SAID CITY; PROVIDING THAT THIS ORDINANCE SUPERSEDE ANY ORMIANCES
OR PART THEREOF IAN CONFLICT HEREa,PITH; AND PROVIDING THE EFFECTIVE
DATE .OF THIS ORDINANCE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
CALDbiF,LL, IDAHO:
Section 1. It shall be.unlawful for any club-as defined in
the Idaho Coin Operated Amusement Device Control Act (Chapter
112 of the 1945 Idaho .Session Laws) to.own or conduct or operate,
and far any member or person in attendance at h club to play,
a coin operated amusement device, as defined in said act, within
the limits.of. the City of Caldwell, Idaho,. unless such club shall
have applied for and received a license from the State of Idaho
as provided for in said :pct, and also a license from the City of
Caldwell, as provided for in this Ordinance. Any violation thereof'
shah constitute a misdemeanor, and any club or person convicted
thereof shall be fined in a sum not exceeding one hundred dollars
($100.00).

Section 2. Application shall be made for such license to
the Clerk of the City of Caldwell upon . a form -as prescribed by
said Clerk; and with such application the applicant shall exhibit
the license for the period as covered by the application'issued to
the applicant by the Department of Law Enforcement of the State
of Idaho.' Upon making a proper application and payment of a fee
of x;;50.00 per year for eachs.uch.coin operated amusement device
owned or operated by such club, the Clerk of the City of Caldwell
is hereby authorized to issue a license to the applicant club for
the operation of coin operated amusement devices. All fees for
licenses shall become due and payable on.the 1st day of July of
each year or at the time such club shall commence business; in
the former case the fee shall be computed for one year; in the
latter case the fee shall be computed proportionately for a period
commencing on -the lst day of the month in which liability for the
license is initiated, and terminating on the 30th day - of . June fo
lowing. Liability for the license will be deemed initiated when
such device is maintained for use on the club's premises.
Section 3. The Clerk of the City of Caldwell, Idaho, is hereby
authorized to suspend any license issued to any club or to revoke
the same whenever the license issued to such club by the State
of Idaho has been suspended or revoked by the Commissioner of Law
ihforcement of the State of Idaho, such suspension of license to
be for the same period of time as that specified by said Commissioner.
Section 4. All license fees collected by the Clerk of the
City of Caldwell under the provisions of this Ordinance shall be
paid by said Clerk to the Treasurer•of the City of Caldwell, and
shall be and.become a part of the general fund of the City of
Caldwell, Idaho.
,Section 5. Should any provisions of the existing ordinances
or parts of ordinances of the City of Caldwell be in conflict

with the provisions of this ordinance,the .provisions of this ordi-
nance shall control and supersede all such existing ordinances,
Section 6. This ordinance shall be in farce and shall take
effect from and after, passage, approval and publication,.
