An ordinance to regulate the building of sidewalks and
crossings in the city of Caldwell.
Be it ordained by the mayor and Council of the city of
Caldwell.
Section 1••• All sideyvalke hereinafter laid in the city
of Caldwell shall be con structedj maintained' in the manner
and form hereinafter pet forth in this Wdinanace•
Section 2• The height of the exurbs shall be six inches
above the grade of the street, as the same has been or shall
be hereafter established by the city council.
Section 3.- sidewalks constructed within the fire
limits of the city ;yCalaiwell shall be c onstructed of cement;
said sidewalk to be composed of three inches of concrete con -
sisting of eight parts gravel and one part of cement overlaid
with 3/4 inch of cement and sand, consisting of four parts
sand and two parts cement; and 1/4 inch pure cement said
sidewalks Ito be twelve feet wideumeasuftng ftom -.the lfn6:of the
block to the outside of the curb' accordance with the grade
already established.
Section 4-- Upon all other streets and avenues, the side-
walks shall conform to one of the. following plans of construe -
tion, which plans shall be known as plans 2, 3, and 4 of this
ordinance. Under plan 2, the sidewalk shall be five feet
wide', and shall be constructed 'of cement; said sidewalk shall
be overlaid with three inches of concrete consisting of eight
parts gravel and one part cement; overlaid w3.th'3l4 of

Section 5.- Upon a petition being presented: to the'eitY
council, for the :oonstruotion,of'alsidewalk in any portion
of the 'streets of the city of Caldwell, the city conncil,
by resolution, order that said sidewalk or any portion ithereof,
be constructed; said order to state the plan under which Bvt d

the same is t.o be conatrs�cted, and'shall require the property' - ;
owners in front of which the .same—is to be constructed, to
construct the a within 60 days after the publication
of suchlresolution• The :said resolution shall be `published

city of Cal& well, Idaho. - Provided that by two - thirds vote

Section 6. When.ary si,dewalk,is.arder.ed constructed
along any .of,the..streets of the. city where the g;°adelhss_ been
est4blished.by ordinance, the grade of the sidewalk will
confosan to that so established by ordinance. . When a ,sidewalk
shall be ordered constructed in accordance with plan one and
plan'twolover streeta or portions of streets, the grade of.
which has.not.been established by.ordinanoe,,the grade of

established, the same shall.be perm a nent, and the surveyor's
wnotes in the establishment of said grades shall be riled of
record in the office of the city,.clerk, And the same. .shall be

to be constructed, according to plan 3, when not.estab?ished .
by ordinance, shall be such as maylbe designated.b;f the street
oommittee•.(when a walk is ordered to be constructed according
to pls,n 4, the, some ,shall bel constructed on the surface of
the ground without reference to grade.'
Section 8.,- Whenever the property owners in,front of
/--whose property the sidewalk,has been ordered as hereinbefore
provided, shall construct the same in pursuance of-such order,
they shall on completion of the sidewalk, notify th &, --
e g who.. shall1.1mmediately.inspect and examine the walk
so constructed and if it has been constructed in accordance
with the..provisions of this ordinance, he shall report the

same to the city council who accept the . same on behalf
of the city.. ,If the ssme has not been - construote in Accord-
ante with the provisions,.of thisjordinenas, the .` ,
shall notify the property owners of any defects in such con- {;
struetion, and require them to complete such construction

of such .sidewalk in accordance with the provisions Of this
ordinano.e.
Section 6.- Whenever a.sidewalk or any,pertion thereof,
which has been ordered as ;herein before provided, shall not
be constructed within the time ppegified by the notice provided
for.in section-5 of,this,ordinance, by. ownerajof the lots
in front of. which such sidaralk is to be constructed, the
city of Caldwell shall then construct the same by contract, 4
let to the loviest bidder, after ten days notice given by the
Mayor, upon.an order of the council, published.in at least
one issue Of some newspaper, which notice shall describe
; briefly the walk to be oonetmoted and the time and place
for the opening of bide for such construction.
Section 9.- vyhenever any sidewalk or any portion thereof
shall be constructed by the city of Caldwell, as provided in
this ordinance the cost of such construction shall be app ®r -
tioned to the, number of .feet of the .lot or Irate

abutting upon the sidewalk so constructed, and the cost of
such oonstruction shall be levied and assessed by the council
in proportion to such frontage, against the property front
of which the same is constructed. Such assessment shall be

shall be securely spiked to the cures and sill with not less
than 40 -penny nails.
Section lg�_ All ordinances in conflict with this ordinance
are hereby repealed.
