORDINANCE.
BE IT ORDAINED AND ESTABLISHED by the Mayor and Council
of the City of Caldwell, Idaho:
I.
That an application has been presented to the Mayor and
Council of the City of Caldwell, Idaho, for the passage and appro-
val of an Ordinance vacating the following described portions of
Michigan Avenue and 23rd Avenue in the City of Caldwell, Idaho,
TRACT I•
Beginning at the Southeasterly corner of Block 2 in
College Heights Addition to Caldwell, Idaho, as shown on the
official Plat thereof on file and of record in the office
of the Recorder of Cm yon County, Idaho; running thence
North along the Vilest line of Michigan Avenue (that being
the East line of said Block 2) and continuing on an exten-
sion of that line to the point of intersection with the
Northwesterly line of 23rd Avenue in the City of Caldwell,
Idaho; running thence Northeasterly along the Northwesterly
line of said 23rd Avenue to the point of intersection with
the Southwesterly line of Cleveland Boulevard in the City
of Caldwell, Idaho; running thence Southeasterly along the
Southwesterly line,of said Cleveland Boulevard to the point
of intersection with the Southeasterly line of said 23rd
Avenue (that being the North corner of said Block 1 of Col-
lege Heights Addition to Caldwell, Idaho) running thence
Southwesterly along the Southeasterly line of said 23rd
Avenue (that being the Northwesterly line of said Block 1)
to the point of intersection with the East line of said
Michigan Avenue; running thence South along the East line
of said Michigan Avenue (that being the Vest line of said
Block 1) to the Southwesterly corner of said Block; running
thence West to the point of beginning; also
TRACT II:
Beginning at the North corner of Block 3 in College
Heights Addition to Caldwell, Idaho, as shown on the official
Plat thereof on file and of record in the office of the re-

corder of Canyon County, Idaho; running thence North to the
point of intersection with the Northwesterly line of 23rd
Avenue in the City of Caldwell, Idaho; running thence South-
westerly along the Northwesterly line of said 23rd Avenue
to a point due West of the West corner of said Block 3;
running thence Bast to the :'nest corner of said Block 3 (that
being on the Southeasterly line of said 23rd Avenue); run-
ning thence ;Northeasterly along the Southeasterly line of
said 23rd Avenue (that being the Northwesterly line of said
Block 3) to the point of beginning.
In which Application the applicant was the owner of all of the
property abutting and adjacent to said portions of said streets;
all of the real property abutting and adjacent to the above des-
cribed portions of said streets, is a part of the campus of the
applicant, The College of Idaho.
That in the event of the vacation of said portions of
Streets by Ordinance adopted by the Council of the City of Cald-
well, Idaho, and approved by its Mayor; the applicant agrees to
execute and deliver to the City of Caldwell a good and sufficient
Deed covering the following described tract of land:
Beginning at a point on the Northeast boundary line of
Block 1 of College Heights Addition to the City of Caldwell,
Canyon County, Idaho, which is North 46 West, 129 feet
from the Northeast corner thereof and bearing ,south 43
West 257 feet to the intersection of the East boundary line
of Michigan Avenue of the aforesaid City of Caldwell; thence
North 34 feet along the East boundary line of the aforesaid
Michigan Avenue to the intersection of the North boundary
line of Hazel Street of the aforesaid City of Caldwell;
thence West 50.4 feet along the North boundary line of the
aforesaid Hazel Street; thence North 43 East 267 feet to
the intersection of the Northeast boundary line of the afore-
said Block 1; thence South 46 East, 60 feet along the
Northeast boundary line of the aforesaid Block 1 to the point
of beginning,
to become and be used as a public street, the width of the traveled
portion (from curb to curb) to be 40 feet.
II.
That said Application will be considered under a suspen-
sion of the requirement that an Ordinance be read on three different
days at a meeting of the Council of the City of Caldwell to be held

on the .L_l�� day of 1 "r ),99C6L , 1946, at the hour of 8:00
of Block P.M., at the Council Chambers in the City Hall in the
City of Caldwell; when and where, or prior to which date, any
citizen of the City of Caldwell or any owner of property in the
City of Caldwell may file with the Clerk of the City of Caldwell
written objections to granting said application or may file any
claim for damages which any such citizen or owner of property
may sustain by reason of the vacation of said portion of the said
streets, so filed, and all claims for damages will be considered
and ascertained by the Council of the City of Caldwell at said
meeting.
III.
Notice of the foregoing shall be given to all citizens
of, and owners of property in, the City of Caldwell, Idaho, by
the publication of this Ordinance in The Caldwell News- Tribune,
a newspaper published in the City of Caldwell, Idaho, in at least
one issue thereof and commencing with the issue published on
1J , 1946.
